B.2 STATEMENT OF WORK

STATEMENT OF WORK

FIRE SUPPRESSION AND DETECTION SYSTEMS TESTS AND INSPECTIONS

I. SCOPE OF WORK

The West Texas VA Health Care System (WTVAHCS) in Big Spring, TX requires non-personal services for testing and inspection of the fire alarm system with related electronic components, fire sprinkler system, standpipes, and fire pump. All tests and inspections shall be performed in accordance with the requirements as outlined by the national fire protection association (NFPA), state, VA, VACO, and in accordance with manufacturer instructions.

The location of the needed testing and inspection of the fire alarm system is:

II. DESCRIPTION

Contractor shall provide all supervision, materials, transportation, tools, and labor necessary to perform testing and inspection of fire suppression and protection systems at the WTVAHCS in accordance with the standards for EC.02.03.05

III. PERIOD OF PERFORMANCE

Base Year: 9/29/2024 – 9/28/2025 Option Year 1: 9/29/2025 – 9/28/2026 Option Year 2: 9/29/2026 – 9/28/2027 Option Year 3: 9/29/2027 – 9/28/2028 Option Year 4: 9/29/2028 – 9/28/2029

IV. SITE VISIT

IAW FAR 52.237-1: Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

VI. COMFORMANCE STANDARDS

Contractor shall ensure that the equipment functions in conformance with the latest published edition of NFPA- 99, JCAHO, OSHA, and manufacturer specifications. All reporting shall be detailed based on the Elements of Performance (EP) specified by TJC regarding each device type. All inspection reports shall meet TJC Standard EC.02.03.05, EP 28. The contractor shall perform annual tests and inspections on the fire alarm system in accordance with National Fire Protection Association recommendations, manufacturer’s recommended procedures, and following standards required by The Joint Commission on Accreditation of Healthcare Organizations (TJC).

All tests and inspections are to be performed in accordance with the most recent edition of NFPA 101, 96, 25, 72, and 13, as applicable.

VII. HOURS OF COVERAGE

All non-disruptive work is to be completed between 8:00 a.m. and 4:30 p.m. (normal working hours) Monday through Friday, except as requested or approved by the COR for special circumstances. Work which would be disruptive to the daily operations of the facility, such as the testing of annunciation devices, shall be performed after normal working hours.

A. Normal hours of coverage shall be Monday through Friday from 8:00 a.m. to 4:30 p.m., excluding weekends and federal holidays. All service/repairs will be performed during normal hours of coverage unless requested or approved by COR and CO.

B. All work must be scheduled at least one week in advance with the COR. Coordination may be done by telephone.

D. Federal Holidays observed by WTVAHCS are:

VIII. TESTING

The contractor is responsible for obtaining a list of all monitored and testable items directly from the main Fire Alarm Control Panel (FACP) at the beginning of the contract year, and prior to any testing. The contractor shall perform testing & inspections of the fire alarm system with related electronic components, the fire sprinkler system, standpipes, and fire pump.

All testing shall be done in accordance with National Fire Protection Association recommendations, manufacturer’s recommended procedures, and following standards required by The Joint Commission on Accreditation of Healthcare Organizations (TJC).

Testing of audible notification devices shall be conducted with the aid of a decibel meter, and audio levels shall be submitted as part of the testing report.

Testing of all smoke and duct detector devices shall done with the application of artificial smoke.

No system will be left out of service at the end of a workday or over a weekend without written permission from the COR. All switches must be verified as reset prior to the end of each workday.

Contractor will provide daily status updates during testing of devices that do not pass testing/inspection. Upon completion of inspection, contractor will provide a list of deficiencies noted during testing on the final day of testing/inspection. Contractor will provide a complete report of all devices tested within one week of completion of inspection.

Contractor must provide all tools, supplies, equipment, and personnel to perform the work of this contract. Contractor is expected to work independently once oriented, with adequate personnel to accomplish all testing in an efficient manner.

The COR will provide a block diagram of the building listing all stairwells, elevators, and major hallway locations. The COR will also provide an escort, if needed, during the contractor’s first testing quarter to properly orient the contractor with the building layout. During all subsequent testing quarters, the contractor shall be expected to perform testing with minimal assistance.

