1. The vendor shall procure the commercial off-the-shelf (COTS) products specified in Appendix I – Bill of Materials
(BOM).
2. All equipment shall be professional grade and rated for continuous duty. Basic guidelines have been prepared with manufacturer names, makes, and model numbers included as minimum performance requirements. These shall be satisfied, unless a variance (separate document) is submitted and approved by the COR.
3. Electronic component models shall be commercially available for at least one year prior to offer, or be approved by the COR.
4. All equipment and material shall be new – original equipment manufacturer (OEM).
5. No used equipment, hardware, fasteners, accessories, wire, cabling, connectors, or active components may be used, at any time.
6. All like components shall be from the same manufacturer for usability.
7. All indicated “no substitution” equipment on the BOM shall be provided by the vendor and cannot be substituted.
8. Any proposed equipment substitutions to allowable items specified on the BOM shall be equal, or greater in terms of features, performance, function, capacity, reliability, form, and warranty. They must also be comparable in price. These items shall be commercial-grade and rated for continuous usage. The Government may request the manufacturer’s original specifications tests. The COR will evaluate and approve all substitutions.
9. In compliance with Executive Order 13123, the vendor shall offer equipment that is EPEAT-registered (http://www.epeat.net), and ENERGY STAR® certified or other energy-efficient products listed on the Department of Energy Federal Energy Management (FEMP) Product Energy Efficiency Recommendations product list, whenever available.
10. The vendor shall provide equipment that, where required, shall conform to the applicable requirements of the Underwriters Laboratories, Inc., local codes, the National Electrical Code and any other governing codes. Such items shall bear a label or mark indicating their conformance to the above requirements.
11. Electronic and information technology (EIT) procured through this effort will meet the applicable accessibility standards at 36 CFR 1194. 36 CFR 1194 implements Section 508 of the Rehabilitation Act of 1973, as amended, and is viewable at http://www.section508.gov.
12. The vendor shall obtain and convey appropriate warranties and data rights on the acquired COTS products to be delivered to the NIAID. Data rights shall permit the NIAID to make unlimited copies of all documentation.
13. The vendor shall provide an initial set of technical information, manuals, instruction books, and training support materials available from the COTS product vendors for each product. The contractor shall ensure such documents are free of encumbrances that would prohibit their reproduction or use by the NIAID for training and site operational purposes.
14. The vendor shall identify and report all license, copyright, and proprietary restrictions that affect the NIAID’s ability to maintain the COTS products.
