Pricing is firm for the entire contract term, with invoices required to be submitted within 45 days of contract expiration or they will not be paid. The State will make payment via Electronic Funds Transfer through the Sigma Vendor Self Service Portal, and the contractor must electronically register with the State as required by MCL 18.1283. Final acceptance will be determined through visual inspection. Liquidated damages of $1,000 plus an additional $100 per day apply for late or improper completion of contract activities. The contractor must designate a Contractor Representative specifically assigned to State of Michigan accounts and disclose any subcontractors, including their legal business names, addresses, telephone numbers, organization descriptions, and proposed work scope. Products must meet environmental and energy efficiency standards and comply with federal and state requirements regarding hazardous chemicals, mercury content, brominated flame retardants, and PFAS substances. The contractor is responsible for all costs associated with disposal and must protect the safety and health of the public, state employees, and state property during contract performance.

Michigan.gov/MiProcurement Schedule a – statement of work contract activities Request for Proposal (RFP) No. 230000002771 Five Points Landscaping Roundabout Mason Township, Cass County, Michigan This schedule identifies the anticipated requirements of any Contract resulting from this RFP. The term “Contractor” in this document refers to a bidder responding to this RFP, as well as the Contractor who is awarded the contract. The term “bidder” is used to identify where specific responses to the RFP are required.

The Contractor must respond to each requirement or question and explain how it will fulfill each requirement. Attach any supplemental information and appropriately reference within your response.

BACKGROUND

MDOT Southwest Region provides transportation related construction and maintenance needs for local communities within their jurisdiction.

SCOPE

Landscaping services to include fabric, decorative stone, earth excavation, and traffic devices for US 12/Old M-205, Five Points Road near the Coloma TSC.

REQUIREMENTS

1. General Requirements The required objective is to maintain the facilities in such a manner that the location provides a clean, healthy, and safe work environment for occupants and visitors of State-owned or leased facilities.

A. The Contractor must provide all personnel, training, equipment, tools, materials, supervision, and other items and/or services necessary to perform the contract activities.

B. The Contractor shall conduct and supervise work as to ensure its completion in accordance with the terms of the Contract and the approved project schedule.

C. Contract Activities require personnel to comply with High Visibility clothing requirements. All workers must wear high-visibility safety apparel as specified in the Michigan Manual of Uniform Traffic Control Devices [see MDOT - Transportation Standards and Special Details (state.mi.us)], Sections 6D.03 and 6E.02.

D. All local noise, dust, and work-hour ordinances shall apply to the Contract.

E. MDOT will not be responsible for any cost associated with the disposal of any service provided in this Contract. MDOT will not be responsible for any citations, fines or tickets received, while performing Contract activities.

F. Contractor shall protect the safety and health of the public, state employees, State property and property of the local unit of government during the performance of this Contract.

2. Product Specifications Inside the vegetated section of the roundabout, the Contractor shall perform the following, as directed by the Engineer:

· The Contractor must provide the following: Remove existing established landscaping and excavate soil to a minimum of 6 inch per Special Provision for Decorative Stone

· Place landscape fabric per Special Provision for Landscape Fabric between concrete curb and tree

· Mulch rings before placing stone

· Place Decorative Stone, per Special Provision for Decorative Stone at a depth of 6-inch width

· Finish grade being level with concrete curb and top of steel landscape edging. Approved stone types are Meramec Rock and River Rock. Contractor to identify the selected stone in the quote.

· The grading of the proposed landscaping to match existing grading to maintain the visual barrier

· Restore elevation and slope to original specifications

· Plant 7 Syringa Reticulata “Ivory Silk’, 2-inch trees per R-100 Planting details. Place 4-inch of mulch around each tree over root ball. Do not place fabric or stone within mulch rings. The trees to be spaced

· 15 ft O.C. centered in the middle of the roundabout. See attached detail

2.1. Transition

Post-Contract Transition: Invoices must be sent within 45 days after expiration of contract. Any invoices received after 45 days will result in a non-payment of invoice.

3. Service Requirements

3.1. Timeframes

All Contract Activities must be completed by September 29, 2023 from receipt of order. All work must be completed within six (6) consecutive days of start date. Notice must be provided to Dharmesh Valsadia at valsadiad@michigan.gov a minimum of three (3) calendar days prior to beginning work. The receipt of order date is pursuant to the Notices section of the Standard Contract Terms.

4. Staffing

4.1. Contractor Representative

The Contractor must appoint one individual specifically assigned to State of Michigan accounts who will respond to State inquiries regarding the Contract Activities, answer questions related to ordering and delivery, etc. (the “Contractor Representative”).

The Contractor must notify the Contract Administrator at least calendar days before removing or assigning a new Contractor Representative.

4.3. Disclosure of Subcontractors

If the Contractor intends to utilize subcontractors, the Contractor must disclose the following:

· The legal business name; address; telephone number; a description of subcontractor’s organization and the services it will provide; and information concerning subcontractor’s ability to provide the Contract Activities.

· The relationship of the subcontractor to the Contractor. Of the total bid, the price of the subcontractor’s work. Whether the Contractor has a previous working experience with the subcontractor. If yes, provide the details of that previous relationship.

· A complete description of the Contract Activities that will be performed or provided by the subcontractor.

8.1. Invoice Requirements

All invoices submitted to the State must include: (a) date; (b) purchase order/contract number; (c) quantity; (d) description of the Contract Activities; (e) unit price; (f) shipping cost (if any); (g) vendor-generated invoice number and (h) total price.

8.2. Payment Methods

The State will make payment for Contract Activities Sigma/Vendor Self Service via Electronic Funds Transfer (EFT): Welcome to CGI Advantage Vendor Self Service Portal: Home (michigan.gov).

As required by MCL 18.1283, the Contractor must electronically register with the State.

9. Licensing Agreement The Contractor must provide a copy of any applicable licensing agreement.

Bidder must provide a copy of any applicable licensing agreement either in this response box or identified here as an attachment to this RFP.

10. Liquidated Damages Late or improper completion of the Contract Activities will cause loss and damage to the State and it would be impracticable and extremely difficult to fix the actual damage sustained by the State. Therefore, if there is late or improper completion of the Contract Activities the State is entitled to collect liquidated damages in the amount of $1,000 and an additional $100 per day for each day Contractor fails to remedy the late or improper completion of the Work.

11. Additional Requirements

11.1. Environmental and Energy Efficiency Product Standards

The Contractor must provide products that meet the environmental or energy efficiency standards. Contractor must describe how products that meet these requirements are identified or otherwise labelled.

11.2. Hazardous Chemical Identification

In accordance with the federal Emergency Planning and Community Right-to-Know Act, 42 USC 11001, et seq., as amended, the Contractor must provide a Material Safety Data Sheet listing any hazardous chemicals as defined in 40 CFR §370.2, to be delivered. Each hazardous chemical must be properly identified, including any applicable identification number, such as a National Stock Number or Special Item Number.

The Contractor must identify any hazardous chemicals that will be provided under any resulting contract.

11.3.

Mercury Content Pursuant to MCL 18.1261d, mercury-free products must be procured when possible. The Contractor must explain if it intends to provide products containing mercury, the amount or concentration of mercury, and whether cost competitive alternatives exist. If a cost competitive alternative does exist, the Contractor must provide justification as to why the particular product is essential. All products containing mercury must be labeled as containing mercury.

11.4. Brominated Flame Retardants

The State prefers to purchase products that do not contain brominated flame retardants (BFRs) whenever possible. The Contractor must disclose whether the products contain BFRs. Contractor must describe how products that meet these requirements are identified or otherwise labelled.

11.5. Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS)
