Governing Law (continuation of Schedule of Supplies and Services above):

Federal law and regulations, including the Federal Acquisition Regulations (FAR), shall govern this Contract/Order. Commercial license agreements may be made a part of this Contract/Order but only if both parties expressly make them an addendum hereto, as permitted by FAR 12.212. If the commercial license agreement is not made an addendum, it shall not apply, govern, be a part of or have any effect whatsoever on the Contract/Order; this includes, but is not limited to, any agreement embedded in the computer software (clickwrap), any agreement that is otherwise delivered with or provided to the Government with the commercial computer software or documentation (shrinkwrap), or any other license agreement otherwise referred to in any document. If a commercial license agreement is made an addendum, only those provisions addressing data rights regarding the Government’s use, duplication and disclosure of data (e.g., restricted computer software) are included and made a part of this Contract/Order, and only to the extent that those provisions are not duplicative or inconsistent with Federal law, Federal regulation, the incorporated FAR clauses and the provisions of this Contract/Order; those provisions in the commercial license agreement that do not address data rights regarding the Government’s use, duplication and disclosure of data shall not be included or made a part of the Contract/Order. Federal law and regulation including, without limitation, the Contract Disputes Act (41 U.S.C. § 7101 et seq.), the Anti-Deficiency Act (31 U.S.C. § 1341 et seq.), the Competition in Contracting Act (41 U.S.C. § 3301 et seq.), the Prompt Payment Act (31 U.S.C. §3901 et seq.), Contracts for Data Processing or Maintenance (38 USC § 5725), and FAR clauses 52.212-4, 52.227-14, 52.227-19 shall supersede, control, and render ineffective any inconsistent, conflicting, or duplicative provision in any commercial license agreement. In the event of conflict between this clause and any provision in the Contract/Order or the commercial license agreement or elsewhere, the terms of this clause shall prevail. The Contractor shall deliver to the Government all data first produced under this Contract/Order with unlimited rights as defined by FAR 52.227-

14. Claims of patent or copyright infringement brought against the Government as a party shall be defended by the U.S. Department of Justice (DOJ in accordance with 28 U.S.C. § 516; at the discretion of DOJ, the Contractor may be allowed reasonable participation in the defense of the litigation. Any additional changes to the Contract/Order must be made by contract/order modification (Standard Form 30) and shall only be made by a warranted Contracting Officer. Nothing in this Contract/Order or any commercial license agreement shall be construed as a waiver of sovereign immunity.

C.3 VAAR 852.212-72 GRAY MARKET AND COUNTERFEIT ITEMS (MAR

2020)

(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided.

This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.

(b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.

(c) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.

C.4 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—

MONITORING AND COMPLIANCE (JUL 2018) (DEVIATION)

(a) This solicitation includes 852.219-11.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor’s offices where the Contractor’s business records or other proprietary data are retained and to review such business records regarding the Contractor’s compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor’s business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirement.

AND COMPLIANCE (JUL 2018) (DEVIATION)

(a) This solicitation includes the clause: 852.215-70, Service-disabled Veteran-owned and Veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

(d) Comptroller General Examination of Record. BACKGROUND

The Department of Veterans Affairs, VA North Texas, has a requirement for an On-Call service contract to perform maintenance and minor installation of low voltage cabling as needed for VA North Texas Healthcare System. The contractor shall provide voice and data cable installation and follow-on services for VA sites in the VISN 17 North Texas Healthcare system.

This proposal request herein describes the complete Copper Cable and Fiber Optic Cable Distribution System and will be referred to in this document, as the "Cable Distribution System" or “Fiber Distribution System”.

APPLICABLE DOCUMENTS

c. ANSI/TIA 526-14A (2015, Rev. C) optical power loss measurement of installed multimode fiber cable and testing procedures; and

d. EIA/TIA-604 and EIA/TIA-604-5 (2019) for Fiber Optic Connector Intermateability Standard – Type MPO (FOCIS 5).

SCOPE OF WORK

The contractor shall furnish all personnel, equipment, tools, materials, transportation, management supervision, and other items and services necessary to perform all cable installation tasks and functions. The contractor must perform to the standards identified in the performance work statement.

