Performance Work Statement (PWS)

PSFR Parcel Dairy Remediation

1. Overview – This PWS identifies tasks to be completed for the PSFR Parcel Acquisition Remediation.

With the operation of the Potholes Supplemental Feed Route (PSFR), certain properties adjacent to Crab

Creek are expected to see increases to the ground and surface water on the properties. One such property expected to be significantly impacted by PSFR flows is the Dieringer Dairy property. Due to the expected increase in surface water, the property will no longer be compatible with its current use as a working dairy farm and will need remediation services. The Crab Creek portion of the PSFR is planned to carry irrigation water to the Potholes Reservoir as early as Spring 2024

The Dieringer Dairy property (Grant County Parcel 170934000) is located at 9327 Road 10 NE, Moses

Lake, WA 98837

2. General Terms of the Contract – Contractor must perform all tasks necessary to complete the

Dieringer Dairy property contamination remediation and obtain a No Further Action letter for the property from the WA Dept. of Ecology (Ecology).

a) No additional information.

b) No additional information.

c) Any changes on this PWS to the geographic location where the work is to be performed (office or field), the period of performance, the deliverables required, performance work statement and all other pertinent data requires a bilateral modification, in advance, between the Contractor and

Contracting Officer.

3. Communication and Coordination

a) Contractor will conduct a project update meeting with Reclamation every two weeks at a recurring time/day negotiated with the COR.

b) Contractor shall provide daily work-completed reports to the COR and Reclamation inspector. Reports shall include any safety incidents.

c) No additional information.

4. Non-Personal Services - If the contractor believes that any actions constitute, or are perceived to constitute personal services, it must be the contractor's responsibility to notify the CO immediately.

5. Professional Qualifications - The contractor must accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience to successfully complete the requirements in this PWS.

6. Site Work

a) The contractor must perform all tasks necessary to complete the PSFR Parcel Acquisition remediation and reporting described below.

b) Site Work

i) Contamination Remediation

(1) Purpose, Scope, and Other Work Features

As part of the environmental due diligence, Reclamation contracted with White Shield, Inc. (Pasco, WA) to conduct environmental assessments. Those assessments (attached) revealed several locations on this property where operations of the dairy farm have created environmental situations that must be remediated before Reclamation and

Ecology can determine that the property is acceptable for PSFR water inundation.

Additional contamination could exist, if discovered, would require the contractor to notify the

COR immediately.

Contractor will remediate these areas to the satisfaction of Ecology regulations and

Reclamation so that the PSFR can be utilized without surface or groundwater contamination from the property. The property shall be remediated to the standard where Ecology will issue Reclamation a No Further Action letter.

The contractor shall conduct work on approximately 103 acres of federal lands in Grant

County, Washington (see attached map). The PSFR Parcel Acquisition Remediation project is a component of the Potholes Supplemental Feed Route (PSFR) and consists of remediation of recently acquired property (Grant County Parcel 170934000) in preparation for use of the Crab Creek portion of the PSFR to carry irrigation water to the Potholes Reservoir as early as Spring 2024. Remediation is an action of reversing or stopping environmental damage and is generally referred to as reclamation.

Location and Access: The work areas are contained within a parcel consisting of approximately 103 acres of federal land in Grant County, Washington, in Township 20

North, Range 28 East, Section 15 (Grant County Parcel 170934000). Access to the property is from County Road 10 NE along the northern and eastern boundaries.

Testing Inventory Methodology: When contamination testing is required the contractor must collect, maintain the chain of custody, and test the sample through an independent lab in adherence with generally acceptable principles and methodology for environmental testing. Sample locations must be GPS’d and photographed.

All work will be performed in accordance with the requirements laid out in the

Inadvertent Discovery Plan that will be provided to the Contractor. If the contractor identifies any unusual or threatened artifacts that warrant collection, they must immediately stop work and consult with Reclamation’s COR and the Columbia-

Cascades Area Office archaeologist.

Site Recordation and Evaluation: The locations of all contaminated areas must be

GPS’d, photographed, and documented prior to any work. The remediation process must be documented through notes, photographs, and confirmation testing.

Reporting: Upon completion the various remediation tasks, the contractor must prepare draft remediation reports followed by a final all-encompassing report incorporating comments provided by Reclamation.

