Justification for Solicitation SA1301-16-RP-0003 Renew a Subscription to HeinOnline

1.The Commerce Research Library intends to renew their subscription to HeinOnline for a base year, plus four option years. HeinOnline is an online legal research database providing access to more than 80 million pages of secondary legal materials. It is a unique database in that all the content is available from the publication's inception, starting at volume 1, and all content is in PDF image-based format. HeinOnline is the sole source of 95% of the content in HeinOnline published before 1980 in this format and fully searchable.
2.Almost all of the law journals and other publications are not available through other databases (such as EbscoHost, Gale Academic & General OneFile, or ProQuest) from their inception, and only offer selected years, if the title is offered at all. Additionally, while many of the government documents HeinOnline offers that Commerce employees need (such as the Federal Register, Congressional Record, Code of Federal Regulations, US Statutes at Large, etc.) are available for an additional cost through the LexisNexis or Westlaw databases, attorneys often have pagination issues because the content is transcribed by third-party, also rendering it subject to potential errors. The PDF image-based format is only offered by HeinOnline for most of this content and is the only format that allows attorneys and other Commerce employees to see the government document as it was originally printed, which ensures the wording and cited pagination are correct.
3.The Commerce Research Library has had a subscription to HeinOnline for several years. Due to building renovations and space constraints, the Commerce Research Library has had to sacrifice much of the physical collection to fit within the smaller space allotted. As a result, many of the government documents that were previously available to Commerce staff in print had to be discarded. This includes a complete run of the Federal Register, older CFR titles, select years of the Congressional Record, and a large number of legal journals. The library was able to justify discarding these titles because of the availability of the PDF image-based format HeinOnline uses, as well as the fact that their publications include full runs of these titles back to inception. Without this resource, Commerce staff, especially the attorneys in OGC, would not have the necessary resources available to complete their due diligence responsibilities
