About this file

This document is a Justification for Limiting Sources (LSJ) for a micro-purchase from the Department of Veterans Affairs (VA), Network Contracting Office (NCO) 10, at the Louis Stokes Cleveland VAMC. The VA intends to award a firm-fixed-price delivery order to LogicMark, LLC, a small business, under Federal Supply Schedule (FSS) contract 47QSWA21D005Z for 500 Guardian Alert Plus personal emergency response systems, to be delivered within 5 days of order receipt.

The justification cites that LogicMark, LLC is the only identified FSS contract holder capable of meeting both technical requirements and the accelerated delivery schedule. The Guardian Alert Plus system is a proven VA-utilized device that provides two-way voice communication and immediate access to assistance for vulnerable patients. The procurement is being completed under an urgent and compelling need exception, with market research indicating no alternative FSS contract holders could deliver within the required timeframe without causing compatibility or implementation issues.

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

Rationale/explanation to support cited authority: LogicMark, LLC is the only identified FSS contract holder with the specific Guardian Alert Plus product available and capable of meeting both the technical requirements and the accelerated delivery schedule. The Guardian Alert Plus system is a proven, VA-utilized personal emergency response device that integrates with the facility’s existing infrastructure. It provides two-way voice communication and immediate access to assistance—critical features for the vulnerable patient population served.

Although other emergency alert systems exist on the market, market research did not identify any available through FSS contract holders that could deliver within the required timeframe or without causing compatibility or implementation issues. Competing this requirement under standard procedures would result in an unacceptable delay and compromise patient safety.

Therefore, in accordance with FAR 8.405-6(a)(1)(i)(A), this limited sources justification is appropriate. LogicMark, LLC remains the only responsible source capable of meeting the government's immediate operational and delivery requirements.

Market research was not conducted due to the procurement being completed under FAR 8.405-6(a)(1)(i)(A), An urgent and compelling need exists. The Guardian Alert Pluse are urgently needed for patient care.

Any Other Facts Supporting the Justification: FITARA is not needed. The Guardian Alert Plus devices are not IT-related.

4. BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-1(e).