All testing and inspection shall be conducted in a manner which would present the least amount of disruption to the healthcare facility.

Testing staff will follow VA dress procedures for entering clean areas (operating room suites, Sterile Processing, etc.) prior to entering clean areas. Sterile garments will be provided to testing staff by the VA.

In those cases where contractor is required to verify that alarms operate and transmit alarms to VA main fire panel, the contractor may need to have a person at the building’s fire alarm panel to confirm the signal.

Work dates must be scheduled with the COR.

IX. FIRE ALARM SYSTEM

A. Annual Testing - The contractor shall provide labor, time, materials, and equipment, necessary to perform annual testing and inspection of:

1. Each fire alarm system control panel, all input and all output devices, and batteries.

2. Test, inspection, and operation to be performed on all manual fire alarms pull stations, smoke detectors (including elevator shafts), duct detectors, and heat detectors. Any smoke or heat detector that does not operate properly will be calibrated or replaced from hospital stock and reported to the COR. Before the removal of smoke detectors can begin, advanced notice shall be given to the COR.

3. Testing and inspection of all detectors

4. Inspection of all building alarm notification devices (audible devices, speakers, and visual devices)

5. Inspection and testing of all electro-mechanical releasing devices.

6. Ground fault for fire alarm system.

7. All horizontal & vertical rolling & sliding doors.

8. Emergency service notification transmission equipment.

B. Semi-Annual Testing - The contractor shall provide labor, time, materials, and equipment, necessary to perform semi-annual testing and inspection of:

1. Valve tamper switches and water flow devices

C. Quarterly Testing - The contractor shall provide labor, time, materials, and equipment, necessary to perform quarterly testing and inspection of:

1. Fire alarm equipment for notifying off-site responders.

2. All supervisory signal devices (Done with Fire Sprinkler Inspection). Must be clearly stated on inspection form individually.

X. FIRE SPRINKLER SYSTEM

A. Annual Testing - The contractor shall provide labor, time, materials, and equipment, necessary to perform annual testing and inspection of:

1. Each fire alarm system control panel, all input, and all output devices.

2. All system riser main drains.

3. Fire pump under flow.

B. Semi-Annual Testing - The contractor shall provide labor, time, materials, and equipment, necessary to perform semi-annual testing and inspection of:

1. Test of fire alarm system circuits for proper operation.

2. Fire sprinkler system valve tamper switches and water flow devices (flow and tamper switches are chained and padlocked) in the months indicated on the test schedule. Full water flow testing of each device shall be performed during at least one of the semi-annual tests. Performance and documentation are to be in accordance with the most recent edition of the applicable National Fire Protection Association Standards 25 and 72.

3. Inspection and testing of dry-pipe suppression systems. This testing is to be coordinated with the COR. Performance and documentation is to be in accordance with the most recent edition of the applicable National Fire Protection Association Standards 25 and 72.

4. Inspection and testing of antifreeze-pipe suppression systems. This testing is to be coordinated with the COR. Performance and documentation is to be in accordance with the most recent edition of the applicable National Fire Protection Association Standards 25 and 72.

5. Inspection and testing of kitchen and canteen extinguishing systems. This testing is to be coordinated with the COR. Performance and documentation is to be in accordance with the most recent edition of the applicable National Fire Protection Association Standard 96

C. Quarterly Testing - Contractor to provide labor, time, materials, and equipment to perform inspection and preventive maintenance of:

1. Fire department connections.

2. Performance and documentation are to be in accordance with the most recent edition of the applicable National Fire Protection Association Standards 25 and 72.

D. 5-year Testing - Contractor to provide labor, time, materials, and equipment to perform testing, inspection, and preventive maintenance of:

1. Standpipe Flow Test. Gauges must be changed with a calibrated gauge.

2. Tests and inspections shall be conducted in accordance with current year NFPA 25 standards for the inspection and testing of fire protection systems to comply with Joint Commission Standard EC.02.03.05(12).

