1.0 EXECUTIVE SUMMARY:
The USDA Geneva, New York Plant Genetic Research Unit (PGRU) and the Grape Genetics Research Unit (GGRU) Administration Building is located on the Cornell University Agri-Tech Campus at 93 Collier Drive, Geneva, New York. The PGRU & GGRU Administration Building was constructed in 1984 and is identified in the USDA asset system as Building B011 (The Cornell University Facility Code for the Building is 4974).
A 2019 fire in the building’s adjoining/attached Greenhouse section severely damaged the Administration Building Section and destroyed the aluminum frame & glass construction Greenhouse Section. The Administration building section has been unoccupied since the incident. Based on this, the overall building (Administration building section and remnants / debris from the Greenhouse building section) is to be demolished in order to prepare the site for new construction, which is being designed and procured separately from this demolition project.
The scope of the current project is to demolish the Administration Building down to its foundation / slab (slab to remain). Associated building utilities are to be either isolated and capped at the slab, completely removed, or re-routed where the given utility Services adjacent buildings. All site finishes outside of the building footprint are anticipated to remain as-is. This includes existing sidewalks, grass areas, and asphalt pavings. Impact to the Site Storm Sewer components is anticipated to be minimal.
Prior to, and separate from, the demolition project, the Location (USDA and/or Cornell University Geneva Site Representatives) will be performing the following (at the time of the 10/21/2020 Site Investigation, the majority of the below items had been completed):
• Remove and salvage or dispose of all extraneous building contents.
• Remove laboratory casement, desks and furniture.
• Remove all Fume Hoods with the exception of the two present in Rooms 104 and 110. These two Hoods, and their associated components will be addressed as a part of the demolition project.
• Remove, package and dispose of all refrigerants and heat transfer fluids associated with the building HVAC equipment / components.
• Remove / relocate the existing emergency generators.
• Remove, package and dispose of all Universal Waste.
• Remove exterior chiller unit
Alternate 1 for the Design will include the demolition of the detached Screenhouse Structure located adjacent to the Building. The Screenhouse is currently being utilized and this will continue until a separate facility located off the project site is repaired. As this may require the continued use of the Screenhouse at the time of the project, its demolition is being included as an Alternate.
The design package may also include the re-routing of an existing communications line that currently runs through the building, if it is determined that including the communications line re-routing is desirable to the USDA as part of the project.
Delta Engineers, Architects, Land Surveyors, & Landscape Architects, DPC (Delta) was contracted by Global Engineering Solutions to perform a Pre-Design Phase Site Investigation and provide an associated Site Investigation Report. The associated services include a review of existing information for the building and the performance of a site visit to document existing conditions. The site visit was performed on October 21st, 2020.

3.0 Demolition
The Base Scope Design will address the demolition of the existing PGRU & GGRU Administration Building (Administration building section and remnants / debris from the fire damaged Greenhouse building section). Demolition shall be down to the existing building floor slab / foundation. Demolition shall include the actual building structure along with all building equipment / components that remain at the time of demolition. Equipment / components shall be salvaged and/or recycled where applicable.
Demolition of the detached Screenhouse Structure will be included as Alternate 1 in the Design Package.
4.0 Sitework
All site finishes outside of the building footprint are anticipated to remain as-is. This includes existing sidewalks, grass areas, and asphalt pavings. Based on the site area, anticipated sitework scope, and the fact that the sites impermeable area will not be altered (i.e. less than 1 acre, slabs / pavings / sidewalks to remain, only minimal excavation for potential communications line re-routing, etc.), minimal storm water management will be required for the Design. No Stormwater Pollution Prevention Plan (SWPPP) will be required, with only an erosion and sediment control plan utilizing silt fence being incorporated for protection of environmentally sensitive areas that surround the site. Impact to the existing Site Storm Water system / components is anticipated to be minimal.
5.0 Utilities
The Site Utilities are anticipated to be isolated / capped, removed, or re-routed as follows:
• Steam Supply / Condensate Return – currently capped in the steam tunnel.
• Domestic Water – currently shut-off at Collier Street isolation valve, Line to be capped at slab.
