• Federal Regulations 36 CFR, Part 18

• National Park Service Reference Manual 38

Market Rent

Federal Regulations 36 CFR, § 18.2 defines fair market value rent as follows:

“Fair market value rent means the most probable rent, as of a specific date, in cash or in terms equivalent to cash, for which the property to be leased, under the terms and conditions of the lease, should rent for its highest and best permitted use after reasonable exposure in a competitive market under all conditions requisite to a fair leasing opportunity, with the lessor and the lessee each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under undue duress.

Determinations if fair market value rent under this part are to be made taking into account the considerations stated in § 18.5.”

Federal Regulations 36 CFR, § 18.5 states:

“Property may be leased under this part only if the lease requires payment of rent to the government equal to or higher than the property’s fair market value rent. The determination of fair market value rent shall take into account:

a) Any restrictions on the use of the property or terms of the lease that limit the value and/or the highest and best use of the property; and

b) Any requirements under the lease for the lessee to restore, rehabilitate or otherwise improve the leased property.”

Date of Value

The date of value is the date of the last property inspection, which must be within 30 calendar days prior to the submission of the initial first draft appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing.

Extraordinary Assumptions

None. If the appraiser determines extraordinary assumptions are necessary for the completion of the assignment, they must contact the AVSO reviewer for prior written approval.

Hypothetical Conditions

The opinion of fair market value rent will be based on the hypothetical condition that the subject property has been renovated into rentable condition that is typical for the market area as of the effective date of the appraisal. A statement regarding use of the hypothetical condition affecting assignment results must be included in compliance with USPAP. If the appraiser determines any other hypothetical conditions are necessary, they must contact the AVSO reviewer for prior written approval.

Jurisdictional Exceptions

If the appraiser believes that USPAP’s Jurisdictional Exception Rule needs to be invoked to comply with law or regulation, they must contact the AVSO reviewer to obtain prior written approval.

Placement in Report

The appraiser must clearly identify all extraordinary assumptions, hypothetical conditions, and jurisdictional exceptions wherever the final value conclusion is stated, including the Letter of Transmittal and the Executive Summary/Summary of Salient Facts. These must also be communicated with any general assumptions and limiting conditions.

Property Inspection

The primary appraiser must inspect the subject property and all of the comparable market properties used in the analysis, unless the AVSO review appraiser has approved other conditions in writing.

The appraiser is to photograph and describe all vertical structures on the subject property.

The appraiser is to make arrangements for the property inspection with the property owner or designated representative and notify the NPS realty specialist and AVSO reviewer of the time in advance, as they may wish to accompany the appraiser on the inspection.

Pre-Work Meeting/Conference Call

The appraiser may be required to attend a pre-work call with the assigned AVSO review appraiser, the NPS realty specialist and/or other NPS representative(s), and other interested parties. The AVSO reviewer will coordinate the date, time, and place of the call.

If any significant items of concern are observed during the property inspection, from aerial photographs, or from other materials researched during the appraisal process that were not discussed in the pre-appraisal meeting, the appraiser must contact the AVSO reviewer before continuing with the appraisal assignment.

Controversies/Issues

NPS intends for the property to be used as short-term rentals, although there are no specific exclusions to permitted uses. The required property renovations are residential in character.

The appraiser is to estimate fair market value rent to a single tenant (also known as a sandwich lease position) on an absolute net basis.

Rent escalations will be derived from the marketplace and comply with Reference Manual 38 (NPS policy for 36 CFR Part 18) regarding Fair Market Value Rent Formulations, which states all leases with a term of 5 or more years must contain a CPI adjustment provision.

The appraiser will conduct a thorough search for comparable rentals and verification, and explain the process and parameters used to conduct this research.

Should the appraiser identify any other controversies or issues during the course of the assignment that were not previously discussed with the AVSO reviewer, the appraiser must immediately notify the AVSO reviewer before proceeding with the assignment.

Legal Instructions

None.

General Appraisal Requirements & Instructions

1. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located and insert a copy of the license within the appraisal report.

(Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)

2. The AVSO statement of work, other assignment instructions and engagement letter must be included within the Addenda to the appraisal report.

