SECTION L

INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

SOLICITATION: FA8251-23-R-0005

A. INTRODUCTION:

1. This section provides guidance for preparing proposals and specific instructions on the required format and content. To assure timely and equitable proposal evaluation, offerors shall propose in accordance with this section and all solicitation requirements (i.e. provisions, clauses, appendices, attachments, forms, etc.). Non-conformance with the instructions provided in this section or the requirements and statements of the solicitation may result in an unfavorable evaluation or proposal disqualification (i.e. the offeror was non-responsive to the solicitation requirements).

2. The Government representatives identified below shall be the sole points of contact for this acquisition. All questions, comments, and/or concerns shall be directed to the below points of contact.

3. If an offeror believes that the solicitation contains errors, omissions, or is otherwise unsound

(i.e. the offeror is unable to agree to the proposed delivery schedule), the offeror shall immediately notify the aforementioned Government representatives in writing with supporting rationale. Upon consideration, the Government may continue, amend, or cancel the solicitation.

4. The Government reserves the right to award this effort based on initial proposals, as received, without discussions IAW FAR 52.215-1. However, if the Contracting Officer (CO) determines that entering into discussions is in the best interest of the Government, the CO may do so.

5. The Government intends to award the requirement(s) represented in this solicitation to one awardee. However, the Government reserves the right to award no contract at all.

6. If only one proposal is received the procedures in DFARS 215.371 Only One Offer will be followed.

B. PROPOSAL FORMAT:

1. A digital proposal is required; however, offerors may submit a hardcopy proposal in addition to the digital proposal.

a. Email to the aforementioned Government representatives is the preferred method for delivering digital proposals. Hardcopy proposals shall be submitted via courier to the aforementioned Government representative(s).

2. Completion of Proposal via Solicitation Standard Form 1447, Offerors shall complete blocks 11, 13, 15 and 27 on the front page. Offerors that are determined not acceptable will not be considered for award.

3. Completion of written Technical Proposal

4. Factor 1 – Technical

a. The written technical proposal shall be clear, concise, and include all the information required by this provision in sufficient detail for effective evaluation. The proposal should not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume the Government has no prior knowledge of their capabilities, work processes, facilities, and experience and will base its evaluation on the information presented in the offeror’s technical proposal.

b. Format and Specific Content: The following information shall be provided in the written technical proposal and will be evaluated to assess technical acceptability in accordance with Section M-900, Evaluation Basis for Award. The written technical proposal shall address each of the following subfactors to describe the offeror’s proposed approach to performing the requirements set forth in the PWS.

Subfactor 1.1 - Lead Time: Offeror shall provide a list of necessary equipment, tooling, shop aids, parts, etc. needed for this effort, and a timeline to obtain such, in order to meet the Government’s lead time.

Subfactor 1.2 - Capacity and Consistency: Offeror shall provide a schedule showing how they will meet the Governments minimum requirement of one canopy repair per month and 15 canopy repairs per year. Schedule will include time on cradle fixture and repair fixture for each canopy throughout the repair cycle.

Subfactor 1.3 - Risk Mitigation Plan: Offeror shall include answers to the following questions as part of the risk mitigation plan:

- How many repair fixtures does offeror have, how many will be built / procured?

- Is there competing workload for these fixtures?

- If competing workload, is that workload on-schedule or behind-schedule?

- Does offeror have any labor risks (qualified labor), what is the mitigation plan?

- What part constraints / obsolescence issues does offeror have, how will offeror mitigate these constraints?

Subfactor 1.4 – Technical Data Delivery: Offeror shall provide the technical data in a

Commercial Of-The-Shelf (COTS) format and sent via email to the recipients listed in

CDRL B003.

5. Factor 2 – Price

a. Offerors shall propose a unit price (i.e. amount) for each CLIN in Section B for Year 1 through Year 3. Prices are not to be proposed for those CLINS that are Not Separately

Priced (NSP) or are to be negotiated at the task order level.

b. Offerors shall propose to the delivery schedule in the solicitation. A proposed delivery beyond the established required delivery will result in a non-responsive proposal. Early delivery is acceptable unless specifically prohibited.

6. Offerors shall fill in the Inspection and Acceptance clause, as well as the F.O.B Origin clause in Part I Section E and Section F of the solicitation.

7. Offerors shall fill in applicable clauses under Part II Section I of the solicitation.

a. Offerors shall provide a subcontracting plan as specified in clause 52.219-9 Small

Business Subcontracting Plan. If not applicable, the offeror shall provide explanation as to why small business subcontracting is not feasible for this contract.

8. Offerors shall fill in their representations, certifications, and other statements in Part IV

Section K of the solicitation.

9. Offerors are required to review ALL sections of the solicitation to include solicitation provisions/clauses and complete ALL representations as required.

10. Offerors must clearly identify any exception or inclusion to the solicitation and substantiate the exception or inclusion with supporting rationale (i.e. the Offeror is unable to agree to the required delivery schedule). The government is not obligated to accept any exceptions or inclusions. Failure to meet all solicitation requirements may result in an unfavorable evaluation or proposal disqualification (i.e. the Offeror was non-responsive to the solicitation requirements)