• Electric – Removal of Transformer. Options for Building Electrical Service line include o Remove line back to Manhole 8
Or o Service line to be re-directed to EMH9 by others prior to the project
• Emergency Power – Emergency Generator to be relocated from the site prior to the project.
• Sanitary – Capped at slab. Includes floor drains, sink / fume hood drain lines and bathroom lines.
• Propane – Tanks to be removed by Provider. Lines to be removed with Generator relocation work.
• Storm Water – no impact to storm water drains / system anticipated.
• Chilled Water – System supply / return piping to be removed as part of project. The local chiller unit to be relocated from the site prior to the project.
• Communications Line – to be re-routed through existing steam tunnel. This will require the installation of conduits and underground pull box from the northwest corner lawn of project site traveling underground at Collier Drive and into Steam Tunnel.
• All building utility and steam tunnel slab penetrations / openings shall capped and sealed water-tight.
6.0 Environmental and Hazardous Waste
6.1 NEPA Environmental Assessment - Reference Appendix B for the NEPA Environmental Assessment Report performed for the Project.
6.2 Hazardous Materials:
6.2.1 Asbestos: Asbestos Containing Material (ACM) previously identified at the PGRU & GGRU
Administration Building were previously removed by the USDA via a local New York State Department of Labor Licensed Asbestos Contractor following all applicable US EPA, NESHAP and NYS DOL Regulations.
As per NESHAP / NYS DOL requirements, a Pre-demolition Asbestos Survey was performed as a part of this Site Investigation. Survey findings showed no ACM’s being present at the PGRU & GGRU Administration Building (including Administration building section and remaining debris from previously damaged Greenhouse building section). The Survey also addressed the detached Screenhouse Structure, with the screen frame caulk, door panel caulk, and construction joint caulk reported as being ACM. These ACM’s will have to be addressed prior to, or as a part of, the Screenhouse Structure Demolition. Reference Appendix B for the complete Pre-Demolition Asbestos Survey Report.
6.2.2 PCB’s: Based on Buildings 1984 Construction Date, the presence of PCB’s in building caulks is not an issue, as their use was banned prior to its construction (banned in 1979). All light fixture ballasts were inspected and confirmed to be electronic non-PCB. Based on documentation provided by the Location, results from previous sampling for PCB content of the site Transformer dielectric fluid were reported as “None Detected”.
6.2.3 Refrigerants / Heat Transfer Fluids: All Refrigerants / Heat Transfer Fluids associated with the building’s HVAC equipment have been removed based on documentation provided by the Location.
6.2.4 Miscellaneous Items: All stored Chemicals have been removed from the building based on documentation provided by the Location. There are two (2) Fume Hoods present at the building.
These hoods, along with the ventilation components (exhaust ductwork and exhaust fan units) and sink components (drain lines and traps) will be decontaminated / cleaned and disposed of as per applicable Federal and State requirements as a part of the overall Demolition Project.
6.2.5 Universal Waste: All Universal Waste (fluorescent light tubes, mercury thermostats, etc.) has been removed from the building based on a visual inspection / provided documentation.
6.2.6 Lead Paint: Based on Buildings 1984 Construction Date and the Project demolition scope, the presence of lead based paint is not an issue.
7.0 Topographic Survey
A Topographic Survey of the Property was performed by the US Army Corps of Engineers in 2020 and therefore not included as a part of the Pre-Design Phase Site Investigation. Reference Appendix D for the USACE Survey Drawing.
8.0 Additional Testing Requirements
Based on existing information for the site and the October 21st, 2020 onsite investigation / inspection, potential additional sampling to be considered at the site for this Demolition Project includes the following:
• Structure Demolition Debris – Based on the buildings 1984 construction date, the presence of lead based paint is not an issue. However, for demolition debris disposal purposes, the landfill accepting the waste may require results for TCLP sampling of the representative demolition waste stream in order to accept the waste. If required, it is recommended that the Contractor be responsible for this sampling / analysis.

