USFWS OLE Agent Vehicles

Blanket Purchase Agreement

U.S. Fish & Wildlife Service

Acquisition Property Office

June 05, 2023

2 | P a g e

Background

The U.S. Fish and Wildlife Service (Service), Office of Law Enforcement (OLE) replaces under cover agent vehicles at regular intervals, approximately 2-6 units per year. Once acquired, these vehicles will need to be fitted with emergency lighting, sirens, gun safe, and other miscellaneous mission specific equipment. The total amount for the upfit and services cannot exceed $8k per vehicle for FY23.

The vehicles will be Sport Utility Vehicles (SUV) or pickup trucks, of various makes and models. Each agent will meet with Alaska Safety to go over their preferred method of installation to meet policy guidelines.

K9 specific equipment will be communicated on an as needed basis.

Mission

The Service acquires under cover emergency response vehicles to ensure the safety of our OLE agents in the performance of their duties. The upfitting of the components required to perform patrol work and investigations are of utmost importance to the mission. The ability to safely respond with adequate emergency lighting, and equipment is achieved through the quality upfitting of vehicles by a vendor which meets or exceeds public safety levels.

The USFWS OLE retains the right to conduct on-site inspections of the upfitted vehicles at the vendor location any time prior to delivery. No vehicle will be delivered without consent of the FWS OLE Contracting Officer’s Technical Representative (COTR), or designee.

Bidder must be an Authorized Manufacturer's Distributor and Authorized Warranty Center for the specified BPA equipment and shall provide letters with their bid to substantiate such status-.

PERFORMANCE WORK STATEMENT

UP- FITTING

The awarded vendor will be subject to BPA work oversight conducted by the US Fish and Wildlife Service, OLE, located at 4725 Gambell St, Anchorage, AK 99503; the standard has been established and may be conducted at the awarded vendors facilities during the up-fitting of equipment to be installed in the vehicles identified in the BPA. The vehicles requiring upfitting and delivery based on the GSA SIN are as follows, but not limited to:

55 – Ford F-150 size 4X4 Pickup, Full Size Crew Cab, Min 6700 lbs GVWR

57 – Ford F-250 size 4X4 Pickup, Full Size Crew Cab, Min 9201 lbs GVWR

100L – Ford Explorer size SUV, Police Use Vehicle, with Law Enforcement Package, 4 Door

105C – Ford Expedition / Chevy Tahoe size 4X4 SUV, 4DR, Special Service Package Vehicle

The requirement of the vendor is the receiving, proper installation of Government identified law enforcement equipment, and delivery of government owned vehicles.

3 | P a g e

The installation is to be in compliance and consistent with equipment manufacturers’ instructions for the item to include all non-original equipment manufacturer (OEM) after-market items which are purchased in order to make the vehicle ready for OLE mission requirements. The vendor agrees to complete the upfit and deliver the patrol-ready vehicle within 14 days from the date the vehicle arrives at the vendor’s up-fitting facility.

The vendor will install all the emergency vehicle equipment in a consistent manner. The vendor will ensure that every vehicle is identical in the manner that each component included in the upfitting is the same throughout all vehicles, to include the routes in which the wiring is laid throughout the interior of the vehicle. The wiring must include weatherproof, protective sheathing in areas which may subject the wiring to outside elements, crimping and/or wear that may cause failure to the equipment which it is connected and potentially damage to the vehicle.

The standard for our vehicles includes that all connections utilize butt connectors, solder and shrink wrap at connection points. When installing equipment and wiring the vehicles, the vendor shall ensure that their performance and workmanship will minimizing risk of electrical failure, mechanical failure or fire due to changes made by the vendor.

The installed equipment must be able to sustain extremes in vibration, climate and conditions, from extreme cold, snow covered highways, to extreme hot, dusty wash-boarded gravel roads, to off-road use.

OLE PACKAGE EQUIPMENT AND UPFITTING

The vendor shall adhere to the OLE vehicle up-fitting standards for equipment being lights, sirens, and a gun safe. Each vehicle will be equipped differently depending on the agent’s vehicle and preference.

OLE requires all of our agent owned vehicles to be under cover, which entails the installation of lights, sirens and gun safes. These standard for emergency lights are set by each state, and Alaska requires the following:

Minimum: Front and rear mounted red and blue lights. No siren needed per law, but we opt to have this installed Example: Front mounted flip down visor light, rear mounted light in back window

Agents may ask for and be granted more than the minimum equipment described above.