3. Contractor shall verify the standpipes and gauges function properly.

4. Contractor shall identify and report any conditions that render the system ineffective during a fire situation.

5. This test only needs to be completed in the last year of the contract.

XI. GENERAL REQUIREMENTS:

1. The contractor shall provide a schedule of all buildings to be tested. The Fire and

Emergency Manager must give prior approval for the shut-down of the fire alarm of each building. Tests must be performed as fast and expertly as possible. No building will have a zone or a complete system shutdown more than one working shift.

2. The contractor shall provide all software updates to the system within the parameters of all the maintenance being done.

3. The contractor will be responsible for all bells, lights, buzzers, switches, batteries, battery chargers, and any equipment associated with the fire alarm system.

4. The contractor shall keep all equipment clean and well ventilated, inspect all system components and note any unusual performance, test-check operation of all the equipment as part of the inspection program and perform minor adjustments as needed at the time of inspection, including any software updates.

5. A record of all repairs, abnormal findings, and results of tests on equipment shall be maintained and turned over to COR.

6. The contractor shall provide the COR with two copies of all inspection reports and emergency repair reports and fire alarm smoke detector test results. Contractor also to notify the COR of any equipment repair ready for final inspection. All testing and repair reports must be provided to the VA within five working days.

XII. WET SYSTEM SPECIFICATIONS:

1. Test of water flow alarms:

All water flow alarm switches will be tested by drawing water through inspector’s test valve.

Record elapsed time (switch retard) for switch activation-alarm initiation-local alarm, to determine if retard setting meeting VA standards (45 seconds from water flow to alarm signal activation).

Verify that alarm signals transmit to Fire Alarm Control Panel (FACP).

2. Test of electric supervisory alarms:

Test all supervisory alarm switches on supply valves, by closing all supervised valves and reopening the valves, verify that all local alarms operate, verify that all alarms transmit to Fire Alarm Control Panel (FACP). Note number of turns of valve stem required to activate the supervisory alarm.

3. Inspect and service all fire department connections:

(i.e., interior, and exterior FDC’s) On all fire department pumper connections, Siamese, etc.

Remove caps; replace any missing/damaged caps. Lube threads, replace gaskets.

4. Inspect and service all main supply valves:

Operate full close and reopen all P.I.V and O.S. and Y. valves on each system. Replace valve stem packing where leaking is evident and lubricate stems. (Rather than replacement of valve stem packing, tightening (but not over-tightening) is acceptable if adequate to stop leaking).

Lubricate all threads and bearings, to assure normal operation.

Re-seal all valves in open position with wire seal where now sealed, re-lock all chains and padlocks where locked. Contractor furnishes wire seals.

5. Inspection and flushing of main drain:

Operate the main drain on each system to dislodge and flush any debris in main riser between supply main and cross mains.

6. Test flow standpipes/hydrants:

Calculate and record GPM flows for each standpipe/hydrant.

7. Test run fire pump as specified in NFPA annual performance test for fire pumps. Record pilot reading, calculate and record GPM flow. As referenced in the most recent edition of

NFPA 20

XIII. DRY SYSTEM SPECIFICATIONS:

1. Trip test of main dry pipe valves:

Trip test each main system riser dry valve by opening inspectors test valve to simulate sprinkler flow.

NOTE: The time (seconds) required from inspection valve open to trip (clapper valve open) and water flow at inspection test valve.

2. Rapid air exhauster test:

Observe the function of the rapid air exhauster during the trip test of the main dry pipe clapper valve, to determine if the air exhauster function is adequate.

3. Water supply valve’s function tests:

Manually operate, fully close, and reopen all O.S. & Y. main valves and P.I. Valves to assure easy normal operation. Repack any leaks in glands. Lubricate stems as necessary, one full closure and open of each valve minimum, for each function test.

4. Test all electric supervisory alarm switches on supply valves:

Concurrent with item 3, assure that all supervisory alarm switches are operating and transmitting to fire alarm system in boiler plant indicating valve closed and valve open as required. Dry pipe system low points are to be drained upon completion of the trip tests.