1.0 INTRODUCTION:
Delta Engineers, Architects, & Land Surveyors (Delta) was contracted by Mr. Ali Najafi, PE, of Global Engineering Services (GES) to provide a National Environmental Policy Act (NEPA) Environmental Assessment for the USDA PGRU & GGRU Administration Building, attached fire-damaged greenhouse section, and the adjacent Screenhouse structure demolition project. The structures are located on a common parcel on the Cornell University Campus at 93 Collier Drive, Geneva, New York. Buildings are currently vacant but were previously occupied / operated by the United States Department of Agriculture (USDA) – Agricultural Research Service (ARS) on the Cornell AgriTech Geneva Campus. Cornell designates it with a Facility Code as Building 4974. The PGRU & GGRU Administration Building was constructed in 1984.
A fire in the building’s greenhouse section in 2019 completely destroyed the greenhouse and severely damaged the PGRU/GGRU administration building section. The current PGRU & GGRU Administration Building, including remnants / debris and remaining above-slab components from the fire damaged Greenhouse section, and the adjacent Screenhouse are to be demolished in order to prepare the site for new construction. The New Construction is being procured separately from this demolition project. The structures are to be demolished down to their slabs (which are to remain). All existing site pavings and sidewalks are to remain, with minimal impact to the site outside of the building footprints. The area around the exposed slabs would be fenced with temporary storm water management incorporated until new construction commences. Site utilities to be addressed as a part of the demolition include electric, water, steam supply / condensate, chilled water, sanitary sewer, storm drain, telecommunications, and propane lines (for emergency generators).
2.0 ALTERNATIVES:
No Action vs. Proposed Action
No Action would leave a damaged building that has been deemed partially structurally unsound and not worthy of repair standing near the center of the Cornell AgriTech Geneva Campus. With no maintenance or utilities, the building would further degrade over time. Access to the burned greenhouse building section has been restricted due to safety concerns and the area has been isolated with reduced visibility fencing. Based on the above and fact that this building occupies valuable space on the campus, No Action is not an acceptable long-term alternative.
The Proposed Action would clean up the site, eliminate exiting safety issues, prepare it for proposed new construction, and return the property as a viable part of the campus.
3.0 AFFECTED ENVIRONMENT AND POTENTIAL IMPACTS:
3.1 Wetlands and Floodplains: The NYSDEC Environmental Resource Mapper shows that there are no wetlands associated with the project area (see Appendix A). A FEMA Floodplain Map shows no floodplains associated with the project area (see Appendix B).

3.2 Critical Environmental Areas: The NYSDEC Critical Environmental Areas in Ontario County list no such areas for Geneva (see Appendix C).
3.3 Cultural Resources: The National Register of Historic Places listings in Ontario County, New York indicate one location within sight distance of the proposed project, Parrott Hall (see Appendix D). Parrott Hall is located on West North Street, approximately 200 feet northeast of the project location. This building is owned by New York State and is on the Cornell AgriTech Geneva Campus. The building is currently unoccupied and in a state of disrepair due mainly to a severely compromised roof. The proposed project will have no effect on this historic property.
Project information was submitted to SHPO via the online portal through the NYS Cultural Resource Information System (CRIS). After review, CRIS responded that it is the opinion of the New York SHPO that no historic properties, including archaeological and/or historic resources, will be affected by this undertaking (see Appendix E).
3.4 Environmental Justice: As no persons “reside” on the Cornell AgriTech Geneva Campus, this project will have no effect on the human health, economic status, or social wellbeing of any minority or low-income community.
3.5 Aesthetic Effects: Aesthetic qualities of an area can include several resources including scenic vistas, landscape, architecture, structures, scenic roadways, sights, and sounds. This project will produce a short-term increase in noise. No other aesthetic effects are anticipated.
