COMBINED SYNOPSIS/SOLICITATION
Provide all supervision, labor, materials, and equipment to provide repairs to the Province Land Visitor Heating System. Work consists of the following:
1. Repairs existing air handler, AHU-1.
2. Remove two failed hot water unit heaters and replace with new.
3. Remove damaged constant volume box, coil and associated piping designated HC-2.
4. Patch, repair and insulate ductwork and piping at former HC-2 location.
5. Remove damaged constant volume box HC-1.
6. Patch, repair and insulate ductwork and piping at former HC-1 location.
7. provide one, 3 ZONE, ductless, compact, air conditioning and heating VRF system. Unit shall be 48,000BTU cooling and 54,000BTU heating with three (3) wall mounted indoor units.
8. Provide new 100amp, 208/120 volt, 3phase, 4 wire panelboard to replace LP-1.
9. Provide new 400amp, 3phase, 4 wire, MLO panel to replace wireway, conductors and disconnects.
Option 1: Provide graphical front end for managing building and BAS (Building Automation System) building controllers across the park. Users access via a new web interface. System shall operate as a Microsoft Windows® application and uses Microsoft SQL Server® for data storage. The province land visitor center shall be assigned its own virtual web and application server. BAS applications shall operate from an installation “on-Premises Server”.
Option 2: Provide VRF central controller with BACnet IP card, programming, and system graphics.
Option 3: Decommission existing pneumatic controls and replace existing pneumatic system with a new Building Automation System with direct digital control for province land visitor HVAC system in accordance with this statement of work and drawings.
This work is to be performed at Cape Cod National Seashores, Province Land Visitor Center and Comfort Station, Historic District, 171 Race Point Rd, Provincetown, MA.
(i) This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number 140P4323Q0060.
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-04 6/2/2023.
(iv) This solicitation is being issued as a Total Small Business Set-Aside, under NAICS code 238220, Plumbing, Heating, and Air-Conditioning Contractors, small business size standard of $19 million.
(v) See Pricing Schedule for description of line items, Attachment 2.
(vi) A detailed description of requirements can be found in, Attachment 1, Performance Work Statement (PWS).

(vii) Work described in the PWS is to be accomplished at Cape Cod National Seashores located in Providence, Massachusetts. The Period of Performance for this contract is anticipated to be October 23, 2023, through March 22, 2024.
(viii) The provision at FAR 52.212-1, Instructions to Offerors -- Commercial Items (MAR 2023), applies to this acquisition.
(ix) The provision at FAR 52.212-2, Evaluation – Commercial Products and Commercial Services (NOV 2021), applies to this acquisition.
a. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government shall make award, if at all, to the lowest-priced technically acceptable offeror who meets the minimum technical acceptability requirements as stated below. The following factors shall be used to evaluate offers:
1. Price
2. Management Plan: The evaluation will be based on a management plan that clearly demonstrates the offeror’s ability to select and effectively manage project workflow, schedules, personnel, and equipment, to maintain quality control throughout the life of the project. Provide a description of management of both in-house as well as subcontracted personnel whose skills and abilities demonstrably match the technical, and administrative needs of the contract. Plan shall be evaluated to the extent it convincingly demonstrates that the Government’s standards for quality will be met or exceeded in the resultant contract.
3. Past Performance: The offeror shall demonstrate past performance with a list of three similar previous projects (project title, project number, cost, change orders with costs and description, project location and similar project technical complexity) with an accompanying description of each project. The projects list shall be provided for projects within the last three years.
a. Schedule: provide a schedule (task list with duration or GNATT chart with tasks and durations) that demonstrates the offerors ability to meet the contract period of performance. The schedule shall note all critical path elements and a brief description of anticipated challenges associated with the schedule.
b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(x) The offeror must submit a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications Commercial Items (DEC 2022), with its quote.
(xi) The clause at FAR 52.212-4, Contract Terms and Conditions Commercial Items (DEC 2022), applies to this acquisition.
(xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (MAR 2023) applies to this acquisition.
(xiii) The Government intends to award a Firm-Fixed-Price contract resulting from this solicitation.
(xiv) The Government shall make award, if at all, to the lowest-priced technically acceptable offeror who meets the minimum technical acceptability requirements as stated above.

(xv) The following additional contract requirements or terms and conditions apply:
Wage Determination: 2015-4045, Revision 25 applies to this solicitation. The most current Wage Determination at time of award will be included in the award, Attachment 10.
There are no contract financing or warranty requirements necessary for this requirement. To be awarded a contract, the successful contractor must be registered with the System for Award Management (SAM) for Electronic Funds Transfer and be willing to submit invoices online electronically through the U. S. Department of the Treasury's Invoice Processing Platform system (IPP). The successful offeror must have a valid Tax Identification Number and a valid UEI Number (UEI may be obtained through the SAM registration process). A Site Visit will be conducted on Wednesday, July 19, 2023, at 8:00 AM EDT, parking area in front of the Province Land Visitor building, Historic District, 171 Race Point Rd, Provincetown, MA 02667.

(xvi) The Defense Priorities and Allocations System (DPAS) is not applicable to this acquisition.
(xvii) The Contractor agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes unless another time period is specified in an addendum to the solicitation. All responses must be received no later than August 16, 2023, 10:00 am EDT. Contractors must submit quotes to the email address listed below. Only electronic submissions via email will be accepted. When emailing your quote, please note the solicitation number in the subject line. Anticipated award date is on or about September 15, 2023.

PRICE SCHEDULE
The offeror shall provide a detailed price schedule to the National Park Service that includes a breakdown of all services, materials, labor, equipment, tools, transportation, and superintendence necessary to execute the work described in the attached PWS (Attachment 1).
INSTRUCTIONS TO OFFERORS:
Quotes must be submitted in accordance with this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.
All interested parties shall be registered in the System for Award Management (SAM.gov) at time an offer or quotation is submitted.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(2) While not required, the Contractor may include in its subcontracts for commercial products and commercial services a minimal number of additional clauses necessary to satisfy its contractual obligations.
FAR 52.217-7 Option for Increased Quantity-Separately Priced Line Item MAR 1989
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30-days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has

Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
The contractor is prohibited from utilizing All-Terrain Vehicles (ATV)s on National Park Service lands. ATV is defined as: A motorized off-highway vehicle (OHV) traveling on four or more low-pressure tires, having a seat to be straddled by the operator and a handlebar for steering control.
Use of UtilityTerrain Vehicles (UTVs) are permitted. UTV (also called a side-by-side) is defined as: A motorized OHV having four or more low pressure tires, designed with side-by-side seats, seatbelts, steering wheel, and optional cab, brush cage, or ROPS.
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
Invoice to be on company letterhead with stated contract number.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