XIV. ANTIFREEZE LOOP SYSTEM SPECIFICATIONS:

1. Solution testing:

Tests will be made by drawing a sample of the solution from the antifreeze loop at the lowest point within the loop. Solution testing will be conducted on an annual basis. However, if system modifications occur sample test shall be conducted, after modification to verify that appropriate freeze protection is achieved.

6. A hydrometer or refract-o-meter shall be used to measure the specific gravity of the solution drawn from the system thus indicating the level of freeze protection.

XV. STANDPIPES AND FIRE PUMPS:

1. Annual Standpipe Flow Test:

- The contractor will perform the annual standpipe flow test in accordance with NFPA 25.

- This test to be performed in the uppermost or most remote part of each building to determine the flow rate in gallons per minute (gpm) and the residual pressure in pounds per square inch (psi). The flow will be maintained for at least 30 minutes.

- Fire pump controls will be switched off during the first half of the test and on the second half of the test with results recorded for both operations.

- Contractor will provide all tools required including a water diverter funnel and fall protection for standpipes located on the roof.

- Test data will be properly recorded on forms approved by NFPA 25 and signed by the inspector.

2. Annual Fire Pump Full Flow Test:

- The contractor will test each fire pump annually to determine flow rate, pump pressure, pump motor current, voltage, and speed at peak load. All valves in suction line will be checked to assure that they are fully open.

- The flow will be maintained for at least one hour.

- The inspector will record the date, total flow rate, test meter gpm, suction and discharge pressure, number, and size of hose nozzles with corresponding psi and total gpm, pump motor current, voltage and speed, and sign for each fire pump.

- Performance curves will be documented showing pressure at 0%, 100%, and 15Q% flow rate of pump. This graph will be completed In accordance with NFPA 20-11.3 and presented to the COR.

- Simulating a normal power failure with the unit delivering peak power output shall test the automatic power transfer switch. Circulation and/or discharge relief valves shall be checked with the pump churning (no flow), to visually verify that sufficient water is discharging through the valve.

- Alarm indicators shall be checked, and the jockey pump shall be operated. System components within the fire pump room will be tested. Control valves will be opened, closed, and checked to ensure that they seat properly. Gauges will be checked for corrosion and accuracy. Valve position indicating (tamper) switches will be tested and adjusted if necessary.

- A written report will be provided to the VA. In addition to the report, the test points will be charted on a graph providing a performance “curve” for the unit. The curve should be compared to the unadjusted field acceptance test curve and to the most recent previous (if any) test curve. Deficiencies should be reported as soon as possible. A summary of fire pump inspection, testing, and maintenance is contained in NFPA 25, table 5-5.1.

3. 5-year standpipe flow test:

a. Gauge inspection:

Gauges must be changed every five years by comparison with a calibrated gauge.

2. Standpipe Flow Test:

a. A flow test shall be conducted every 5 years on all automatic standpipe systems to verify that the required flow and pressure are available at the hydraulically most remote hose valve outlet(s) while flowing the standpipe system demand.

b. Where a flow test of the hydraulically most remote outlet(s) is not practical, the authority having jurisdiction shall be consulted for the appropriate location for the test.

c. Pressure gauges maintained in accordance with 8.3.3.5.2 shall be provided for the test.

d. Class I and Class III standpipe system demand shall include 500 gpm for the most remote standpipe and 250 gpm for each additional standpipe until the total system demand is simultaneously flowing.

e. The 250-gpm required from each additional Class I and Class III standpipe shall be allowed to be flowed from the most convenient hose valve on that standpipe.

f. Where the 250 gpm cannot be flowed from each additional Class I and Class III standpipe, the authority having jurisdiction shall determine where the additional flow can be taken.

g. Class II standpipe system demand shall include 100 gpm for the most remote standpipe connection.

h. The standpipe system demand shall be based on the design criteria in effect at the time of the installation.

i. Where the standpipe system demand cannot be determined, the authority having jurisdiction shall determine the standpipe system demand.

j. The actual test method(s) and performance criteria shall be discussed in advance with the authority having jurisdiction.