(2) Specific Tasks/Services Required

The contractor shall furnish all staff, including supervision and administration, basic materials, supplies, travel, labor, and equipment required for the work listed in this

PWS.

TASK 1 – PROJECT PLANNING

Task 1.1 - The contractor shall submit to Reclamation a Feasibility Study/Draft Clean-

Up Action Plan. The plan shall be constructed from and meet the requirements of

Ecology for Feasibility Studies and Cleanup Action Plan Checklists. Plan shall also include a confirmation sampling plan, Ecology test standards and levels for No Further

Action, and outline the necessary permits for remediation. Cleanup Action Plan

Checklist (wa.gov).

a) Include a plan for Reclamation approval to remove as much of the surface manure (including inside of the buildings) on the property as practically https://apps.ecology.wa.gov/publications/documents/1609008.pdf https://apps.ecology.wa.gov/publications/documents/1609008.pdf feasible.

b) Include a decommissioning plan for the north and south dairy waste lagoons in accordance with applicable federal and state requirements, conforming to the most stringent requirement in cases of conflict between specifications and regulatory requirements. Attached is the White Shield, Inc. decommissioning report for reference.

c) WA Dept. of Ecology Guidance for Remediation of Petroleum Contaminated

Sites

d) Contact Ted Uecker (tuec461@ecy.wa.gov, 509-342-5564) at Ecology for assistance prior to drafting the Cleanup Action Plan

Task 1.2 - The contractor shall submit to Reclamation a proposed Site Cleanup

Schedule based on the tasks outlined. Note: the schedule should take into account the equipment needs to access to various areas of the property as seasonal surface water tends to be shallower in the spring and deeper in the fall.

Task 1.3 – The contractor shall submit to Reclamation a Reclamation--approved Final

Cleanup Action Plan with schedule.

Task 1.4 – The contractor shall obtain all necessary permits and email proof of permitting research and obtained permits to the COR.

a) Potential permitting needs may include but are not limited to: USACE 404, ECY 401, HPA, EPA 402 (due to federal operator clause), etc.

b) Contactor shall state clearly on all permits that they are working for

Reclamation on a Reclamation project.

STANDARDS

1. The contractor shall complete these tasks by the dates outlined in the PWS deliverables table in Section 9 below.

TASK 2- FIELD WORK

Task 2.1 - The contractor shall research, locate, disconnect, abandon, and remediate the existing north end residential septic system (including drain fields or sand mounds, if necessary) in accordance with WA State (RCW 90.48, WAC 173-200 and 201), Grant County, and any other applicable regulations. Provide proof to COR via email that Grant County has signed off that the system is properly abandoned.

Task 2.2 - The contractor shall research, locate, disconnect, abandon, and remediate any on-site wastewater disposal facilities located in the dairy operations area

(including drain fields or sand mounds, if necessary) in accordance with WA State

(RCW 90.48, WAC 173-200 and 201), Grant County, and any other applicable regulations. Provide proof to COR via email that Grant County has signed off that the system is properly abandoned.

Task 2.3 - The contractor shall research, locate, disconnect, abandon, and remediate the south end residential septic system (including drain fields or sand mounds, if necessary) in accordance with WA State (RCW 90.48, WAC 173-200 and 201), Grant

County, and any other applicable regulations. Provide proof to COR via email that https://apps.ecology.wa.gov/publications/documents/1009057.pdf https://apps.ecology.wa.gov/publications/documents/1009057.pdf mailto:tuec461@ecy.wa.gov https://granthealth.org/septic-system-oss/ https://granthealth.org/septic-system-oss/ https://granthealth.org/septic-system-oss/ https://granthealth.org/septic-system-oss/

Grant County has signed off that the system is properly abandoned.

Task 2.4 - The contractor shall delineate any existing wetlands on the property according to the Eastern Washington Wetland Rating System https:/ecology.wa.gov/Water-Shorelines/Wetlands/Tools-resources/Rating-systems.

a) Stake boundaries of any wetlands delineated, prior to commencing any work

(disconnections, abandonment, etc.).

b) Provide to Reclamation’s COR via email or secure download site the GIS shapefiles of the delineated wetlands.

