C.1 Performance Work Statement

Foreign Service Institute Transition Center Training Division (FSI/TC/T)

MQ930 Security Overseas Seminar

Delivery of "Basic Personal Defense" Presentations Performance Work Statement

Background The George P. Shultz National Foreign Affairs Training Center of the Department of State is the federal government’s primary train-ing facility for personnel of the foreign affairs community. The Foreign Service Institute (FSI) is the Department bureau that provides training for employees of the Department of State and other agencies at the Shultz Center.

The Transition Center offers basic self-defense training to foreign affairs agency personnel and their eligible family members in the form of the Basic Personal Defense (BPD) course.

In its second year the course has had over 220 participants with an average class size of 18-23. The course is capped at 25 parti-cipants. The course is mostly comprised of Department of State employees and family members although it is open to all U.S. govern-ment employees.

Purpose The Foreign Service Institute is actively seeking a contractor with multiple presenters to facilitate the Basic Personal Defense (BPD) course. The overall aim of this BPD course is to motivate individuals to identify the likely personal security risks, primarily those overseas, and to develop a plan for dealing with those risks. The two and a half hour program is offered approximately twelve to sev-enteen (12-17) times a year, and utilizes a variety of techniques and information in order to maximize the effectiveness of the pro-gram. The BPD course requires qualified instructors with international experience to provide presentations on physical threats in the overseas environment and practical self-defense techniques and strategies.

Scope The ideal Presentation Team should be readily identified as diverse, having a team composed of both men and women. They should have a Team Lead presenter who can manage the Presentation Team effectively. The Presentation Team should also be experienced in adult and child self-defense techniques and well aware of current and relevant incidents that have occurred in real life situations.

The course blocks are not flexible and are set to the designated durations listed below. Therefore all instruction is encouraged to be in-novative but also remain compliant with the designated durations associated with each course.

Part One: Basic Personal Defense course for Adults The Basic Personal Defense (BPD) course occurs approximately once a month typically on Wednesdays. To meet the needs of our clients, we offer these courses in the morning, during the work day, and evenings after hours. The session is a total of 150 minutes al-lowing 10 minutes for safety brief, warm up and theory; 130 minutes shall then be used for practical exercises and drills; and the final 10 minutes reserved for questions and answers. The day of each session is subject to change and specific dates and times will be de-termined by the assigned Contracting Officer Representative (COR). Anticipated course dates will be provided in funded BPA calls.

After an introduction from the course coordinator, the course will begin with a safety brief to maximize the safety of the participants and reduce the possible occurrence of injury. The presentation shall contain, but is not limited to the following topics: physical threats in domestic and international environments and tactics and techniques to ward off physical threats. The presentation shall also include elements of situational awareness and an overview of current international criminal trends which may mirror some domestic trends, along with applicable deterrence. Instruction shall not include in any way weapons techniques or choke holds/choking techniques.

All instruction shall be defensive in nature.

Most offerings of BPD courses will be conducted at the Department of State’s Foreign Service Institute located in Arlington Virginia.

Entry level participants appreciate the non-intimidating environment and the presentation team must be careful not to move too fast and will avoid reliance on law enforcement, karate or judo jargon. Successful presentation teams are inclusive of all experiences when engaging in practical exercises and describing scenarios pertaining to self-defense. It is also important to acknowledge that some parti-cipants will not be able to engage in all of the practical exercises and are not required to do so. The level of self-defense and athleti-cism of the participants varies even though the program is described as entry level.

Part Two: Basic Personal Defense course for Teenagers The above description also applies and includes a subsequent program; a Basic Personal Defense course for teenage participants of the summer Young Diplomats Overseas Program (YDOP). Under this contract, an age appropriate version of BPD will be offered to For-eign Service Eligible Family Members between 13-18 years of age. Considering the age group includes 13-18 year old boys and girls, age appropriate content will take into consideration the physical strength and capacity of students, the vulnerability of adolescents, and will find a balance between preparing students for an altercation and not scaring them away from fully engaging in their future over-seas environment. The BPD for Teenager course will likely be schedule three-six (3-6) times during the summer (June-August) months. These offerings will coincide with the two-day Young Diplomats Overseas Program. Specific dates and times will be de-termined by the assigned Contracting Officer Representative (COR). Anticipated course dates will be provided in funded BPA calls.

Description of Agreement This will be a Blanket Purchase Agreement (BPA) with a one year base ordering period and four (4) additional one year ordering peri-ods. This solicitation will result in a presentation team contracted via a single award agreement. This solicitation is not for United States Government Civil Service jobs. Performance of these services will occur only as authorized by specific BPA Calls detailing dates, tasks and schedules. The government may issue orders requiring services at multiple locations.