3. Standpipe Hydrostatic Test:

a. Hydrostatic tests of not less than 200 psi pressure for 2 hours, or at 50 psi in excess of the maximum pressure, where maximum pressure is in excess of 150 psi, shall be conducted every 5 years on manual standpipes.

4. Check Valve Inspection:

a. Valves shall be inspected internally every five years to verify that all components operate correctly, move freely, and are in good condition.

5. Internal Inspection of Piping:

a. Except as discussed in 14.2.1.1 and 14.2.1.4, an inspection of piping and branch line conditions shall be conducted every five years by opening a flushing connection at the end of one main and by removing a sprinkler toward the end of one branch line to inspect for the presence of foreign organic and inorganic material.

b. Alternative nondestructive examination methods shall be permitted.

c. Tubercules or slime, if found, shall be tested for indications of microbiologically influenced corrosion (MIC).

d. If the presence of sufficient foreign organic or inorganic material is found to obstruct pipe or sprinklers, an obstruction investigation shall be conducted as described in Section 14.3.

e. Non-metallic pipe shall not be required to be inspected internally.

f. In buildings with multiple wet pipe systems, every other system shall have an internal piping inspection every five years, as described in 14.2.1.

g. If the presence of foreign organic and/or inorganic material is found in any system in a building during the 5-year internal inspection of piping, all systems shall have an internal inspection.

XVI. KITCHEN AND CANTEEN HOOD FIRE SUPPRESSION SYSTEM:

1. The contractor shall provide labor, time, materials, and equipment, necessary to perform semi-annual testing and inspection of kitchen’s hood fire suppression system in accordance with NFPA 96.

2. Extinguishing nozzles: Inspect for buildup and caps are clean and in place.

3. Manual alarm pull station: Ensure system is functioning when pulled.

4. Gas & electrical shut off: Test microswitch and valves to ensure gas and electric shut off when activated.

5. Fusible Link: Test fusible link to see if system activates properly.

XVII. REPORTS AND DOCUMENTATION

1. Inspection Forms:

a. Additional inspection forms can be obtained from the applicable NFPA codes.

Contractor will provide a list of deficiencies noted during testing on the final day of the testing.

b. Upon completion the contractor will provide a complete written report of all devices tested within one week of completion of testing. The report shall identify repairs needed and overall condition of the systems

2. Joint Commission Inspection Requirements:

a. All inspections listed above will be conducted as required by the Joint Commission on

Healthcare Accreditation. Items will be tested and documented at the periodicity indicated.

3. Deliverable:

a. The contractor shall deliver a written hard-copy inspection report, in conjunction with its digital file formatted as both an Adobe PDF and a Microsoft Excel document. This inspection report shall describe the components tested, tests performed, and inspection results. This report shall be detailed based on the Elements of Performance (EP) specified by TJC regarding each device type. All inspection reports shall meet TJC Standard EC.02.03.05, EP 28 and include the following:

• Component being tested

• name of activity

• date of activity

• required frequency of activity

• NFPA standard referenced for activity

• TJC Element of Performance referenced for the activity

• Testing result of the activity

• contact information, including affiliation, of the person who performed the activity (full name, phone number, & email address)

b. Contractor shall provide a hard-copy report of all deficiencies noted during testing on the date of the finding to the COR.

c. In addition to an EP-based report, the contractor shall also provide a spreadsheet database file of all testable items which may be cross-referenced by device number to the EP-based report. All reports & documentation shall be submitted to the COR electronically.

XVIII. UNSCHEDULED MAINTENANCE

1. Contractor shall provide labor, testing, equipment, materials, & parts to provide emergency and general repairs (minor to moderate in nature) for the equipment systems covered under this contract. Contractor shall submit a quote for repairs and must be approved by the COR.

No valves, gauges, or other parts will be replaced and charged to VA without prior written approval by the COR.

2. The contractor shall furnish and replace parts to meet up-time requirements. The contractor has ready access to unique and/or high mortality replacement parts. All parts supplied shall be compatible with existing equipment. The contract shall include all parts and software.

The contractor shall use new parts.

XIX. CONDITION OF EQUIPMENT

1. The contractor accepts responsibility for the equipment described in the schedule "as is" condition. Failure to inspect the equipment prior to contract award shall not relieve the contractor from performance of the requirements of this contract.