The performance work statement also includes furnishing, installing and maintenance of the complete horizontal copper station cabling and vertical copper riser cable to support voice and data end user equipment. The cable distribution system architecture shall be of the latest technology design for category 6A horizontal station wiring. The Cable Distribution System and Fiber Distribution system shall meet or exceed the manufacturer's published commercial specifications and standards specified in this document. The Contractor shall provide all transmission facilities, equipment, materials, maintenance, test equipment, and design layout needed to perform and provide broadband telecommunications systems access, transport services, and functions at the designated VA locations. These services shall include any special items, equipment, wiring or infrastructure to ensure the Contractor's solution is compatible with the Government's current telecommunications infrastructure.

The contractor shall respond to Critical repairs/work orders within 4 hours.

The contractor shall provide the VA North Texas Healthcare system Engineering group with a dedicated 24-hour phone number for emergency repairs/work orders.

The contractor shall respond to Normal repairs/work orders within 7 business days.

PERFORMANCE DETAILS

TRAVEL

The Government anticipates travel under this effort to perform the tasks associated with the effort, as well as to attend program-related meetings or conferences throughout the PoP. Include all estimated travel costs within the local commuting area in your firm-fixed price line items. These costs will not be directly reimbursed by the Government.

Travel outside of the local commuting area shall be in accordance with the Federal Travel Regulations (FTR) and requires advanced concurrence by the COR. The local commuting area is defined as 50-miles from the Dallas VA Medical Center, 4500 S. Lancaster Road, Dallas, Texas 75216 . Contractor travel within the local commuting area will not be reimbursed.

SPECIFIC TASKS AND DELIVERABLES

The Cable Distribution System and Fiber Distribution system will be maintained to satisfy the digital data and voice requirements of the Department of Veterans Affairs, VISN 17 North Texas Healthcare System (NTX).

5.1 CABLE DISTRIBUTION SYSTEM; COPPER (TWISTED PAIR):

5.1.1 Install at minimum Cat 6A cabling and data drops in accordance with work orders, location drawings, and specifications.

5.1.2 Horizontal cabling shall be at minimum Category 6A (Cat6A) (ANSI/TIA-1179

Healthcare Facility Telecommunications Infrastructure).

5.1.3 Installation shall be compliant with the BICSI standards (ANSI/NECA/BICSI 568, Standard for Installing Commercial Building Telecommunications Cabling and ANSI/TIA-1179-A Healthcare Facility Telecommunications Infrastructure for new installations).

5.1.3.1 New cable installations additionally shall be compliant with TIA 568.2-D, TIA TSB-184-A, and NFPA-70 Section 725.144 to prevent PoE heat accumulation. Provide certification reports to the COR.

5.1.3.2 Alternatively, new UTP cabling shall carry a UL listed "LP" (Limited

Power) rating.

5.1.3.3 Cat6A cable shall be terminated to identified RJ-45 patch panel in IT closet and CAT6A RJ-45 jack at wall plate and labeled at both ends.

5.1.3.4 Use a cable analyzer to determine cable length (max cable length

90M/295 linear feet) and certify that cable meets or exceeds TIA-EIA- 568-C.2.

5.1.3.5 Cables shall be installed in continuous lengths from origin to destination, no splices with a one ft service loop.

5.1.4 Cable management shall be implemented for all patch cables in accordance with Infrastructure Standard for Telecommunications Spaces, Version 3.0, ensuring proper bend radius, bundling, airflow, support and labeling.

5.1.5 Copper structured cabling shall be certified as meeting or exceeding TIA-EIA-

568.1-D (max fixed cable length 90M/295 linear feet) independent of media type.

5.1.6 Use existing raceways as much as possible. Cable shall be installed in accordance with manufacturer’s recommendations and best industry practices.

Existing raceways shall not be filled greater than the NEC maximum fill for the raceway type. Cables shall be supported with J hooks or cable bags every four

(4) to five (5) feet whenever there is an absence of a cable tray. Any areas requiring the use of fire sealing material will conform to the ANSI/NFPA-70 FIRE SEALING / SAFETY standard. The VA, upon written request, will authorize the contractor to provide a quote to increase number or size of pathways only in the event the total pathways provided to any given area are inadequate.

