4. Authority Cited: 41 U.S.C. 152 (3), as prescribed in FAR 8.405-6, Items Peculiar to one
Manufacturer (brand name).
5. Reason for Authority Cited: Adobe is the benchmark product on many key software platforms at DCMA and is an industry leader in a wide variety of applications. DCMA owns and manages a large inventory of these Adobe products and the end user approval is “high.” Adobe Brand name products require annual maintenance per the Terms and Conditions of the contract. Adobe products are proprietary and require Adobe brand name maintenance; therefore, no other maintenance will suffice. These products cannot legally be altered to not require this maintenance.
The annual maintenance required includes security patches for discovered vulnerabilities that might otherwise leave the DCMA network infrastructure vulnerable to outside hostile influences. Maintenance also includes tech support as may be required to assist end-users or in-house technical staff. DCMA maintains 32 separate Adobe products (listed above) including Acrobat of which every DCMA employee and contractor uses to open and read PDF documents. DCMA is currently adding licenses to its inventory in order to meet the demands of an increasing number of users.
If an alternate PDF reader/editor was considered, DCMA could face a significant learning curve for a new product with subsequent loss of productivity. Depending on the proposed new “reader,” the previously stored Adobe PDF could not be compatible and therefore, potentially, stored Adobe Acrobat documents may become unreadable. This would be true, as well, for any of the other 32 products stored data. Proposed pricing for Adobe products is also discounted, based in large part, to the quantity of licenses DCMA is buying and maintaining. DCMA would lose its discount and potentially pay the same amount it currently pays (or more) for fewer products if DCMA moves to a different brand product for one or more of the current Adobe branded products.
The vast majority of the Adobe products as listed are available on ESI contract N00104-09-A-ZF31. Since DCMA is seeking a BPA style contract, the terms and conditions of the ADOBE ETLA (Enterprise Term Licensing Agreement) contract and the Government ESI Agreement conflict, and as such disallows the use of the ESI Agreements. The complete DCMA Adobe requirement base however is available, as requested, on GSA at a minimal cost difference.
6. Market Research and Efforts to Obtain Competition: Market research was conducted by internet searches. In addition, industry personnel were consulted to determine availability of sources. Research indicates that Adobe maintenance and support is available from holders of Enterprise Software Agreements under the DoD ESI. IAW 40 U.S.C. 11312, DoD agencies are required to fulfill requirements for commercial software and related services through ESI when possible. However, as noted above, due to a conflict of posted Terms and Conditions and Government policy ESI is not able to be used as a source of supply. DCMA contacted the following Adobe authorized resellers for interest:
(1) En Pointe Gov, (2) CDW-Government, (3) Dell Software Inc., (4) Emergent Technology Group, (5) GovConnection, (6) Insight Public Sector, (6) SHI International Corporation, and (6) Softmart Governmental Services, Inc. The requirement will be solicited among the holders of GSA.
7. Fair and Reasonable Cost Determination: Pricing will be determined fair and reasonable based on competition, a comparison of current market prices and the historical contract pricing of GSA contract vehicles and DCMA BPA and call orders.
8. Other Factors: None
9. Sources: DCMA is aware of several authorized Adobe resellers holding GWAC BPAs.
BPA holders are as follows: (1) Carahsoft Technology Inc. (CAGE 1P3C5); CDW-G (1KH72); (2) Dell Marketing L.P. (3DMD3); (3) Emergent, LLC (4J2K1); (4) GovConnection (0GTJ3); (5) Insight Public Sector (575H6); SHI International Corporation (1HTF0); (6) Softchoice Corporation (3DH15); and (7) Softmart Government Services, Inc. (1LW45)
10. Actions Taken to Remove Barriers: In 2015 the IT department considered the possibility of removing Adobe Acrobat for an alternate Brand of PDF reader. The results of this consideration determined that Best value for the Government was to remain with Adobe Acrobat for the foreseeable future due to the reasons previously mentioned to include the quality of the product and the Security patches that are helping to protect our environment from vulnerabilities as well as due consideration of the investment DCMA currently has in its Adobe inventory.