IX. REPORT ADDITIONAL SERVICE BEYOND SCOPE

1. The Contractor shall immediately, but not later than 24 consecutive hours after discovery notify the CO and COR, in writing, of the existence or the development of any defects in, or repairs required to the scheduled equipment which the Contractor considers he/she is not responsible for under the terms of the contract. The contractor shall furnish the CO and COR with a written estimate of the cost to make necessary repairs.

2. There will be no additional charge for time spent at the site during, or after the normal hours of coverage awaiting the arrival of additional FSE and/or delivery of parts. Any work deemed necessary by Contractor that does not fall within the scope of this contract must not be performed without approval from the COR.

XX. OFFEROR’S QUALIFICATIONS

1. Contractor must provide proof that the testing team includes at least one member with NICET 1 certification. Any NICET certifications must be submitted to the CO and COR to be kept on file with the VA Contracting Office.

2. Contractor testing team shall include no fewer than 2 qualified individuals.

3. Contractor must also provide proof of at least one NICET 3 certified employee on staff for support of the testing team.

4. Contractor shall furnish information about qualifications, ability to perform the work, and references regarding related experience in health care facilities.

5. Contactor must be able to provide an Original Equipment Manufacturer (OEM) trained and qualified fire alarm service technician, capable of performing programming on an Siemens fire alarm panel, and can be on-site within eight (8) hours of any emergency service call.

6. The offeror is required to submit sufficient evidence of adequate equipment, facilities, personnel, and necessary experience to establish responsibility and integrity to meet the requirements of this contract. Any offeror, who does not have adequate experience, personnel and/or equipment, in the opinion of the Contracting Officer, will be rejected.

To assist in this determination, offeror is required to furnish the following information:

a. Number of years’ experience performing the type of services indicated within.

b. Number of personnel regularly employed on a full-time basis.

c. Quoters are highly encouraged to furnish for past performance refences of three (3) companies for whom similar services (in both size and scope) have been furnished. References must include the point of contact name and email address, company name and physical addresses, telephone number, contract reference number, total contact/project value, performance period, summary of services provided.

d. Provide certification that contractor has manufacturer updated maintenance software, manuals, and parts.

XXI. COMPETENCY OF PERSONNEL SERVICING EQUIPMENT

A. Each respondent shall have an established business, with an office and full-time staff. The staff includes a "fully qualified" FSE and a "fully qualified" FSE who will serve as the backup.

B. “Fully Qualified" is based upon training and on experience in the field. For training, the FSE(s) has successfully completed a formalized manufacturer training programs within the last two years, for the equipment identified in the equipment schedule, and annual refresher course.

For field experience, the FSE(s) has a minimum of two years of experience, with respect to scheduled and unscheduled preventive and remedial maintenance, on equipment listed.

C. The FSEs shall be authorized by the contractor to perform the maintenance services. All work shall be performed by "Fully Qualified" competent FSEs. The contractor shall provide written assurance of the competency of their personnel and a list of credentials of approved FSEs for each make and model the contractor services at the WTVAHCS. The CO may authenticate the training requirements, request training certificates or credentials from the contractor at any time for any personnel who are servicing or installing any WTVAHCS equipment. The CO and/or the COR specifically reserve the right to reject any of the contractor's personnel and refuse them permission to work on the WTVAHCS equipment.

E. Subcontractor will not be used under this contract unless authorized and approved by the

CO.

XXII. TEST EQUIPMENT

Prior to commencement of work on this contract, the contractor shall provide the WTVAHCS with a copy of the current calibration certification of all test equipment which is to be used by the contractor on WTVAHCS equipment. This certification shall also be provided on a periodic basis when requested by the WTVAHCS. Test equipment calibration shall be traceable to a national standard.

XXIII. FAILURE TO PERFORM

If any maintenance or repair service does not meet the requirements outlined herein, WTVAHCS may require the contractor to re-perform the services to conform to the contract requirements at no additional cost.

