DEPARTMENT OF DEFENSE

WASHINGTON HEADQUARTERS SERVICES

1155 DEFENSE PENTAGON

WASHINGTON, DC 20301-1155

ACQUISITION DIRECTORATE

02 September 2015

JUSTIFICATION FOR SOLICITING FROM A SINGLE SOURCE

FOR

PENTAGON MISSION CRITICAL CHILLER REPAIR

Pursuant to the Federal Acquisitions Regulation (FAR) FAR 6.302‐1(a)(2)(iii)(A) Only one responsible source and no other supplies or services will satisfy agency requirements.), Washington Headquarters Services (WHS) has determined that sole source procedures under the are justified for this procurement action. The following is supporting documentation in accordance with FAR 6.303.

1. Contracting Agency – United States Department of Defense (DoD), Washington Headquarters Services (WHS), Acquisition Directorate (AD).

Requiring Office: United States DoD, WHS, Facilities Services Directorate (FSD).

2. Nature/Description of Action –This procurement will be a follow‐on award to a previously provided repair. The contractor will perform repairs and updates to the control system hardware, software, and program logic at the RDF chiller plant. The repair and updates will be on SCADA (Supervisory Control and Data Acquisition System) built by Allen Bradley. Allen Bradley was purchased by Rockwell Automation (RA). Program logic and software updates include: program logic updates based on previous two years of in‐depth troubleshooting and sequence of operations analysis, control point adjustments, revision of control points for enhanced reliability, addition of safety interlocks into the program logic and HMI updates for operator use. Hardware additions include: additional sensors to correct sequence, reliability and safety and hardware repairs, updates and upgrades to existing equipment. Due to the complex knowledge and skills required to troubleshoot and repair these systems, it is essential to immediately contract a team that has previous knowledge and expertise with the equipment and programming deficiencies for this work. Using another resource would not be very cost‐efficient. The Rockwell Automation (RA) technical lead has in‐depth knowledge of not only the code but the other systems that interface with it such as hardware, networks, servers and HMI (Human Machine Interface) displays. He also understands unique mission critical chiller plant and organizational requirements.

3. Description of Supplies/Services Required to Meet the Agency’s Needs – Inclusive of the Estimated Value– The DoD/WHS/FSD has a requirement for the acquisition of electronic controls repairs for the Pentagon Remote Delivery Facility Mission Critical Chilled Water Plant. This plant provides chilled water for HVAC throughout the Pentagon. Without this support, multiple tenants could not continue to operate if the primary cooling plant experienced a major problem. This repair work will be a one‐time award. The estimated value of this service and maintenance support services is not expected to exceed $380,000.00.

4. Statutory Authority Substantiating this Action – Using the authority of FAR 13.501(a)(1)(ii) “Test Program for Commercial

Items” with FAR 6.302‐1(a)(2)(iii)(A) as reference, “…services may be deemed to be available only from the original source in the case of follow‐on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in‐‐Substantial duplication of costs to the Government that is not expected to be recovered through competition...” This RA system utilizes unique codes and ControlLogix controller hardware, networks, servers and displays which are specialized services.

5. Demonstration of Unique Qualifications Under Cited Authority –Rockwell Automation has gained extensive knowledge and understanding of the Pentagon Mission Critical Chiller Controls and programming requirements through a previous contract (HQ0034‐13‐P‐0204) to safely and expeditiously perform the work required for this current requirement.

Rockwell Automation is also the manufacturer of the software and hardware in the Mission Critical Chiller Plant system and has spent the last two years performing functions to repair and update the RDF mission critical chiller plant control system. Rockwell Automation gained extensive expertise on this highly specialized system that allowed them to identify problems that have accumulated over the ten operational years of the plant and compounded by numerous other contractors’ attempts at repair. The Government will incur duplicated cost and effort if another contractor is awarded this action. If this contract were awarded to another contractor, the Government would incur duplication of effort for at least two years of continuous technical troubleshooting by a senior engineer while the contractor becomes familiar with the sequence of operations, control system, logic and hardware at the chiller plant. Rockwell Automation has installed their licensed software program for the chiller plant SCADA (Supervisory Control and Data Acquisition System). A different contractor could modify the program, but will need long man hours to reach Rockwell Automation software engineer’s level of expertise. Providing program plus software engineering support will be very difficult to replace Rockwell Automation.

Additionally, Rockwell Automation’s previously provided repair which is scheduled to be completed at the end of September is covered with 12 months warranty. This warranty will be void upon any modifications to the software by another contractor.

6. Efforts to Obtain Competition – The Contracting Officer will post the sole source justification on the Federal Business Opportunities website at www.fbo.gov in accordance with FAR Subpart 5.2, Synopsis of Proposed Contract Actions.

7. Contracting Officer’s Fair and Reasonable Cost Determination – Through comparison of pricing for maintenance and support services for similar maintenance and support services, labor hour wage rates, and historical acquisition data, the Contracting Officer has determined that the anticipated cost to the Government, for the services required will be fair and reasonable.

8. Market Survey –Market research was conducted on equipment such as sensors, level control parts, and current transducers. The software engineer’s rate from the original contract was utilized for this follow‐on award. This follow‐on award is for the continued provision of highly specialized services and substantial duplication of costs to the Government is not expected to be recovered through competition.

9. Other Facts Supporting the Use of Sole Source – N/A

10. List of Source(s) –Rockwell Automation; 9020 Stony Point Parkway, Suite 300, Richmond, VA 23235; Telephone 804‐560‐ 6444.

11. Actions to be Taken to Promote Future Competition – In this instance, there is only one source capable of repairing the Pentagon Mission Critical Chiller Plant controls due to their extensive knowledge and understanding of the chiller inert workings and controls to safely perform this multifaceted work. Due to urgent nature of the required repairs, FSD is proposing to award this one‐time purchase order while also working with AD to procure an Indefinite Delivery Indefinite Quantity (IDIQ) sole source contract to Rockwell Automation with Base 12‐months, with Four, One Year Option Periods for future repairs on this Mission Critical Chiller Plant system.

Though this work is best suited as a sole source contract, FSD is in agreement with AD that we promote the use of small business subcontractors on the future long‐term contract through the requirement of a subcontracting plan in accordance with FAR 52.219‐8, Utilization of Small Business Concerns . The use of a Small Business Sub‐contracting Plan increases the ability of Rockwell Automation to provide the required services to the Government without interruption, while also increasing the efforts to remove or overcome barriers to competition while supporting the Small Business Goals of WHS.

12. Requiring Office Certification – I certify the supporting data, which form the basis for this Justification for Other than Full and Open Competition, are accurate and complete.

Natalie Huber Date Deputy O&M Manager

13. Contracting Officer’s Certification –All of the requirements of FAR 13.501(a) with FAR Part 6.302‐1 as a reference have been considered in preparing this justification. Based on the above, I recommend this acquisition employ the simplified procedures authorized by the test program to the maximum extent practicable, as required by FAR Part 13. In addition, I agree that the sole source procedures in accordance with FAR 6.302‐1 Only one responsible source and no other supplies or services will satisfy agency requirements. I certify that this justification is accurate and complete to the best of my knowledge and belief.
