52.212-2 Evaluation - Commercial Products and Commercial Services. (NOV 2021)
EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
A. Basis for Award: The Government intends to award one firm fixed price contract to the lowest priced vendor who meets the requirements as laid out in this RFQ.
The Government will evaluate the Contractor's submission strictly in accordance with this solicitation and will not assume that performance will include areas not specified in the Contractor's submission.
The Government intends to award the contract without discussions. Therefore, the quote should contain the Contractor's best terms from Technical Capability and Price standpoint. Additional oral or written information from the Contractor may be requested. The Government reserves the right to conduct discussions. If a revised quote is requested but not necessarily from all, it will be evaluated against the same criteria as was the initial quote. Failure to provide the required information could result in deeming the vendor as nonresponsive to this solicitation.
B. Evaluation Criteria: The Government will use the criteria set forth below to evaluate and select the awardee. The following factors shall be used to evaluate quotes:
Factor 1: Technical Capability Factor 2: Price
Factor 1: Technical Capability. The vendor provided sufficient documentation demonstrating the vendor is authorized to deliver and sell 100LL bulk aviation fuel.
Factor 2: Price. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3(2) will be the primary means of assessing price analysis for commercial items to determine price reasonableness. To be viable for award, an Offeror’s price must be determined fair and reasonable. Price will be evaluated by multiplying the vendor’s quoted per gallon price by 3000 (fuel tank size) and any delivery fees and/or discounts will be applied to produce a total estimated price per delivery.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