XXIV. FIRE ALARM TRIP CHARGE

If the contractor trips a fire alarm due to negligence, inattention, or failure to properly coordinate and request fire alarm system shutdown, the contractor will be charged actual costs incurred for VA personnel responding to the alarm. In addition, the contractor will be liable for losses associated with disruption of facility operations, fines, charges, and other costs imposed by the VA or external Fire Departments and any City, County, State, or external agency.

XXV. IDENTIFICATION, PARKING, SMOKING AND VA REGULATIONS

All contractor personnel are required to be aware of and observe security, safety and environmental requirements of the VA facility including, but not limited to, restricted area access, wearing of distinctive clothing bearing the name of the contractor, wearing visible identification issued by the WTVAHCS Police Section at all times while on the premises of the WTVAHCS. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. WTVAHCS will not invalidate or make reimbursement for parking violations of the Contractor under any conditions. Smoking is prohibited inside any buildings at WTVAHCS. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

XXVI. INVOICES AND PAYMENT

Submit the proper documentation and reports to receive payment on this service according to the following instructions:

A. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

B. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

C. The contract shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.

D. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

v. Invoice number, date, and;

vi. Contract and obligation numbers.

XXVII. SECURITY REQUIRMENTS

a. Information System Officer, Information Protection: The contractor will not have access to VA Desktop computers.

b. Privacy Officer: During the services provided to the VA, if removal of equipment from the VA is required, any memory storage device will remain in VA control and will not be removed from VA custody. All research data available for Contractor analysis is de-identified. The contractor, their personnel, and their subcontractors shall be subject to the Federal laws, regulations, standards, and VA Directives and Handbooks regarding information and information system security as delineated in this contract. Consistent with the requirements of 38 U.S.C. 5725, a contract may require access to sensitive personal information. If so, the contractor is liable to VA for liquidated damages in the event of a data breach or privacy incident involving any SPI the contractor/subcontractor processes or maintains under this contract. However, it is the policy of VA to forgo collection of liquidated damages in the event the contractor provides payment of actual damages in an amount determined to be adequate by the agency.

c. Training: Per VA Handbook 6500.6, Contract Security Appendix C, All contractor employees, and subcontractor employees requiring access to VA information and VA information systems shall complete the following before being granted access to VA information and its systems:

(1) Sign and acknowledge (either manually or electronically) understanding of and responsibilities for compliance with the Contractor Rules of Behavior, Appendix E relating to access to VA information and information systems;

(2) Successfully complete the VA Cyber Security Awareness and Rules of Behavior training and annually complete required security training;

(3) Successfully complete the appropriate VA privacy training and annually complete required privacy training; and

(4) Successfully complete any additional cyber security or privacy training, as required for VA personnel with equivalent information system access [to be defined by the VA program official and provided to the contracting officer for inclusion in the solicitation document – e.g., any role-based information security training required in accordance with NIST Special Publication 800-16, Information Technology Security Training Requirements.]

(5) The contractor shall provide to the contracting officer and/or the COR a copy of the training certificates and certification of signing the Contractor Rules of Behavior for each applicable employee within 1 week of the initiation of the contract and annually thereafter, as required.

(6) Failure to complete the mandatory annual training and sign the Rules of Behavior annually, within the timeframe required, is grounds for suspension or termination of all physical or electronic access privileges and removal from work on the contract until such time as the training and documents are complete.

XXVIII. RECORDS MANAGER

a. Citations to pertinent laws, codes, and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228.

b. Contractor shall treat all deliverables under the contract as the property of the U.S.

Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

c. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

d. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

e. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

f. The Government Agency owns the rights to all data/records produced as part of this contract.

g. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

h. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

i. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.

j. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.

XXIX. RECORD RETENTION & STORAGE:

(1) Federal Records related to this policy, regardless of medium, shall be created, maintained, and dispositioned in accordance with the VHA Records Control Schedule (RCS) 10-1, General Records Schedule (GRS) or other NARA-approved records schedule, if applicable.

(2) Federal Records shall be stored per the National Archives & Records Administration (NARA) Facility Standards for Records Storage, as described in 36 Code of Federal Regulations (CFR) 1234