DELIVERY

Upon arrival to the vendor of each law enforcement vehicle, completion and delivery of the vehicle will not exceed 14 calendar days. OLE retains the right to conduct on-site inspections of the completed vehicle at the vendor location prior to delivery.

The vendor shall perform quality control checks on all new equipment on each vehicle when up fitting to ensure that proper installation, assembly and function of emergency equipment operates as manufactures specifications. This will ensure that all vehicle equipment will work in operating conditions and that the up fitting process does not affect equipment or settings.

No OLE vehicle will be stored or left outside of secure area overnight or longer while being up fitted.

The vendor shall be responsible for repair of any damage to any vehicle and equipment incurred during the build phase.

In the event a defect in installation workmanship is discovered following delivery of a vehicle at its final destination, the contractor shall itself, or sub-contract with a company in that geographic area, to make repairs and shall assume financial responsibility for all costs related to the repair.

BPA Order Management

In response to quote requests, the contractor shall either submit a quote or written notification of a decline to quote.

General BPA Information

5 | P a g e

Period of Performance: Each BPA has a 5 year period of 06/14/2023- 06/13/2028

Purchase Limitations: The maximum amount (ceiling) for this BPA is $250,000.

Pricing: See the pricing on each individual BPA or reference the overall pricing guide provided as an attachment to the ordering guide.

Note: Consolidated pricing guide will only be made available to the government.

Ordering Guidelines

The BPA allows for any U.S. Fish and Wildlife Service (USFWS) contracting representative to purchase services in this document. The Contractor has provided the pricing via a price schedule for the work defined in the PWS.

The requesting program or office will generate the work required (Base Package, Optional Partition/Cage, Optional Blackout Switch, and delivery location) for the vehicle type (100L, 55, 57, 105C) and delivery location of the finished vehicle. The program has broad discretion on their particular SOW’s formatting and content. All SOWs must include the following:

(A) Performance Period

(B) Vehicle Type and Quantity: 100L, 55, 57, 105C.

(C) Work Required: Base Package, Optional Partition/Cage, Optional Blackout Switch

(D) Delivery location of upfitted vehicle

Award of orders under the BPA has been made on a "best-value" basis of lowest price technically acceptable.

For each BPA order the Contracting Officer must contact both BPA holders for pricing. Even though the BPAs are pre-priced, actual pricing for each order will vary due to uncertainties in freight and material costs.

Fair Opportunity

Fair Opportunity will be given to each BPA holder IAW FAR 8.405-3(c)(2).

Issuing Authority

Any warranted Contracting Officer (CO) belonging to USFWS or any of its offices may order against this BPA in their delegated warrant authority, provided the BPA does not exceed the ceiling amount. COs seeking to place orders against this BPA consent to the terms stated in the BPAs.

BPA Administration

The BPA Order CO will administer and manage the order. Under no circumstances shall any understanding, agreement, modification or any other action in deviation from the order’s terms be effective or binding upon the Government. The ordering CO is available to answer questions concerning planning and developing the BPA orders, review and approval procedures, and can provide overall guidance, oversight and general information regarding this BPA. The CO issuing the BPA order will perform all the administration associated with individual

6 | P a g e

BPA order. Additionally, all official BPA order files will be maintained by each ordering office. Site Representatives, responsible for project oversight, will be assigned at the order level.

Contractor Performance Assessment Reports

Per FAR 42.1502(b), “Agencies shall prepare an evaluation of contractor performance for each contract that exceeds the simplified acquisition threshold.” As required, contractor performance will be monitored and entered into the Contractor Performance Assessment Reporting System (CPARS). On each order meeting the simplified acquisition threshold (currently $250,000.00), a vendor performance report will be generated in CPARS.

Therefore, when each BPA order that exceeds the simplified acquisition threshold is completed, the issuing CO shall complete a contractor performance report in CPARS. The preparation and completion of these reports is the ordering CO’s duty, but should include input from the assigned COR or Program Site Representative.

The act of receiving and accepting an authorized Call creates a contract obligation, which will remain in effect for the duration of work required under the accepted Call. Calls are authorized when they are placed against this BPA by authorized personnel, against authorized line items.

The Government is obligated only to the extent of authorized purchases actually made under the BPA by authorized individuals, and then only to the extent that they are delivered and acceptable to the government. The Contractor and the Authorized Officials are to notify the CO with any personnel changes listed in the contract. The Contracting Officer (CO) is the ONLY official authorized to change any terms and conditions of the BPA. All administration associated with individual BPA Calls will be performed by the Personnel issuing the BPA Call.