Task 2.5 - The contractor shall decommission and remediate as per WA Dept. of

Ecology, US Dept of Agriculture (Agriculture), and any other applicable regulations the existing manure ponds including the pumping system. This will entail pumping and hauling for disposal of all liquids and solids considered pollutants by Ecology.

The manure ponds are adjacent to wetlands; contractor shall obtain all necessary permits (see Task 1.4). An impermeable barrier shall remain between the manure ponds and the adjacent wetlands at all times until all contamination has been removed from the site. After testing has proved the contamination has been remediated, breach the barrier to the wetlands so water cannot pond. Provide proof to COR via email that

Ecology and Agriculture have concurred that the manure ponds have been properly abandoned.

a) Before final restoration steps, provide to COR confirmation sampling report from an independent lab proving contamination has been removed.

b) Attached example references include, but may not be limited to or applicable, NRCS Practice Standard, Ecology CAFO Fact Sheet, and Ecology CAFO

Permit requirements.

Task 2.6 - The contractor shall remove and remediate the manure handling system

(just south of the loafing shed) and detectable VOCs and petroleum related contaminants in the vicinity. Demolish, haul offsite, and properly dispose of the associated equipment and facilities.

a) Provide to COR confirmation sampling report from an independent lab proving contamination has been removed.

Task 2.7 - The contractor shall collect and dispose of the site manure in accordance with the Reclamation-approved plan from Task 1.1.

Task 2.8 – To limit further runoff, the contractor shall place silt fence 10 linear feet upslope of the 1107’ elevation contour line from the west property line to the fence separating the dairy from the pivot field.

Task 2.9 – The contractor shall remove and properly dispose of all barrels and other containers in the diary operations buildings that contain or could potentially contain hazardous materials.

Task 2.10 - The contractor shall clean and properly dispose of manure, semi-volatile petroleum products, and any other contaminants on the calving shed floor.

Task 2.11 - The contractor shall determine the extents of the hydrocarbon contamination in the vicinity of the former above-ground diesel tank on the west side of the commodity shed and provide the COR with a map and sampling results showing https://ecology.wa.gov/Water-Shorelines/Wetlands/Tools-resources/Rating-systems the extents.

Task 2.12 - The contractor shall remediate hydrocarbon-contaminated soils in the vicinity of the former above-ground diesel tank on the west side of the commodity shed and provide to the COR confirmation sampling report proving contamination has been removed.

Task 2.13 - The contractor shall complete all confirmation sampling as outlined in

Task 1.1 and submit results to the COR.

STANDARDS

1. The contractor shall complete fieldwork by May 31, 2024.

2. Any sample results that are returned as positive above levels acceptable by Ecology

(as outlined in Task 1.1), will require that the contractor again perform the associated remediation task and retest.

TASK 3 – WA Dept. of Ecology No Further Action Letter

Task 3.1 – Contractor shall obtain from Ecology and submit to the COR a No Further

Action letter as proof of acceptable remediation.

STANDARDS

1. The contractor shall complete by May 31, 2024.

2. Contractor shall reperform to the satisfaction of Ecology any listed Tasks that has a level of incompleteness or quality that prevents Ecology from issuing the No

Further Action letter.

7. Quality Control

a) All submittals (where applicable) must be approved by both Reclamation and Ecology.

b) All remediation must be done to the satisfaction of Ecology towards the goal of a No Further

Action letter for the subject property.

c) All sample testing should be taken with generally acceptable sampling techniques, chain-of-custody documentation, and analyzed at an independent lab.

DOI-AAAP-0050 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (DEC

2015)

1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts.

The Department of the Interior (DOI) has implemented the Contractor Performance Assessment

Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR

42.15.

2) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report.

Once the report is processed, it is available in the Past Performance Information Retrieval System

(PPIRS) for Government use in evaluating past performance as part of a source selection action.

3) We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the

Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.

4) When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.

5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.

a) Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.

c) All information provided should be reviewed for accuracy prior to submission.

d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.

e) Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

f) If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the

Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."

6) The following guidelines apply concerning your use of the past performance evaluation:

a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.

http://www.cpars.gov/ http://www.cpars.gov/

b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.

7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the

CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