Offerors must submit quotes to be considered for both the Basic Personal Defense for Adults and Basic Personal Defense for teen-agers. Companies may provide the same presentation team for both courses. The presenters will help support FSI’s intent to provide diversification of knowledge and presenter shared experiences. The FSI will evaluate all offers and determine if an Offeror is capable of providing both forms of instruction (theory and practical) for BPD for adults and BPD for teenagers.

No part of the services to be performed under this agreement may be subcontracted, and no obligation or duty arising out of the indi-vidual order may be transferred, or assigned, without the prior authorization of the Contracting Officer.

Purchase Limitation There will be no limit to the number of Calls issued under the BPA, however, the total value of orders placed under a BPA award shall not exceed $7 million dollars.

Extent of Obligation There is no specific commitment by either party, until dates, task and schedule are mutually negotiated. BPA Calls will be issued un-der a BPA based upon the government's need and according to FSI's determination of what is most advantageous to the Government.

FSI does not guarantee any minimum level of work under any resultant BPA.

Individuals authorized to purchase under the BPA Only an FSI Contracting Officer may enter into agreement with the contractor through the issuance of a BPA Call. Only an FSI Con-tracting Officer can make modifications to the BPA or BPA Call through a modification.

Prior approval by the Contracting Officer and the technical representative of the program office for subcontracting is required and must be documented.

Neither the COR/GTM have the authority to make changes in this Performance Work Statement or in the terms and conditions of this agreement; any necessary changes are only made by the Contracting Officer in the form of a bilateral agreement. The Contractor is forewarned that the Government will not compensate any additional work by the contractor if it is not authorized in the BPA.

Definitions Here forward Contractor will refer to the contractor/company who will ultimately be responsible for services rendered and billing.

Furthermore, Presentation Team will be the actual professionals tasked with facilitating/instructing the MQ930 Basic Personal De-fense for Adults (BPD) and Basic Personal Defense for Teenagers. Differences between the Basic Personal Defense for Adults Presentation Teams and Basic Personal Defense for Teenagers Presentation Teams will be delineated as necessary.

The Presenter(s) shall have travel experience in foreign countries, familiarity with foreign policy issues, and possess a working know-ledge of the current structure, policies, regulations and operational mechanisms of U.S. foreign affairs government agencies, in partic-ular U.S. Embassy security measures.

*The Contractor and Presentation Team Lead will be required to attend an initial post-award orientation meeting with the COR/GTM onsite at FSI. The meeting will last up to an hour. The awardee (Contractor and Presentation Team Lead) must also attend at least one meeting per year with the COR to review student evaluations, objectives, and structure of the course. This annual meeting will last up to one hour and will be onsite at FSI or via telephone at the discretion of the COR. These meetings are not billable—the cost of con-tractor attendance must be integrated into the fully loaded course rates.

*The Contractor/Presentation Team must work with the COR/GTM to address any issues with the presentation and content of the course, performance concerns for individual instructors, and other feedback in response to evaluations from students and staff, and/or updates to security procedures or State Department policies.

*After the initial award of BPA, the Contractor may not substitute or replace the Team Lead, without first vetting substitutes through the COR and receiving written approval from the COR. Furthermore, the Team Lead may not be changed for three months starting from the first billable action under the contract.

This position shall not be billable to the Foreign Service Institute.

*The Government will not provide any liability insurance to contractors performing services under this award. It is the Contractor’s responsibility to ensure what if any coverage is appropriate and insure their employees who will be performing under this award ac-cordingly.

Other Should it be necessary to cancel or postpone one or more of the Basic Personal Defense courses, every effort will be made to gives the Contractor and Presentation Team a minimum of one week’s notice prior to the scheduled start of the session in question.

By mutual agreement, and depending on the availability of funds, the contractor could be contacted to provide additional sessions, throughout the period of the BPA.

Government Provided Property The Government will provide all necessary supplies to perform the duties listed above. Supplies are considered computer, projector, slide advancer, microphones, striking dummies, striking pads, and floor mats. The contractor will be providing the actual subject mat-ter content and any associated materials. The contractor can bring in visual aids or any material that is in support of an interactive learning environment or innovative learning environment, however, this will all be under the supervision and approval of the COR/

GTM.

Data Rights All materials developed by the Contractor and their associated Presenter(s) become the property of the Government; and the Contract-or/Presenter(s) may not copy or reproduce them in any way for use outside of an FSI class, share them by any means outside of the Foreign Service Institute, or publish them in any fashion without the express permission of the Director of the Transition Center.