3.6 Infrastructure/Utilities: This project does not include removing or installing infrastructure or utilities.
3.7 Hazardous Materials:
3.7.1 Asbestos: Asbestos Containing Material (ACM) previously identified at the PGRU & GGRU Administration Building included a black glazing compound applied on the interior door slab windows. The USDA previously removed the doors and associated glazing compound through a local New York State Department of Labor Licensed Asbestos Contractor following all applicable US EPA, NESHAP and NYS DOL Regulations. A complete Pre-demolition Asbestos Survey was also performed for this building as per NESHAP / NYS DOL requirements and no other ACM’s were identified at the PGRU & GGRU Administration Building. The Pre-demolition Asbestos Survey also addressed the detached Screenhouse Structure, with the screen frame caulk, door panel caulk, and construction joint caulk reported as being ACM. These ACM’s will have to be addressed prior to, or as a part of, the Screenhouse Structure Demolition.
3.7.2 PCB’s: Based on Buildings 1984 Construction Date, the presence of PCB’s in building caulks is not an issue, as their use was banned prior to its construction (banned in 1979). All light fixture ballasts were inspected and confirmed to be electronic non-PCB.

Based on site observations made during the October 21st, 2020 Site Inspection, a review of existing information provided by the location for the building & site, and a review of the historical records / documentation refenced herein and attached, a “Finding of No Significant Impact (FONSI)” is justified for the USDA PGRU & GGRU Administration Building Demolition Project.

Delta Engineers, Architects, & Surveyors (Delta) was contracted by Mr. Ali Najafi, PE, of Global Engineering Services (GES) to provide a Pre-Demolition Asbestos Survey at the USDA PGRU & GGRU Administration Building and its adjacent detached Screenhouse structure located at 93 Collier Drive on the Cornell University Campus in Geneva, New York. The survey was performed in preparation for the upcoming demolition of the structures.
The initial stage included a review of past Delta bulk sampling information for the Building.
Previous Survey/bulk sample information has been incorporated into this Survey and associated Survey Report where applicable.
On October 21st, 2020, Delta New York State Department of Labor (NYS DOL) Certified Asbestos Inspectors Patrick Reardon and John Muniak conducted a walkthrough of the PGRU & GGRU Administration Building (including the attached fire damaged greenhouse section) and the adjacent Screenhouse structure, to identify the accessible suspect materials present and to perform material sampling.
Based on a review of existing sample information and a visual inspection of the structures, a total of forty-two (42) bulk samples were collected representing twenty-one (21) separate suspect homogenous building materials. Thirty (30) of the samples collected were non-friable organically bound (NOB) representing fifteen (15) homogenous materials. The remaining twelve
(12) samples were friable, non-NOB materials representing six (6) homogenous materials.
In addition to the samples collected above, other suspect homogenous materials were observed but not sampled as they were addressed through previous sampling efforts. For these materials, the existing results have been incorporated into this report. The suspect homogenous materials identified and/or sampled as part of the pre-demolition asbestos survey included the following:

2.0 ASBESTOS SURVEY AND SAMPLING PROCEDURES AND METHODS:
2.1 Survey requirements
Requirements to perform Pre-Demolition/Pre-Renovation Asbestos Surveys are based on the following State and Federal Regulations.
Occupational Safety and Health Administration (OSHA): OSHA survey requirements and sampling protocols are included in 29 CFR Part 1910.1001(j)(2) & (j)(8) and 29 CFR Part 1926.1101(k),(5):
29 CFR Part 1910.1001(j)(2), Installed Asbestos Containing Material: Employers and building owners are required to treat installed TSI and sprayed on and troweled-on surfacing materials as ACM in buildings constructed no later than 1980 for purposes of this standard. These materials are designated "presumed ACM or PACM", and are defined in paragraph (b) of this section. Asphalt and vinyl flooring material installed no later than 1980 also must be treated as asbestos-containing. The employer or building owner may demonstrate that PACM and flooring material do not contain asbestos by complying with paragraph (j)(8)(iii) of this section.
29 CFR Part 1910.1001(j)(8), Criteria to rebut the designation of installed material as PACM:
1910.1001(j)(8)(i) - At any time, an employer and/or building owner may demonstrate, for purposes of this standard, that PACM does not contain asbestos. Building owners and/or employers are not required to communicate information about the presence of building material for which such a demonstration pursuant to the requirements of paragraph (j)(8)(ii) of this section has been made. However, in all such cases, the information, data and analysis supporting the determination that PACM does not contain asbestos, shall be retained pursuant to paragraph (m) of this section.