5.1.7 Install and label outlets, faceplates, and patch panels in accordance with specifications and VAMC standard. Patch panel labels shall include outlet #, jack #. All label printing shall be machine generated

5.1.8 Confirm locations, including installation height, with COR.

5.1.9 Patch and finish disturbed surfaces to match existing.

5.1.10 All material, installed by the contractor, shall be new, tested, and certified. Any station cables testing with bad pairs will be reinstalled. Provide the certification report to COR.

5.1.11 All new Station Data / Voice cable sheaths will be color coded. Blue Sheath will be a 4 pair Data Cable; White Sheath will be a 4 pair Voice Cable; Purple sheath will be a 4 pair video/security cable and shall conform to the requirements of ICEA Publications S-80-576-1988 (Ref. B1.6) as to size, color code, and insulation.

5.1.12 Conductors shall be cabled to insure against induction in voice/data circuits.

Crosstalk attenuation within the cable system shall be more than 80dB throughout the frequency range (UL, ISO 2000).

5.1.13 If temporary cable and wire pairs are used, they shall be installed to present no pedestrian safety hazard and the contractor shall be responsible for all work associated with this temporary installation and for removal when no longer necessary.

5.1.14 The Contractor shall ground all metallic cable sheaths, etc. per NEC requirement

(e.g. risers, underground, station wiring).

5.1.15 All outside cable shall be shielded, 24AWG solid conductors, solid PIC insulation, and filled core (flex gel) (waterproof) REA LISTED PE 39 or PE 89 Code. The outside cable plant cable shall be grounded with 6-gauge green ground cable.

Access to the manholes will be coordinated with the VAMC (Quality Management-Safety). This will allow time to air and test the manhole environment to ensure a safe entry.

5.1.16 All inside riser communications cables shall be listed as being suitable for that purpose and marked accordingly.

5.1.17 All inside riser communications cables shall be shielded, 24AWG solid, thermoplastic insulated conductors. It shall be enclosed with a thermoplastic outer jacket. The maximum DC resistance shall be no more than 28.6 Ohms per 1000 feet.

5.1.18 The Contractor shall engineer and install riser cable to provide full service to all voice cable pairs identified in each telecommunication closet/cabinet. A minimum of one pair per telephone shall be provided and cross connected from the telecommunication closet to the Main Distribution Frame (MDF), unless the site requirements differ and, in that case, the existing site requirement will be used.

5.1.19 All new outlets shall have a minimum of two (2) data cables and one (1) voice at each faceplate unless the site at which the work is being performed has different requirements. The faceplate shall be capable of handling a minimum four (4) connectors, including ST fiber optic and FDDI connectors. The data connectors in the faceplate should be available in the color blue for the distinction of different data services provided at the faceplate. Once terminated, the cable sheath is clamped which provides for strain relief. After termination, wire colors should be visible for verification of correct installation. The front of the connectors shall be flush with the faceplate installation. A modular furniture insert shall be available that uses the same connector being used in faceplates. A surface mount box using same connectors is required.

5.2 CABLE DISTRIBUTION SYSTEM; FIBER (FIBER OPTICS):

5.2.1 The Contractor shall install laser-optimized Optical Multimode (OM) OM4 multimode (MM) fiberoptic cable primarily for ISP use. The fiber optic cable shall contain a minimum of 12 strands unless otherwise specified and shall not exceed 400 meters (1312 feet) in a single run. For distances longer than 400 meters, Optical Single mode (OS) OS2 Single mode (SM) fiberoptic cable is required. All fiber optic cable will be installed in contractor provided "inner duct". Loose tube cable, which decouples the individual fibers from the environment, and shall be installed for all outdoor runs or for any area which includes outdoor run. Tight-buffered fiber cable shall be used for in door runs. If any underground conduit becomes at least 75% filled, a spare inner duct, with pull string, shall be installed.

5.2.2 In the computer room all fiber optic cable shall be installed in a rack mounted fiber optic cable distribution component /splice case in accordance with BICSI standards. "ST" connectors will be installed on each strand.

5.2.3 Fiber optic cables shall terminate in IDF’s at a wall mounted interconnect panel.

5.2.4 All strands will be tested, and cable transmission performance specifications shall be in accordance with EIA/TIA standards. Attenuation shall be measured in accordance with EIA fiber optic test procedures EIA/TIA-455-46-61, or -53.

Information transmission capacity shall be measured in accordance with EIA/TIA 455-51, or -30.