Quality Assurance The COR/GTM (Contracting Officers Representative/Government Technical Manager) determines acceptability of services according to the Performance Work Statement (PWS) and performance metrics. The Government has the right to inspect and approve all ser-vices called for in orders issued under the BPA.

If the Contractor fails to perform the required services at an acceptable level as determined by the Supervisor/GTM, either from a per-formance or professionalism standpoint, the Government reserves the right to terminate the BPA.

Technical Direction The COR/GTM shall provide guidance regarding the interpretation of the PWS and the session objectives.

The contractor is expected to carry out instructions received from the COR/GTM in a professional and timely manner. The Govern-ment will not provide extensive counseling to the contractor on their performance. It is assumed that once the Contractor/ Presentation Team receive instructions and/or feedback about how to perform the duties that they will implement the instructions. Should contract-or performance not be adequate, the Government may cease issuance of additional BPA calls and may seek additional recourse up to and include the termination for cause of already funded BPA calls.

As such, the Contractor is responsible for managing their taxes, health insurance, liability insurance, social security payments, etc. The Govern-ment will pay the Contractor based on the fully loaded firm-fixed price per course rate; the Contractor is responsible for paying their personal expenses. The government will pay no benefits under this agreement. Contractors will be issued a BPA Call that will detail the period of performance their services may be required. The award of a BPA does not necessarily mean that the government will make a BPA Call of services.

The contractor is responsible for parking expenses on site at FSI ($5 per car, if arrival before 12PM is required).

Termination of BPA Calls If the government determines that the terms and conditions of the BPA or BPA Call are not adequately met, the government reserves the right to terminate for cause. GTMs are responsible for monitoring contractor performance. Should they observe that a contractor is failing to follow guidance, is unable to complete designated tasks, cannot work collegially with colleagues, or is demonstrating any other unprofessional behavior; the GTM will advise the contractor and also notify the COR and CO. The government may also ter-minate for convenience as determined by the government’s needs.

The contractual performance of the ele-ment or sub-element being evaluated reflects a serious problem for which the contractor has not yet identified corrective actions. The Contractor’s proposed actions appear only marginally effective or were not fully imple-mented. Facilitator(s) demonstrates poor facilitation skills, a shallow understanding of program requirements, and does not meet performance standards.

Unsatisfactory: Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains a serious problem(s) for which the Contractor’s corrective actions appear or were ineffective. Facilitator(s) routinely fails to demon-strate facilitation skills and an understanding of program requirements.

3. Performance Metrics - Evaluation Areas For each of the Evaluation Areas below, performance will be rated and evaluated using, but not limited to, the following considerations:

Quality:

The Contractor and the Basic Personal Defense Presentation Team must adhere to the requirements as outlined in the PWS and facilitate a high quality educational session reflecting up-to-date self-defense techniques. Mul-tiple measurements will be used to formulate a rating including student feedback, observations of Transition Center and relevant security personnel from Department of State, as well as those of the COR/GTM. In addi-tion to student feedback, course coordinators and the COR/GTM will provide feedback on the presentation con-tent and tone as well as the instruction quality of individual presenters.

Schedule/Timeliness of Performance:

The Contractor and the Basic Personal Defense Presentation Team must adhere to session time parameters and respond to program coordination emails within 24 hours. The rating will be formulated by the COR/GTM based on his/her observation and input from the Security Overseas Seminar coordination team.

Management/Business Relations/Customer Satisfaction:

The Contractor and the Basic Personal Defense Presentation Team must provide effective customer service to the internal FSI clients of this contract COR/GTM, Transition Center staff and students - per their duties in the PWS. There is an expectation that the Contractor will listen to the feedback provided by the COR/GTM and actively take steps to align with the needs of the government as outlined in the PWS, including being responsive on feedback provided for individual instructors. The COR/GTM will use his/her expertise and general observ-ance of interactions and customer service with FSI staff, and students. The rating will be formulated by the COR/GTM based on his/her observation and input from the Security Overseas Seminar coordination team.

Key Personnel:

The COR will assess the contractor's performance in selecting, retaining, supporting, and replacing, when ne-cessary, key personnel Presenter Team Leads.

Additional considerations:

• How well did the contractor match the qualifications of the key position, as described in the contract/order, with the person who filled the key position?

• Was the Key Personnel responsive in addressing performance feedback for individual instructors?

• Did the contractor support key personnel so they were able to work effectively?

• If a key person did not perform well, what action was taken by the contractor to correct this?

• If a replacement of a key person was necessary, did the replacement meet or exceed the qualifications of the position as described in the contract or order schedule?
