DESCRIPTION:

This is a combined synopsis/solicitation for commercial products or services prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice.

This Request for Quote (RFQ) constitutes the only solicitation; quotes are requested, and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-05, effective 22 MAY 2024.

The National Park Service – Contracting Operations East – South Contracting Office is seeking to procure services for web dashboard design and implementation per the attached scope for Everglades National Park, South Florida Natural Resource Center. This is intended to be awarded as a multiyear contract for base and four option years. Option years are subject to the availability of funds.

The Government intends to award a Firm-Fixed Price Contract to the firm that provides the best value to the Government based on pricing, ability to provide services per the scope, and past performance in providing similar services. The contractor must not have active exclusion records within SAM.gov. An exclusion record identifies parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits. Exclusions are also referred to as suspensions and debarments.

All items and work completed are to follow the scope of work provided without conducting discussions per FAR 13.106-2. The resultant contract will be awarded using procedures following FAR Part 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services. Companies must have a valid Unique Entity ID (UEI) number and an active System for Award Management (www.sam.gov) registration.

An offeror must ensure they are self-certified under NAICS 541620 in the Representations and Certifications portion of www.sam.gov.

FAR 52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV

2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price, and other factors considered. The following factors shall be used to evaluate offers:

1. Factor I: Technical Based upon the Government’s evaluation of the quote, separate technical and risk ratings will be assigned which reflect the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal. The technical response will be assessed at the subfactor level, and an overall factor-level rating will be assigned. Each technical subfactor is equally weighted.

a. Subfactor I: Capability and Approach The proposed web-based dashboard must provide efficient and effective methods for users to access data on the Florida Bay ecosystem as described in the SOW. The dashboard should provide interactive data visualization, robust search capabilities, and live updates from data sources, among other functionalities. The proposed web-based dashboard must comply with all applicable federal regulations such as Section 508 of the Rehabilitation Act to ensure accessibility for individuals with disabilities and the Federal Information Security Modernization Act (FISMA) to ensure the security of government data. The dashboard should also be widely compatible across operating systems, web browsers, and devices.

The offeror must provide evidence of capability to perform the work required. Evidence may include, years of experience, description of the same or similar work, and other descriptive literature. A technical proposal that is not complete will not be evaluated.

The technical proposal shall address the work to be accomplished in the statement of work and address the evaluation criteria (Technical Approach) listed in section M of this solicitation. The Government will evaluate the degree to which the technical and management approach demonstrates a thorough understanding of the project and provides a viable plan and means for successful completion, including submittals, mobilization, staffing, training, methodology for completion of the work, and quality assurance procedures.

Evaluation of this factor will be based on the offeror's description of their technical approach to the project. Offerors are encouraged to provide detailed specific information. Failure to provide sufficient information so that the evaluation team cannot discern if the offeror has a thorough understanding of the work in question may lead to the proposal receiving a lower rating. Information provided in the Technical Proposal should be relevant to the Statement of Work. The Government will evaluate the offeror's means and methods to accomplish the construction project, including selection of subcontractor(s) and their role. The estimated time of completion will also be considered.

Please include all proposed product literature and a proposed timeline with an obtainable completion date with your proposal.

The offeror must provide at least one (up to three) example(s) of a completed publicly available product by one or more of the key personnel that demonstrates interactive data visualizations (i.e., web application or dashboard) for review. Submission of a working web link is strongly preferred.

Projects should be relevant examples of similar size, scope, and complexity.

b. Subfactor II: Key Personnel For this evaluation factor, the contractor shall provide the developer and designer’s resume listing doctoral education, work experience, and scientific publications. The developer and designer of the dashboard must have written and published in peer-reviewed scientific journals a minimum of two articles. This information must be included in the offer. The contractor must present the separate credentials of each proposed key team member and must provide a concise summary of everyone’s separate duties and responsibilities as proposed for this project.

The contractor must have experience in handling data stored behind government firewalls including familiarity with federal information technology processes. The developer must lead all front-end website work including the creation of the client-side application, navigating proper hosting requirements, and supplying training to NPS staff for long-term maintenance. The developer may consider JavaScript and D3.js to integrate data visualizations. The contractor must have experience in thinking through data visualizations from a cognitive science perspective. Also, the contractor must have expert data science skills to work with our team to perform descriptive analyses of data and create automated flagging or data cleaning procedures before display. The contractor should have demonstrated expertise in the analysis of hydrology and ecology data (as evidenced by graduate education in a related field, publishing in scientific journals, etc.) along with demonstrated skills in developing water resources dashboards.

Please note that, as a condition of contract award and performance, should the contractor wish to substitute proposed Key Personnel in their proposal (or during the performance, if after award), the replacement staff must possess education and experience equivalent to or exceeding that of the individual(s) being replaced, subject to the approval of the Contracting Officer before the performance.

2. Factor II: Past performance / Similar requirement history / No active SAM.gov exclusions – Please have at least three references of relevant past performance with the name of the project, description, and point of contact with their contact information.

3. Factor III: Price

Factors are listed in relative order of importance.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option (s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204- 26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. FAR 52.204-29 FEDERAL ACQUISITION SUPPLY CHAIN SECURITY ACT ORDERS—

REPRESENTATION AND DISCLOSURES (DEC 2023)

(a) Definitions. As used in this provision, Covered article, FASCSA order, Intelligence community, National security system, Reasonable inquiry, Sensitive compartmented information, Sensitive compartmented information system, and Source have the meaning provided in the clause 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.

(b) Prohibition. Contractors are prohibited from providing or using as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the prohibition is set out in an applicable Federal Acquisition Supply Chain Security Act (FASCSA) order, as described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.

(c) Procedures. (1) The Offeror shall search for the phrase “FASCSA order” in the System for Award Management (SAM)( https://www.sam.gov) for any covered article, or any products or services produced or provided by a source, if there is an applicable FASCSA order described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders—Prohibition.

(2) The Offeror shall review the solicitation for any FASCSA orders that are not in SAM, but are effective and do apply to the solicitation and resultant contract (see FAR 4.2303(c)(2)).

(3) FASCSA orders issued after the date of solicitation do not apply unless added by an amendment to the solicitation.

(d) Representation. By submission of this offer, the offeror represents that it has conducted a reasonable inquiry, and that the offeror does not propose to provide or use in response to this solicitation any covered article, or any products or services produced or provided by a source, if the covered article or the source is prohibited by an applicable FASCSA order in effect on the date the solicitation was issued, except as waived by the solicitation, or as disclosed in paragraph (e).

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority.
