The total maximum points are 1,000, and the bidder with the closest score to 1,000 will be the apparent contract award winner. Bidders must provide six hard paper copies of their technical qualifications (one marked "Original" and five marked "Copy") and one hard paper copy of the cost proposal. EVALUATION METHODOLOGY

Technical Qualifications & Proposal Response: Bidders must answer all questions found on Exhibit G – Scored Questions, which are weighted and will be scored by the County’s evaluation committee. The County’s evaluation committee will score and assign point values to the answers.

The total maximum points are set at 1,000. The County has assigned a 70%/30% split for scoring points: seven hundred (700) points (70%) available for technical qualifications and three hundred

(300) points (30%) available for the cost proposal. The Bidder with the highest total point score closest to 1,000 will be the apparent contract award winner.

Unanswered questions will earn a 0-point score. The Bidder’s response should limit answers directly to the questions asked. Each answer will be scored on a scale of twenty-five (25) percentage points:

https://www.hallcounty.org/Bids.aspx

Excellent = 100% Good = 75% Adequate = 50% Marginal = 25% Poor = 0%

In addition to the space provided on Exhibit G – Scored Questions, Bidders may expand their answers to the questions onto separate pages if needed, with the question repeated at the top of each page. Bidder’s may input “see attached” in the space provided next to each question.

Responses to the questions should be clear and concise. Where appropriate, Bidders should show statistical information in a tabular chart format, and textual information in bullet point form.

Summarize key points at the beginning of each answer. All quantitative material should include complete assumptions and be supported by detailed schedules evidencing all calculations and results.

Provide one-sided documents only. Do not include superfluous marketing brochures nor unnecessary promotional materials. These will not be evaluated. Address each specific question with direct, detailed answers.

Bidder Response:

Technical Qualifications: Each bidder must provide six (6) hard paper copies, with one (1) marked “Original” and five (5) marked “Copy” of their technical qualifications response. Submit all six (6) hard paper copies in a sealed envelope(s), separate from the cost proposal.

Cost Proposal: Bidders are to submit one (1) hard paper copy of the Exhibit C – Cost Proposal Worksheet.

Combined Digital Response: Bidders must provide their responses on one (1) USB drive with two (2) folders therein, one entitled “Technical Qualifications Response”, containing the technical response, and one (1) entitled “Cost Proposal”. Do not include the cost proposal in the technical response folder as this may cause your proposal to be rejected.

Evaluation and Selection: The County will evaluate all submittals in accordance with the Official Code of Hall County, Georgia 3.10, and as further detailed herein. The County will evaluate proposals using a two-step process. The first step is the “Technical Qualifications Proposal” that outlines the bidding firm’s qualifications, experience, and its approach to deliver the services. The second step is the “Cost Proposal” whereby the evaluation committee will evaluate the proposed cost for the Services to determine the best value for the County.

Cost Evaluation: This solicitation is heavily focused on a firm’s qualifications, experience, and capabilities. Therefore, award may not be made solely based on the lowest cost bid. Cost will be given more importance when all the other evaluation criteria are relatively equal.

The County may deem an unreasonably low cost, and the highest cost, as materially unbalanced.

In such cases then the County reserves the right to reject the proposals.

Cost is not the only consideration for award. If, in the County’s sole discretion, qualifications between two (2) or more Bidders are equal, then the County may make an award to the lowest cost Bidder among them. The County will evaluate cost as presented on Exhibit C – Cost Proposal Worksheet. The cost is weighted and will be scored by the evaluation committee. A lower cost will receive a higher score. Any and all fees should be detailed in the bid response.

Validation: Hall County requires that Bidders provide a cover letter with a signature by an officer of the firm with the submittal to ensure its originality.

Bid Retention: The County reserves the right to retain all proposals submitted and use any idea(s) in a proposal regardless of contract award or not. The County shall have the right to waive any informality or irregularity of immaterial deviation, omissions, and clerical errors in any bid received.

