About this file
This document is a Sole-Source Determination for Supplies and Services memo from the Oregon Youth Authority (OYA) regarding the acquisition of a low-code application platform licensing and support from Impact Networking, LLC (a Mendix partner). OYA previously conducted a Request for Quotes (RFQ) to acquire a low-code application platform, which resulted in a contract with Mendix. OYA's Human Resources department had an immediate need to modernize and automate their Employee Action documentation process, and worked with Mendix to develop a new application. Due to the significant hurdles involved with changing to a different low-code platform, such as user training, data migration, and loss of customization, OYA has determined that it is necessary to continue licensing and support from Impact Networking, LLC (Mendix partner) in order to maintain compatibility with the existing applications in use.
The estimated total value of the contract is $48,312.00 for 3 years, with an option to extend as needed not to exceed $250,000.00. OYA has an existing contract with Mendix that runs through June 24, 2024, and needs to renew the licensing and support services with Impact Networking, LLC in order to maintain compatibility with the existing products, services, systems, and applications.

SOLE-SOURCE DETERMINATION FOR SUPPLIES AND SERVICES

Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275
Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
Estimated Total Value of Contract: $48,312.00 (3 years) – Option to extend as needed not to exceed $250,00.00.
Subject of Contract: Impact Networking, LLC (Mendix Partner): Low-code application platform licensing and support.
Background:
OYA previously conducted a Request for Quotes (“RFQ”) to acquire low-code application platform software and support. The result of the RFQ produced a contract with Mendix. OYA’s Human Resources Department (“HR”) had an immediate need to modernize and automate their current Employee Action documentation process by developing an application, in-house, to replace the current paper-driven process. OYA developers worked with Mendix to create a new Employee Action Application capable of tracking employee demographics and information, assigned HR staff, HR staff effort, the cause(s) of the action, and action(s) taken.
Findings:
Major hurdles involved with changing existing low-code platform to another low-code platform:
• OYA employees and end users will need to learn and adopt new low-code platform which requires a significant amount of testing.
• New low-code platform requires re-implementation and there is no direct upgrade or migration path. Software Contractors don’t provide access to their underlying code for such migration.
• Transferring data models and proprietary components between low-code platforms is not feasible.
• Existing workflows and business logic will need to be re-designed for any new low-code platform.
• Training users on a new low-code platform is time-consuming and costly.
• New low-code platform may not support the same level of customization or flexibility as current low-code platform in use. This requires a significant amount of analysis and proof of concept.
• New low-code platform may have its own vendor lock-in issues, limiting future flexibility.
Market Research Overall finding.

Pursuant to ORS 279B.075 (2)(a): Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
OYA needs to continue licensing and support from Impact Networking, LLC (Mendix Partner) in order to support applications currently in use by HR staff and OYA employees. OYA employee training costs, OYA development team application construction and programming time, and onboarding to procure a new low-code platform application would not be efficient or feasible.
Pursuant to ORS 279B.075 (2)(b): Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.

Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source.
OYA has an existing contract in place with Mendix for licensing and support that runs through 6/24/24. In order to maintain compatibility with existing products, services, systems, and applications OYA needs to renew licensing and support services with Impact Networking, LLC (Mendix Partner).