1910.1001(j)(8)(ii) - An employer or owner may demonstrate that PACM does not contain asbestos by the following:
1910.1001(j)(8)(ii)(A) - Having a completed inspection conducted pursuant to the requirements of AHERA (40 CFR 763, Subpart E) which demonstrates that no ACM is present in the material; or
1910.1001(j)(8)(ii)(B) - Performing tests of the material containing PACM which demonstrate that no ACM is present in the material. Such tests shall include analysis of bulk samples collected in the manner described in 40 CFR 763.86. The tests, evaluation and sample collection shall be conducted by an accredited inspector or by a CIH. Analysis of samples shall be performed by persons or laboratories with proficiency demonstrated by current successful participation in a nationally recognized testing program such as the National Voluntary Laboratory Accreditation Program (NVLAP) or the National Institute for Standards and Technology (NIST) or the Round Robin for bulk samples administered by the American Industrial Hygiene Association (AIHA) or an equivalent nationally-recognized round robin testing program.
1910.1001(j)(8)(iii) -The employer and/or building owner may demonstrate that flooring material including associated mastic and backing does not contain asbestos, by a determination of an industrial hygienist based upon recognized analytical techniques showing that the material is not ACM.
29 CFR Part 1926.1101(k)(5), Criteria to rebut the designation of installed material as PACM:
1926.1101(k)(5)(i) - At any time, an employer and/or building owner may demonstrate, for purposes of this standard, that PACM does not contain asbestos. Building owners and/or employers are not required to communicate information about the presence of building material for which such a demonstration pursuant to the requirements of paragraph (k)(5)(ii) of this section has been made. However, in all such cases, the information, data and analysis supporting the determination that PACM does not contain asbestos, shall be retained pursuant to paragraph (n) of this section.
1926.1101(k)(5)(ii) – An employer or owner may demonstrate that PACM does not contain more than 1 percent asbestos by the following:

CFR Part 763, Subpart E) which demonstrates that the material is not ACM; or
1926.1101(k)(5)(ii)(B) - Performing tests of the material containing PACM which demonstrate that no ACM is present in the material. Such tests shall include analysis of bulk samples collected in the manner described in 40 CFR 763.86. EPA National Emissions Standard for Hazardous Air Pollutants (NESHAPs): (NESHAPs) regulates asbestos under “40 CFR Part 61, Subpart M - National Emission Standard for Asbestos”. Subpart M regulates demolition and/or renovation of “facilities” that may contain asbestos-containing materials (ACMs). “Facilities,” as defined by NESHAPs, includes any institutional, commercial, public, industrial, or residential structure or building, except residential buildings having four or fewer units. ACMs are defined in NESHAPs as materials containing more than 1 percent asbestos. Section 61.145 states:
61.145 Standard for demolition and renovation.
(a) Applicability. To determine which requirements of paragraphs (a), (b), and (c) of this section apply to the owner or operator of a demolition or renovation activity and prior to the commencement of the demolition or renovation, thoroughly inspect the affected facility or part of the facility where the demolition or renovation operation will occur for the presence of asbestos, including Category I and Category II nonfriable ACM.
It should be noted that 40 CFR Part 1 Subpart M, NESHAPS has no cut-off date exempting survey requirements.
New York State Department of Labor (NYS DOL): Guidelines followed for the inspection are those established by the NYS DOL’s Industrial Code Rule 56 (Cited as 12 NYCRR Part 56, as amended, adopted January 11, 2006; effective September 5, 2006). The specific survey, sampling and reporting requirements included in 12 NYCRR Part 56-5.1(e) – “Building/Structure Asbestos Survey Requirements” include:
56-5.1 Asbestos Survey Requirements for Building/Structure Demolition, Renovation, Remodeling and Repair
(a) Asbestos Survey Required. An owner or an owner’s agent, except the owner of one and two-family dwellings who contracts for, but does not direct or control the work, shall cause to be conducted, an asbestos survey completed by a licensed asbestos contractor using inspectors certified in compliance with Section 56-3.2(d), to determine whether or not the building or structure, or portion(s) thereof to be demolished, renovated, remodeled, or have repair work, contains ACM, PACM or asbestos material. This asbestos survey shall be completed and submitted as indicated in Subdivision (g) of this Section, prior to commencing work. All such asbestos surveys shall be conducted in conformance with the requirements of Subdivision (e) of this Section.

