B.3 STATEMENT OF WORK

Battery Replacement and Preventative Maintenance on the UPS System for Building 222 Temple VA

Requirements

The contractor shall be responsible for providing all labor, materials, and equipment needed for the services to install 240 New Sealed Lead Acid Batteries and perform standard manufacturing preventative maintenance (PM) on the UPS system in Building 222. Services will be performed at the Central Texas Veterans Health Care Facility in Temple, at 1901 Veterans Memorial Drive, Temple, Texas 76504 at IT Building 222 for the UPS system. After all work is completed, the contractor will have a walkthrough with the VA COR or Alternative COR to ensure all work is completed and ready to receive payment.

The contractor shall provide all personnel, services, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish this service. The contractor shall be familiar with all the terms, conditions, and requirement herein contained. All work must comply with federal, state, and local regulations.

The period of performance for this service shall be less than 90 days to complete. This is due to the coordination through nation IT that is required for this service.

Note: It is highly encouraged bidders be present to verify conditions prior to bid in-order to be fully acquainted with existing site conditions and scope of work. The VA will not be responsible for Vendor’s misconceptions of the conditions and requirements of this service.

“The C&A requirements do not apply, and that a Security Accreditation Package is not required for this contract.”

Project Requirements

Base Bid – New Work Specs

1. The contractor shall be responsible for providing all labor, materials, and equipment needed for the performance of this service install batteries and perform full PM maintenance on the UPS system.

2. Contractor must remove and dispose of 240 ea. AT-35P VRLA batteries that are pasted their life cycles. The disposal must meet all EPA and other government Rules and Regulations.

a. Note: Documentation of the Disposal must be supplied to the COR.

3. Contractor must supply and install 240 ea. new AT-35P VRLA Sealed Lead Acid Batteries.

a. Qty 240 – AT-35P VLRA Batteries

4. Contractor must also test voltage after installation to ensure they are holding the correct voltage and provide a report of the battery state to the COR.

5. Factory trained/ Qualified personal must perform the battery replacement.

6. A Factory trained/ Qualified personal must perform a full Preventive service and inspection of the UPS in accordance with the manufactures requirements and the printed report must be supplied to the COR.

7. The Vendor will Provide all Reports to the COR.

New Battery Inspection

1. Inspect new battery for any damages.

2. Prepare new battery for installation.

a. Load test new battery.

b. Prepare posts as needed.

c. Cleaning.

d. No-ox grease (if applicable).

Replacement with Preventative Maintenance Check

1. Disconnect existing battery from charging system.

2. Disconnect and remove existing battery connections and batteries.

3. Install new battery.

4. Re-install battery connections.

a. Correct any corroded or damaged cables/connections.

5. Torque inter-cell/jar and inter-tier terminal connections as necessary per OEM specifications.

6. Connect battery to charging system.

7. Verify/adjust charging system to proper float voltage per OEM battery specification sheet.

8. Complete battery maintenance data sheet.

9. Record as left condition, discuss findings with customer and provide field service report.

Note: At the end of each workday, please clean-up all worked in areas.

1. Contractor will contact VA COR or Alternative COR to develop a schedule for the work of this contract. Due to the use of this UPS the work will need to be performed outside of normal working hours either after hours or on weekend.

2. Coordinate with VA COR before the start of this service and completion. See information below:

A. Government Holidays:

(a) The Government hereby provides notice and Contractor hereby acknowledges receipt that

Government personnel observe the listed days as holidays:

(b) In addition to the days designated as holidays, the Government observes the following days:

a. Any other day designated by Federal Statute

b. Any other day designated by Executive Order

c. Any other day designated by the President’s Proclamation

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

3. Submit the proper documentation and reports to receive payment on this service. See information below:

A. Invoices and Payment

a. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

b. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

c. The contract shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.

d. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

v. Invoice number, date, and; amount partial or full

vi. Contract and obligation numbers.

• A site visit is needed prior to bid to be fully acquaint oneself with existing site conditions and scope of work.

• It is Contractor’s responsibility to field verify all site conditions prior to bidding the job.

• The contractor shall be responsible for the verification of all requirements for this project and all field measurements/conditions that must be verified by the contractor.

• Any discrepancies between field conditions, project documents, and this SOW shall be immediately brought to the Contracting Officer’s attention.

• Contractor must provide own lock for Lockout/Tagout procedures to work on UPS system if need be.

• The removal and installation will be done on the weekend unless other wised noted by the VA

COR. Working hours are Saturday – Sunday from 7:30 am – 4:30 pm.

• This job will be performed after hours and weekends work unless other wised noted by the VA

COR. After working hours is Monday-Friday 5:00 pm to 5:00 am and weekend working hours are Saturday – Sunday from 7:00 am – 3:30 pm.

• All outages must be scheduled and preapproved by VA COR and coordinated with the Building Service Managers.

• Any other days, not address in the SOW, will need to be scheduled with VA COR to work if needed to satisfy this contract.

• The contractor’s supervisor shall always be available to address any needs, the VA COR/Alternative COR may have during the Period of Performance which is 90 days from start to finish.

