2. GENERAL OVERVIEW
2.1 Introduction and Authority
The City of Riviera Beach ("City"), the Utility Special District (“USD”), and the City of Riviera Beach Community Redevelopment Agency (‘CRA”) is issuing this Request for Qualifications (RFQ) under its general procurement authority, Chapter 16.5, City Code of Ordinances, to establish a Prequalified Pool of qualified and licensed electrical contractors capable of providing electrical services on an as-needed, non-exclusive basis. This is a qualifications-based solicitation and is not issued under the Consultants' Competitive Negotiation Act, § 287.055, Florida Statutes.
Admission to the pool prequalifies a firm for consideration only; it does not guarantee contract award or work assignment. Individual projects will not exceed $100,000. Task Orders will be issued to Pool Members as needs arise, in accordance with the Task Order process, and the City reserves the right to solicit services from Pool Members based on project availability, scope complexity, contractor capacity, and geographic location.
The contract term commences October 1, 2026, and ends September 30, 2031,
2.2 Award Criteria
The City intends to award up to a maximum of five (5) highest ranked responsive and responsible proposers meeting the minimum qualifications of experience, competency, and capability.
2.3 Pricing & Compensation
Pricing shall not be included in any Statement of Qualifications. Cost and compensation are addressed exclusively at the Task Order stage, not during the prequalification process.
2.4 Questions and Clarifications
All questions must be submitted in writing through BidNet Direct by the Questions Deadline on the cover sheet.
2.5 Addenda and Interpretations
The City reserves the right to amend this solicitation prior to the deadline. Only written addenda from the Procurement Department are binding.
2.6 Authorized Signatories
All forms and the Statement of Qualifications must be executed by an individual authorized to legally bind the Respondent. Electronic signatures are accepted per § 668.50, Fla. Stat. Submissions without a valid authorized signature will be deemed non-responsive.
2.7 Acceptance / Minor Irregularities
The City reserves the right, at its sole discretion, to: accept or reject any or all submissions; waive minor irregularities not affecting material substance; cancel or re-issue this solicitation; and establish a pool with fewer or more firms than indicated. Issuance of this RFQ creates no obligation to establish a pool, award a contract, or reimburse any costs incurred in preparing a submission.
2.8 Required Licensing and Certifications
To be deemed responsive and responsible, each Respondent must hold all current, valid licenses, certifications, and registrations required by law to perform the services described in the scope of services:
• Active registration to transact business in Florida, evidenced by a Certificate of Good Standing from the Florida Department of State, Division of Corporations [§§ 607.1501 / 620.1902, Fla.
Stat., as applicable]
• Current, valid Florida Electrical Contractor License (DBPR) in good standing
• A current City of Riviera Beach Local Business Tax Receipt, if maintaining a business address within the City [§ 205.033, Fla. Stat.]
Proof of all required licenses and certifications must be included in the submission. Failure to provide required documentation will result in a non-responsive determination.
2.9 Mandatory Requirements
As specified with each mandatory question posted in the BidNet solicitation tool, the vendor must indicate whether it meets each individual requirement by marking either "YES" or "NO" in the response field provided. A Pass/Fail evaluation will be utilized for all mandatory requirements.
Ordinarily, to be considered responsive, responsible, and eligible for award, all questions identified as mandatory must be marked "YES" to pass. There may be rare instances in which a response of "NO" is the correct and logical response in order to satisfy the mandatory requirement (e.g., responding "NO" to confirm the vendor does not possess any conflicts of interest). Except in such instances, any mandatory question marked "NO," or any mandatory question left unanswered, will fail the requirement and result in the proposal being deemed non-responsive and disqualified from further consideration.
2.10 Exceptions to Draft Contract
Any exceptions, deviations, or proposed modifications to the terms and conditions of the draft contract/agreement included in this solicitation must be clearly identified, in writing, and submitted as part of the Respondent's response by the solicitation submission deadline. Exceptions must reference the specific section, paragraph, and page number of the draft contract to which they apply, and must state the proposed alternative language.
The City will consider only those exceptions submitted with the response. Exceptions, objections, or requested changes to the draft contract submitted after the solicitation closing date and time will not be considered and will render the vendor's response non-responsive. Silence on any provision of the draft contract shall be construed as the Respondent's acceptance of that provision as written.
The City reserves the right to reject any or all exceptions, to negotiate resolution of any exceptions with the apparent successful Respondent, or to deem a response non-responsive based on the nature or extent of the exceptions taken.