(b) Exemptions to Asbestos Survey Requirements: The asbestos survey required by this Subdivision (a) of this Section shall not be required for the following classes of buildings or structures:
(1) An agricultural building;
(2) Buildings or structures for which original construction commenced on or after January 1, 1974;
(3) A structure certified in writing to be structurally unsound by a licensed Professional Engineer, Registered Architect, Building Inspector, Fire Inspector or other official of competent jurisdiction. (See Section 56-11.5)
(c) Building/Structure Demolition. If a building/structure asbestos survey is not required or performed per Subdivision (b) of this Section, and the building/structure is certified to be unsound or slated for contracted demolition, the building/structure shall be assumed to contain asbestos, and shall be demolished per this Part, unless the building/structure is adequately certified to be free of asbestos containing material. Acceptable documentation for certification shall be a previous thorough building/structure asbestos survey, abatement records or other documentation acceptable to the Commissioner or his or her representative.
(d) Responsibility to Comply. No exemption to the requirement to conduct an asbestos survey shall exempt any person, asbestos contractor, property owner or business entity from the inspection or asbestos survey requirements of EPA, OSHA, and any other applicable section of this Part.
(e) Building/Structure Asbestos Survey Requirements. The asbestos survey shall include a thorough inspection for and identification of all PACM, suspect miscellaneous ACM, or asbestos material throughout the building/structure or portion thereof to be demolished, renovated, remodeled, or to have repair work. The required inspection shall be performed by a certified asbestos inspector, and, at a minimum, shall include identification of PACM, suspect miscellaneous ACM or asbestos material by all of the following methods:
(1) The review of building/structure plans and records, if available, for references to asbestos, ACM, PACM, suspect miscellaneous ACM or asbestos material used in construction, renovation or repair; and
(2) A visual inspection for PACM and suspect miscellaneous ACM throughout the building/structure or portion thereof to be demolished, renovated, remodeled, or repaired.
For the purpose of this Part, all PACM and suspect miscellaneous ACM visually assessed shall be treated and handled as ACM and shall be assumed to be ACM, unless bulk sampling is conducted as per this Section, standard EPA and OSHA accepted methods, including multi-layered systems sampling protocols; the subsequent analyses are performed by a laboratory that meets the requirements of Section 56-4.2 of this Part; and the analyses satisfies both ELAP and federal requirements, including multi-layered sample analyses, to document non-asbestos containing material.
(f) Building/Structure Asbestos Survey Information.
(1) The asbestos survey shall, at a minimum, identify and assess with due diligence, the locations, quantities, friability and conditions of all types of installations at the affected portion of the building/structure relative to the ACM, suspect miscellaneous ACM, PACM or asbestos material contained therein. (2) All ACM, PACM, suspect miscellaneous ACM, or asbestos material reported under Paragraph (1) of this Subdivision shall include the location of the materials, an estimate of the quantities, types, friability and condition of the identified materials to be treated and handled as ACM. For the purpose of this Part, all PACM and suspect miscellaneous ACM visually assessed shall be treated and handled as ACM and shall be assumed to be ACM, unless bulk sampling is conducted as per this Section, standard EPA and OSHA accepted methods, including multilayered systems sampling protocols; the subsequent analyses are performed by a laboratory that meets the requirements of Section 56-4.2 of this Part; and the analyses satisfies both ELAP and federal requirements, including multi-layered sample analyses, to document non-asbestos containing material.