• The contractor shall be responsible for the removal of project demo materials/debris /equipment from this facility when complete.

• Contractor must perform standard battery testing to ensure the voltage is correct when complete.

“VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors”

COVID-19 Mandated Protocol (Executive Order 14042)

1. Contractor employees who work in or travel to VHA locations must comply with the following:

a. Documentation requirements:

1) If fully vaccinated, shall show proof of vaccination

i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination

2) If unvaccinated and granted a medical or religious exception, shall show negative

COVID-19 test results dated within three calendar days prior to desired entry date.

Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.

3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.

4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to

VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the following website: COVID-19 Screening Tool. Regularly check the website for updates.

a. Contractor employees who work away from VA locations, but who will have direct patient contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.”

• Also, contractor must provide vaccine records for Flu Shot Vaccination per VHA Directive requirements while working in a patient care building.

The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.

The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:

(a) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.

(b) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.

(c) Compliance with EPA and State environmental regulations.

SAFETY REQUIREMENTS

Prior to performing any work, the contractor will be required to submit a safety plan in accordance with OSHA and VA Regulations.

The safety plan shall include, but not limited to the following:

A. Safety and Health Policy (i.e. company policy) B. Safety and Health Objectives (i.e. company goals, procedures, etc.)

C. Job Site Inspections (i.e. safety inspection/potential hazards/prevention, etc.)

D. Contractor Safety Administrator (i.e. competent person/safety officer) E. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)

F. Safety Rules (i.e. rules applicable to the work/task being performed, equipment, ladders, confined spaces, open flame, etc.)

G. Job Safety Training (i.e. OSHA, safety meetings, etc.)

1. The work covered by these specifications are mostly buildings that are occupied some way fashion or form.

2. All work must be coordinated with the VA COR.

3. The contractor shall leave no area unsecured or unsafe at the end of the day.

4. The contractor shall always keep the premises as clean as possible and free from an accumulation of waste materials and rubbish.

5. It shall be the contractor’s responsibility to field verify all existing conditions and dimensions prior to bid.

6. All materials removed shall be disposed of offsite by the contractor.

7. Proper PPE must be worn when working in these conditions.

Codes and Standards The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.

The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:

(a) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.

(b) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.

(c) Compliance with EPA and State environmental regulations.

SAFETY PLAN REQUIREMENTS

Prior to performing any work, the contractor will be required to submit a safety plan in accordance with OSHA and VA Regulations.

The safety plan shall include, but not limited to the following:

A. Safety and Health Policy (i.e. company policy) B. Safety and Health Objectives (i.e. company goals, procedures, etc.)

C. Job Site Inspections (i.e. safety inspection/potential hazards/ mishap prevention, etc.)

D. Contractor Safety Administrator (i.e. competent person/safety officer) E. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)

F. Safety Rules (i.e. rules applicable to the work/task being performed, equipment, ladders, confined spaces, open flame, etc.)

G. Job Safety Training (i.e. OSHA, safety meetings, etc.)

SAFETY INSPECTIONS

On a weekly basis, the VA will conduct a safety inspection of the work area. This inspection includes, but is not limited to the following:

A. Means of Egress

• Fire/Smoke Doors unlocked, free of obstructions.

• Means of Egress (includes Exits) free of obstructions and clearly marked.

B. Housekeeping and Traffic Control

• Trash and debris are removed promptly and transported outside the construction area.

• Floor mats and dust tack mats are located at the entrance to construction area.

• Tools and equipment are properly stored.

• Signs installed to restrict patient access (doors locked as needed).

• Dust control measures are in place.

• Barriers are in place and properly sealed.

C. Clothing

• PPE is available and properly worn.

• Clothing is relatively dust free with the construction area and patient areas.

Warranty Period

• Contractor must provide one (1) year warranty on parts and labor.

• Warranty period does not start until VA COR signs off on the project.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.4 52.223-99 ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR

FEDERAL CONTRACTORS (OCT 2021) (DEVIATION)

(a) Definition. As used in this clause—

United States or its outlying areas means—

(1) The fifty States;

(2) The District of Columbia;

(3) The commonwealths of Puerto Rico and the Northern Mariana Islands;

(4) The territories of American Samoa, Guam, and the United States Virgin Islands; and

(5) The minor outlying islands of Baker Island, Howland Island, Jarvis Island, Johnston Atoll, Kingman Reef, Midway Islands, Navassa Island, Palmyra Atoll, and Wake Atoll.

(b) Authority. This clause implements Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors, dated September 9, 2021 (published in the Federal Register on September 14, 2021, 86 FR 50985).

(c) Compliance. The Contractor shall comply with all guidance, including guidance conveyed through Frequently Asked Questions, as amended during the performance of this contract, for contractor or subcontractor workplace locations published by the Safer Federal Workforce Task Force (Task Force Guidance) at https:/www.saferfederalworkforce.gov/contractors/.

(d) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts at any tier that exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the date of subcontract award, and are for services, including construction, performed in whole or in part within the United States or its outlying areas.