Mandatory Documents: Bidders must complete and return all exhibits and any addenda with their bid proposals. Failure to do so may deem a proposal as non-responsive and the County may not evaluate it for award.

Award Process: The County will not make an award of contract solely based on lowest cost bid, but on approach, references, qualifications, and other subjective criteria as the County may deem necessary and determine at its sole discretion.

Non-Collusion Requirement (Cone-of-Silence): Bidders must not have contact of any nature with other Bidders, County staff members, elected officials, nor County Commissioners during the RFQ/P evaluation process. The County may deem such as collusion and thus render the submission in violation of the Official Code of Hall County, and therefore the County may deem the proposal as non-responsible and not evaluate the proposal for an award.

By submitting a proposal, the Bidder represents and warrants that no official or employee of Hall County Government has, in any manner, an interest, directly or indirectly in the proposal or in the contract which may be made under it, or in any expected profits to arise there from.

Open Records: All documents, communication, and proposals fall under the Georgia Open Records Act and are subject to disclosure to an open records request by emailing orr_financialservices@hallcounty.org.

Taxes: Hall County, Georgia, is exempt from State of Georgia Sales and Use Tax. A Certificate of Exemption will be made available upon request to the awarded firm.

Bid Bond: A bid bond is not required for this solicitation; however, all Bidders must include in their bid submissions a letter of bondability. The County will only accept surety companies licensed to do business in the State of Georgia.

Performance and Payment Bonds: The awarded Contractor must furnish both a Performance and Payment bond, each equal to one hundred percent (100%) of the total amount of the initial year’s contract award amount. The County will only issue a Notice to Proceed after the bonds are received. The County will only accept surety companies licensed to do business in the State of Georgia. The Contractor must provide all required bonding instruments to the County prior to the commencement of any work. The County will consider any work done prior to the receipt of bonding instruments as null and void and thus not eligible for compensation.

It is a contractual provision allocating the risk of loss if performance becomes impossible or impracticable, especially as a result of an event that the Parties could not have anticipated or controlled.”

B. Obligations Beyond Contract Term. The Contract shall remain in full force and effect to the end of the specified term or until terminated or canceled pursuant to ARTICLE #108 –

TERMINATION PROVISIONS.

C. Transition Cooperation with the County and Cooperation with Other Contractors.

Contractor agrees that upon termination of this Contract for any reason, it shall provide sufficient efforts and reasonable cooperation and assistance to the County to ensure an orderly and efficient transition to the County or an alternative Contractor. Further, if the County has entered into or enters into contracts with other Contractors related to the Services, Contractor agrees to cooperate fully with other such Contractors. 2. The County determines that Contractor’s unsatisfactory performance substantially endangers completion or that default is likely to occur.

3. The Contractor fails to make substantial and timely progress toward performance of the Contract.

4. The Contractor becomes subject to any bankruptcy or insolvency proceeding under federal or state law to the extent allowed by applicable federal or state law including bankruptcy laws; the Contractor terminates or suspends its business; or the County reasonably believes that the Contractor has become insolvent or unable to pay its obligations as they accrue consistent with applicable federal or state law.

5. The Contractor has failed to comply with applicable federal, state, and local laws, rules, County ordinances, regulations, and orders when performing within the scope of the Contract.

6. The Contractor has engaged in conduct that has or may expose the County or the State to liability, as determined in the County’s sole discretion; or a material breach of the terms of the Contract by County upon County’s failure to cure such material breach after written notice thereof has been delivered in accordance with ARTICLE #108.C below constitutes cause for the Contractor to declare that the County is in default of its obligations under the Contract.

C. Notice of Default. If either Party causes any of the default events set out in ARTICLE #108

– TERMINATION PROVISIONS, then either Party shall issue a written Notice of Default to the Party that causes one (1) or more of the default events requesting that the breach or noncompliance be remedied within the period of time specified in the Notice of Default.