2.11 E-VERIFY
Each Party warrants and represents that it is in compliance with section 448.095, Florida Statutes, as may be amended, and that it: (1) is registered with the E-Verify System (E-Verify.gov), and uses the E-Verify System to electronically verify the employment eligibility of all newly hired workers;
and (2) has verified that all of the Party’s Consultants and subconsultants performing the duties and obligations of this AGREEMENT are registered with the E-Verify System, and use the E-Verify System to electronically verify the employment eligibility of all newly hired workers.
CITY shall obtain from each of its contractors and subcontractors an affidavit stating that each contractor and subcontractor does not employ, contract with, or subcontract with an Unauthorized Alien, as that term is defined in section 448.095(1)(k), Florida Statutes, as may be amended. CITY shall maintain a copy of any such affidavit from contractors and subcontractors for, at a minimum, the duration of the subcontract and any extension thereof. This provision shall not supersede any provision of this AGREEMENT which requires a longer retention period.
Failure to comply with the requirements set forth herein will result in rejection of the Offer as non-responsive, or in a determination that the Offeror is not responsible.
3. POOL STRUCTURE, TERM, AND TASK ORDER PROCESS
Upon completion of the evaluation process and approval by the appropriate authority, the City will establish a Prequalified Pool.
3.1 Pool Structure
The pool is a standing resource, not a contract. Pool membership authorizes a firm to receive Task Orders; it does not obligate the City to issue any Task Order or guarantee any volume of work.
3.2 No Guarantee of Work
Admission to the Prequalified Pool does NOT guarantee any Task Order, and does NOT create any entitlement to compensation. The City retains sole discretion to issue, withhold, or cancel any Task Order at any time.
3.3 Pool Term & Removal
The pool roster shall be active for the term stated on the cover sheet, commencing on the date of approval by the City ("Pool Term"). Individual Task Order Contracts executed before Pool Term expiration may extend beyond it.
A firm may be removed from the pool for: (1) failure to maintain required license, certification, or insurance; (2) placement on the Convicted Vendor List; (3) material misrepresentation; (4) repeated failure to respond to Task Order solicitations without good cause; (5) material breach of a Pool Acceptance Agreement or Task Order Contract; or (6) voluntary withdrawal.
Removal from the pool does not automatically terminate any active Task Order Contract.
3.4 Task Order Spending Cap
To promote equity, the Procurement Director shall rotate solicitations among Pool Members and track cumulative awards per fiscal year. Each Pool Member may receive up to $100,000 in cumulative Task Order awards annually (October 1 – September 30). Vendors reaching this threshold shall not receive new solicitations unless: (a) all other Pool Members have also reached their caps, or (b) the vendor possesses unique qualifications for the specific project, documented by the Procurement Director.
3.5 TASK ORDER PROCESS & PRICING NEGOTIATION
3.5.1 Work Issuance
• Each Task Order will specify scope, location, schedule, and performance requirements
• Contractors must respond to Task Order inquiries within specified timeframes (typically
24–48 hours)
• City reserves the right to select multiple contractors for the same project or consolidate work among prequalified firms
Failure to response to three (3) consecutive Task Order requests without good cause may result in suspension or removal from the pool.
3.5.2 Pricing at Task Order Stage
• Labor rates, fees, and material pricing will be requested and negotiated for each Task Order
• Pricing may vary by project scope, complexity, and urgency
• Rates reflect conditions only at the time provided and are not binding for the duration of the Pool Term
• A Pool Member is not obligated to honor a previously referenced rate for Task Orders issued in later years of the Pool Term
3.5.3 Performance Evaluations and Pool Standing
The City may evaluate contractor performance following completion of each Task Order and may consider those evaluations when issuing future Task Orders. Non-performance on a Task Order, failure to submit timely quotes, or repeated failure to meet response times or quality standards may result in removal from the prequalified pool. Compensation shall be determined and issued at the Task Order level.
Compensation for each Task Order will be negotiated or competed at the Task Order stage, not during the prequalification process. The City will not pay any Pool Member for time spent reviewing Task Order solicitations or preparing Task Order proposals. Rate schedules submitted with a Statement of Qualifications are for reference only and do not bind the City to any rate. Because the Pool Term spans multiple years, the City will confirm the currency and reasonableness of proposed rates at the time each Task Order is issued rather than relying on rates referenced at any earlier stage of the Pool Term.