(3) The building/structure asbestos survey shall also include the building/structure name, address, the building/structure owner’s name and address, the name and address of the owner's agent, the name of the firm performing the asbestos survey and a copy of the firm’s current asbestos handling license, the names of the certified inspector(s) performing the survey and a copy of the current asbestos handling certificate for each inspector utilized, the dates of the asbestos survey, a listing of homogeneous areas identifying which ones are ACM, all laboratory analyses reports for bulk samples collected, and copies of the appropriate certifications for the laboratory used for analysis of samples taken during the asbestos survey.
(g) Transmittal of Building/Structure Asbestos Survey Information. One (1) copy of the results of the building/structure asbestos survey shall be immediately transmitted by the building/structure owner as follows:
(1) One (1) copy of the completed asbestos survey shall be sent by the owner or their agent to the local government entity charged with issuing a permit for such demolition, renovation, remodeling or repair work under applicable State or local laws.
(2) The completed asbestos survey for controlled demolition (as per Subpart 56-11.5) or pre-demolition asbestos projects shall also be submitted to the appropriate Asbestos Control Bureau district office.
(3) The completed asbestos survey shall be kept on the construction site with the asbestos notification and variance, if required, throughout the duration of the asbestos project and any associated demolition, renovation, remodeling or repair project.
(h) Removal Required. If the building/structure asbestos survey finds that the portion of the building/structure to be demolished, renovated, remodeled, or have repair work contains ACM, Tel: 607.231.6600

PACM, suspect miscellaneous ACM assumed to be ACM, or asbestos material, which is impacted by the work, the owner or the owner’s agent shall conduct, or cause to have conducted, asbestos removal performed by a licensed asbestos abatement contractor in conformance with all standards set forth in this Part. All ACM, PACM, suspect miscellaneous ACM assumed to be ACM, or asbestos material impacted by the demolition, renovation, remodeling or repair project shall be removed as per this Part, prior to access or disturbance by other uncertified trades or personnel. No demolition, renovation, remodeling or repair work shall be commenced by any owner or the owner’s agent prior to the completion of the asbestos abatement in accordance with the notification requirements of this Part. For multi-phased work, the access restriction for uncertified trades or personnel applies to each intermediate portion of the entire project. Upon completion of the intermediate portion of the asbestos project, other trades or personnel may access that portion of the work site.
For demolition projects that are exempt from asbestos survey requirements due to being structurally unsound, the demolition is considered an asbestos project and shall proceed as per Section 56-11.5.
(1) All building/structure owners and asbestos abatement contractors on a demolition, renovation, remodeling, or repair project, which includes work covered by this Part, shall inform all trades on the work site about PACM, ACM, asbestos material and suspect miscellaneous ACM assumed to be ACM at the work site.
(i) Bidding. Bids may be advertised and contracts awarded for demolition, remodeling, renovation, or repair work, but no work on the current intermediate portion of the project shall commence on the demolition, renovation, remodeling or repair work by any owner or agent prior to completion of all necessary asbestos abatement work for the current intermediate portion of the entire project, in conformance with all standards set forth in this Part.
(j) Unidentified and Unassessed Asbestos. When any construction activity, such as demolition, remodeling, renovation or repair work, reveals PACM or suspect miscellaneous ACM that has not been identified by the asbestos survey per this Part, or has not been identified by other inspections as per current OSHA or EPA requirements, all activities shall cease in the area where the PACM or suspect miscellaneous ACM is found and the Asbestos Control Bureau shall be notified by telephone by the building/structure owner or their representative, followed with a written notice in accordance with the notification requirements of this Part. Unassessed PACM or suspect miscellaneous ACM shall be treated and handled as ACM and assumed to be ACM, unless proven otherwise by standard EPA and OSHA accepted methods, including multi-layered systems sampling protocols; subsequent analyses performed by a laboratory that meets the requirements of Section 56-4.2 of this Part; and the analyses satisfies both NYS ELAP and federal requirements, including multi-layered sample analyses, to document non-asbestos containing material.
2.2 Sample Analysis
Bulk sample analysis was performed by American Science Team New York Inc., an independent laboratory approved/accredited by the NYS Department of Health (ELAP), the American Industrial Hygiene Association (AIHA), and the National Voluntary Laboratory Accreditation Program (NVLAP).
