452.216-73 Minimum and Maximum Contract Amounts (FEB 1988)
During the period specified in FAR Clause 52.216-18 ORDERING, the Government shall place orders totaling a minimum of $500 but not in excess of $75,000.
SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
SCOPE OF CONTRACT
This contract requires indefinite quantities of temporary services and related work in compliance with the terms, specifications, and provisions included herein. This includes furnishing labor on a temporary basis, which usually consists of clerical workers or furniture movers.
LOCATION AND DESCRIPTION
Temporary services will be required at various locations on the Apache-Sitgreaves National Forests and may include the Supervisor’s Office and Springerville Ranger District in Springerville, Arizona (Apache County); Alpine Ranger District in Alpine, Arizona (Apache County); Lakeside Ranger District in Lakeside, Arizona (Navajo County); and Black Mesa Ranger District in Overgaard, Arizona (Navajo County); and Clifton Ranger District in Duncan, Arizona (Greenlee County).
RECRUITMENT
The successful offerors will recruit personnel from the local areas so that temporary positions can be filled within a one-hour notice on an emergency basis. The temporary services companies will work with the Point of Contact (POC) on the respective Ranger District or Supervisor’s Office for the names and contacts of local newspapers or advertising fliers. The Government shall provide a list of individuals known to be interested in performing temporary work for the Forest Service to the awarded contractors.
The awarded temporary services agencies shall contact any individual referred to the company and who submits an application to advise them on the successful receipt of the application. Once an individual is added to the company’s payroll, the company shall be responsible to give a new-employee orientation, either by phone or in writing, outlining the company’s policies on submittal of time sheets, pay dates, methods of reimbursement, and any other information useful to a new employee.
The awarded contractors will provide an updated listing of available individuals and their phone numbers to the Contracting Officer whenever an employee is added to or removed from the list.
TECHNICAL SPECIFICATIONS
Temporary services are required on an indefinite basis and may be for as little as four hours or as much as a few months. Temporary services are usually required on short notice when a full-time employee is ill. A few days advance notice can be given when an employee attends training or is planning annual leave. Occasionally a need arises for temporary services for a special project ranging from a few days to a month or two. These are usually large copy jobs or special mailings.
If a project requires the individual to have a Forest Service computer profile, a background investigation may be required. In this case, the temporary services agency will be responsible to reimburse the individual employee for the cost of fingerprinting at a local law enforcement office. The Forest Service will bear the cost of the background investigation.
TASK ORDERS
Work shall be requested by issuing a Task Order from the Contracting office of the Supervisor’s Office for an estimated number of hours. Once the individual project is complete, any excess funds may be de-obligated and the task order closed. Orders may be placed verbally by the following personnel; however, a written Task Order shall be issued immediately following any verbal orders and shall be faxed to the awarded contractor(s):

(d) The contract price, contract unit price labor rates, or fixed hourly labor rates will be adjusted to reflect the Contractor's actual increase or decrease in applicable wages and fringe benefits to the extent that the increase is made to comply with or the decrease is voluntarily made by the Contractor as a result of:
(1) The Department of Labor wage determination applicable on the anniversary date of the multiple year contract, or at the beginning of the renewal option period. For example, the prior year wage determination required a minimum wage rate of $4.00 per hour. The Contractor chose to pay $4.10. The new wage determination increases the minimum rate to $4.50 per hour. Even if the Contractor voluntarily increases the rate to $4.75 per hour, the allowable price adjustment is $.40 per hour;
(2) An increased or decreased wage determination otherwise applied to the contract by operation of law; or
(3) An amendment to the Fair Labor Standards Act of 1938 that is enacted after award of this contract, affects the minimum wage, and becomes applicable to this contract under law.
(e) Any adjustment will be limited to increases or decreases in wages and fringe benefits as described in paragraph (d) of this clause, and the accompanying increases or decreases in social security and unemployment taxes and workers' compensation insurance, but shall not otherwise include any amount for general and administrative costs, overhead, or profit.
(f) The Contractor shall notify the Contracting Officer of any increase claimed under this clause within 30 days after receiving a new wage determination unless this notification period is extended in writing by the Contracting Officer. The Contractor shall promptly notify the Contracting Officer of any decrease under this clause, but nothing in the clause shall preclude the Government from asserting a claim within the period permitted by law. The notice shall contain a statement of the amount claimed and the change in fixed hourly rates (if this is a time-and-materials or labor-hour contract), and any relevant supporting data, including payroll records, that the Contracting Officer may reasonably require. Upon agreement of the parties, the contract price, contract unit price labor rates, or fixed hourly rates shall be modified in writing. The Contractor shall continue performance pending agreement on or determination of any such adjustment and its effective date.
(g) The Contracting Officer or an authorized representative shall have access to and the right to examine any directly pertinent books, documents, papers and records of the Contractor until the expiration of 3 years after final payment under the contract.

Solicitation Provisions
52.212-1 Instructions to Offerors - Commercial Items. (JUN 2008)
52.212-2 Evaluation - Commercial Items. (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
| Price—the offeror shall provide their best price to the Government. |
| Past performance—offerors shall provide a list of references for all similar contracts from the past three years. At a minimum, vendor shall provide a contact name, phone number, and e-mail address. If the work was under a Government contract, provide the Contract Number and a brief description of the requirements. Companies without past performance information will received a neutral rating for purposes of evaluation. |
Technical Ability—offerors shall provide their standard company statement of qualifications along with their price quotes.
Technical and past performance, when combined, are approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
