The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.
(o) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
(p) Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.

(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. (iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.

Statement of Work Soil Analyses for the Alaska Inventory and Monitoring Network Vegetation Monitoring Program
GENERAL: The Blanket Purchase Agreement (BPA) Holder/Contractor shall furnish all labor, management, supplies, equipment and material (other than those identified herein to be provided by the Government) and do all things necessary for performance of the work as set forth below. The Contractor shall provide the Government all requested reports, and supporting material developed during the period of service. During the prosecution of the work, the Contractor shall provide adequate professional supervision and quality control to assure the accuracy, quality, completeness and progress of work.
PERSONNEL: The Contractor shall provide personnel, equipment and time needed to complete the tasks identified under “Description of Tasks” below.
BACKGROUND: The National Park Service Inventory and Monitoring (I&M) Program was established to provide robust scientific information regarding the status and trends of critical natural resources in the National Parks. There are 32 multipark networks in the I&M Program. One, the Central Alaska Network (CAKN), consists of Yukon-Charley Rivers National Preserve, Denali National Park and Preserve, and Wrangell-St. Elias National Park and Preserve, and covers 22 million acres, or 25% of all land administered by the National Park Service nationwide. A critical part of the CAKN I&M Program is the vegetation monitoring component, which has been developed to monitor status and trends in vegetation structure and composition in the three park units. Critical to a full understanding of vegetation distribution is spatially linked assessment of edaphic characteristics. Thus, highly accurate and repeatable quantification of the physical properties and concentrations of key constituents in collected soil samples is essential to the mission of the individual parks and the I&M Program. Because some of the constituents (i.e., chloride, certain heavy metals) are present at extremely low concentrations in the largely pristine soils of CAKN parks, highly specialized methodologies are required to attain the level of data quality we require.
DESCRIPTION OF TASKS: The services to be provided for the vegetation monitoring program shall include the following:
1. Analysis of soil samples for all of, or a subset of, the following physical characteristics and chemical properties (methodologies in parentheses):
a) soil moisture determined gravimetrically in two stages: 1) determining percent moisture lost from field wet weight to air dry weight; and 2) determining moisture lost from air dried weight to oven-dried weight (of subsample)
b) soil texture (Bouyoucos hydrometer method)
c) sieve analysis (% gravel > 2mm by weight of the air dried sample)
d) pH (1:1 soil to water ratio)
e) total C and total N (via an elemental analyzer using the sieved, air dried sample)
f) electrical conductivity
g) chloride (ion chromatography, method detection limit 0.25 ug/g +/- 0.1 ug/g)
h) calcium (inductively coupled plasma optical emission spectrometry (ICP-OES), method detection limit 1.5 ug/g +/- 0.5 ug/g)
i) heavy metals (Hg, Pb, and Cd - Inductively coupled plasma mass spectrometry (ICP-MS) - this method and the requested method detection limit of 0.015 ug/g +/- 0.01 ug/g applies to all three metals)
2. Testing of each soil sample with fall broadly into one of three testing groups, with specific tests requested of each sample to be indicated in the included inventory:
140P9722Q0027 Page 17 of 39
a) Testing Group A will include tests a-e above
b) Testing Group B will include tests d, f, g, and h above
c) Testing Group C will include all tests in Group B plus analysis of select heavy metals
(specifically Hg, Pb, and Cd)
3. Laboratory specifications:
a) Must be experienced in the analysis of low-level concentrations in soil samples from natural systems.
b) Must put all personnel through a comprehensive training program on laboratory practices.
c) Must have the capacity to analyze > 2,000 soil samples per year with experience with > 100 different testing methods.
d) Certified by the North American Proficiency Testing (NAPT) for five years or more.
e) Maintain certification by the North American Proficiency Testing - Performance Assessment
Program (NAPT-PAP).
f) Must use prepared National Institutes of Standards and Technology (NIST)-traceable calibration standards.
g) Must provide a detailed Quality Control/Assurance Plan to CAKN.
h) Must, when sample volume allows, run duplicate analyses for 10% of samples per analysis.
i) Must be located within reasonable geographic proximity to Alaska (<2,500 miles), so that sample viability is not compromised due to shipping duration because samples must remain frozen for duration of shipment.
SCHEDULE OF WORK AND SUBMITTALS: The government will submit soil samples approximately 1-4 times per year for analyses. The contractor shall deliver timely and accurate analytical results within 30 days of each submittal.
GOVERNMENT FURNISHED MATERIALS: The government will provide appropriately preserved soil samples in plastic bags, a spreadsheet inventory of samples included, and provide coolers and costs for shipping preserved samples. Samples will typically arrive to the contractor during the months of July, August, and possibly September in batches of 50-250 per month.
CONTRACTOR FURNISHED MATERIALS: The contractor shall provide all other equipment needed to complete the tasks listed above.
QUALITY ASSURANCE: The Quality Assurance Surveillance Plan is one evaluation method the government uses to perform surveillance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