3. The appraiser must appraise the subject property in its condition as of the effective date of value, unless authorized in writing by the AVSO reviewer to do otherwise.

4. Color photographs and maps of comparable properties shall be included in the appraisal report.

AVSO will accept aerial photographs for comparable properties unless the aerial photographs do not accurately represent the property as of the date of inspection. The appraiser must photograph any unusual property features from the ground.

5. All adjustments and fair market value rent conclusions must be supported by clear, appropriate, and credible analysis based on documented market research. Mere references to undisclosed “trends” or reliance on the appraiser’s “opinion” or “judgment” without market support is unacceptable. Market support may include discussions with lessors/lessees, potential investors, brokers, etc.

6. The appraisal report will be reviewed for compliance with the terms of this Statement of Work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.

7. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO reviewer.

8. AVSO will not normally accept custody of confidential or proprietary information. Should the appraiser find it necessary to rely on confidential or proprietary information, then the appraiser must contact the AVSO reviewer for instructions prior to delivering the initial appraisal report.

9. While the public is not an intended user of the appraisal report, the Freedom of Information Act

(FOIA) and bureau policy may result in the release of all or part of the appraisal report to others.

10. When the appraiser has performed any services regarding the subject property within the three prior years, they must disclose the extent of the service in the bid proposal.

11. Review comments provided in writing to the appraiser will require a response in writing from the appraiser. Any requested revisions/additions to the appraisal must be highlighted in a contrasting color in the subsequent electronic report submitted to the reviewer prior to the final, signed electronic copy of the appraisal.

12. All comparable market data must be verified by the appraiser with the lessor, lessee, broker, or other person having knowledge of the price, terms, and conditions of lease. The appraiser should not use leases to or from government agencies in the appraisal unless the leases are used to supplement other open market, competitive property leases.

Special Appraisal Instructions

1. This statement of work is intended to identify the subject and the potential appraisal problems the appraiser is expected to solve. This is the best information gathered at the time that the statement of work is written, and appraisal proposals are requested, but it is not intended to be relied upon by the appraiser as the final appraisal report information. While the appraiser must analyze the information provided, the final appraisal must reflect an appraiser’s typical and appropriate due diligence including the subject and market data research, interviews, and verifications. This information may differ from the information listed in this statement of work. Differences from the statement of work information should be discussed promptly with the reviewer during the appraisal process prior to submission of the appraisal report.

2. Even though communication is encouraged with the National Park Service (NPS), only the assigned AVSO reviewer can modify appraisal instructions (in writing).

3. The appraiser may not communicate assignment results to any party, except the AVSO reviewer, until authorized to do so in writing by AVSO.

Read House 5.0 acres 64-04-19-155-006.000- 021 & 64-04-19-301- 001.000-021

Rectangular house consisting of approximately 1,700 square feet in Chesterton, Indiana within Indiana Dunes National Park boundaries.

The subject property to be appraised is single unit, single story rectangular house measuring approximately 58’ x 29’ with a low sloped gabled roof and a partial basement under the northern 43% of the house that functions as a garage with the door opening to the east.

The house is parallel with Tremont Road and situated on the ridge of a sand dune with grade falling away to the east and west. The house can be best categorized in the Prairie style of architecture, though falling toward the end of that period of design. The house and use of natural materials create a very non-intrusive and complimentary aspect to its natural surroundings.

The house is constructed of a concrete foundation with locally quarried rough-cut limestone facing the foundation and continuing up the outside surface of the walls forming a wainscot of stone surrounding entire house except where interrupted by doorways and the great room south window.

The remaining exterior is covered with vertically placed 9 ½” redwood boards painted. A roof creates wide overhangs with 12” tall wood facia boards at its outside edge. The roof is covered in fiberglass shingles. Original wood soffits have been replaced with vented aluminum soffits; this is the only change to the exterior of the house. A large, tapered stone chimney extends through the center of the roof in line with the recessed entry area. It has three shafts with vent guards extending above a concrete cap.

The Agency request covers only adjacent land to the Read House. The total size of the Indiana Dunes National Park is much larger, but a valuation of the entire park is not needed for this
