United States Department of Agriculture Single Source/Brand Name Justification

Less Than the Simplified Acquisition Threshold (SAT) FAR 13.106-1(b)(1)

1.1 Identification of the Agency and Contracting Activity

Requesting Agency:

USDA APHIS VS NCAH

1920 Dayton Avenue Ames IA 50010

Contracting Agency:

USDA APHIS MRPBS AAMD

250 Marquette Ave., Suite 410 Minneapolis, MN 55401

1.2 Description of the Supplies or Services Required to Meet the Agency’s Needs

The proposed contract action is for the acquisition of services for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b) – Soliciting from a Single Source. The National Centers for Animal Health (NCAH) intends to award a Firm Fixed Price, sole source purchase order to Department to the Air Quality Bureau, Iowa Department of Natural Resources, Air Quality Bureau, Wallace State Office Building, 502 E 9th St., Des Moines, IA 50319-0034 for renewal of the NCAH Title V permit for operating air pollutant emitting units. The Iowa Department of Natural Resources must evaluate the permit application for renewal of the NCAH Title V air permit to issue a Title V permit renewal. The application with agreement for payment of permitting fees must be submitted by March 25, 2024 to retain the permit shield and allow NCAH to operate boilers, incinerators and generators past September 25, 2024.

1.3 Circumstances and Rationale for Limiting Competition

The NCAH Title V air permit is a federally mandated air emission permit that can only be issued by an entity delegated by the federal government to issue permits in Iowa. The Iowa Department of Natural Resources is the only entity delegated by the US Environmental Protection Agency (EPA) to write air quality permits for the state of Iowa. EPA delegated authority for air quality permit writing to Iowa via the Federal Register as detailed in procedures from 40 CFR Parts 60, 61, and 63. 1. Except as provided in rule 567—22.104(455B), permit expiration terminates a source’s right to operate unless a timely and complete application for renewal has been submitted in accordance with rule 567—22.105(455B). 567 IAC 22.116(2) To be considered timely, the owner, operator, or designated representative (where applicable) of each source required to obtain a Title V permit shall submit on forms or electronic format specified by the Department to the Air Quality Bureau, Iowa Department of Natural Resources, Air Quality

Bureau, Wallace State Office Building, 502 E 9th St., Des Moines, IA 50319-0034, two copies (three if your facility is located in Linn or Polk county) of a complete permit application, at least 6 months but not more than 18 months prior to the date of permit expiration. An additional copy must also be sent to U.S. EPA Region VII, Attention: Chief of Air Permitting & Standards Branch, 11201 Renner Blvd., Lenexa, KS 66219. Additional copies to local programs or EPA are not required for application materials submitted through the electronic format specified by the Department. The application must include all emission points, emission units, air pollution control equipment, and monitoring devices at the facility. All emissions generating activities, including fugitive emissions, must be included. The definition of a complete application is as indicated in 567 IAC 22.105(2). 567 IAC 22.105

1.4 Description of the Market Research Conducted Among Schedule Holders and the Results or a

Statement of the Reason Market Research Was Not Conducted Market research is not required as the Iowa Department of Natural Resources is the only delegated authority to write Title V permits for the State of Iowa.

1.5 Estimated Price, Including All Options, If Applicable

In January 2016, the IDNR developed a fee payment structure to cover the IDNR staff costs associated with air quality permit issuance. Regulations for setting the fee structure are located in 567 Iowa Administrative Code Chapter 30. The current fee schedule is listed on the IDNR website. The Iowa Department of Natural Resources permit fees schedule is found at https://www.iowadnr.gov/Environmental-Protection/Air-Quality/Air-Quality-Fees. The previous Title V permit fees were $24,800. It is estimated that the number of hours to obtain a Title V permit renewal will be similar to this requirement. Therefore, the estimated price is $25,000.
