Prospective Offerors shall identify the Statement of Work Section and Paragraph to which their question applies. All questions will be answered and submitted thru FedBizOpps by posting an amendment. Any questions received after August 31, 2016 shall not be answered.

7. PROVISIONS AND CLAUSES: The provisions and clauses in the RFQ are those in effect through Federal Acquisition Circular (FAC) 2005-89, effective 14 July 2016.

Offerors shall provide information required by FAR 52.212-1 (Oct 2015), Instructions to Offerors-Commercial Items, which is incorporated by reference.

FAR 52.212-2 (Oct 2014), Evaluation Commercial Items: Selection and award will be made to the lowest priced, technically acceptable (LPTA) Offeror. In order to be found technically acceptable the Offeror must meet the following: 1) Meet technical criteria identified in the RFQ. Technical acceptability will be determined by a review of information submitted by the offeror which must provide a description in sufficient detail to show that the product offered meets the Government's requirement.

FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (July 2016). Please ensure your business is registered electronically via the System for Award Management (SAM) Website located at https://www.sam.gov/portal and all information is entered or updated to include your business size for NAICS 332994 for small arms nonmanufacturer suppliers, if applicable.

FAR 52.212-4 (May 2015), Contract Terms and Conditions-Commercial Items is applicable, which is incorporated by reference.

9.0 STATEMENT OF WORK

9.1 General

The Executive Office for Immigration Review (EOIR), U.S. Department of Justice (USDOJ) has the primary mission to adjudicate immigration cases by fairly, expeditiously, and uniformly interpret and administer the Nation’s Immigration Laws by conducting immigration court proceedings, appellate reviews, and administering hearings. Within EOIR is the Office of Security whose mission is to provide security measures for the agency. Part of the Division’s mission is to provide support to the members of the Emergency Response Group in support of Continuity of Operations Program (COOP) and Occupant Emergency Plans (OEP) interoperability and sustainment of operations in the event of an emergency or disaster.

The National Continuity Policy Implementation Plan (NCPIP) and the National Security Presidential Directive-51/Homeland Security Presidential Directive-20 (NSPD- 51/HSPD-20) is guidance for individual executive departments and agencies to ensure that Government Agencies’ Primary Mission Essential Functions (PMEFs) continue to be performed during a wide range of emergencies, including localized acts of nature, accidents and technological or attack-related emergencies.

9.2 Personal Evacuation Kits

In order to carry out the Agency’s mission to be prepared in the event an actual COOP or OEP is activated, the Agency requires the procurement of 2,114 Personal Evacuation Kits (PEK). These kits are for each employee of the Agency to enhance the employee’s ability to perform their normal duties in such events.

9.2.1 Criteria – Each kit must contain the following items:

• Nylon Orange Pouch w/deployable shoulder strap and reflective strip, no embroidery – Qty of 1

• Full Face ReadiMask (must have the current shelf life to allow for 5 years)– Qty of 1

• Half Face ReadiMask (must have the current shelf life to allow for 5 years) – Qty of 1

• 12 hour White (vs. green) Chem sticks – Qty of 2

• High Intensity Whistle – Qty of 1

• Packet of Purified Drinking Water – Qty of 1 (must have the current shelf life to allow for 5 years)

• Thermal Blanket – Qty of 1

• 42pc. First Aid Kit – Qty of 1

• Non-Latex Gloves – Qty of 1 Pair

• Rain Poncho – Qty of 1

• Must have space to include items listed plus room for an individual to carry his/her medication and glasses.

The remainder of the PEK kits shall be shipped to the courts in order of descending quantities from highest to lowest.

The vendor shall notify the appropriate Court Administrator (listed above) by e-mail as well as the following personnel:

Deliveries are between the hours of 8:00 am and 4:30 pm, Monday thru Friday. After hours, weekends, and holiday deliveries will not be available.

10. Award – The Government intends to award a Lowest Price/Technically Acceptable (LPTA) contract.

11. Evaluation – Evaluation shall be based on the technical factor rating and price will be evaluated on price reasonableness.

FACTOR 1 – Technical

The technical factor is based on the Offeror’s ability to:

• Provide the items described in Paragraph 9.2.1;

• Provide the Full and Half Face ReadiMasks;

• Meet the requirement for shelf life.
