LIMITED SOURCE JUSTIFICATION & APPROVAL (J&A)
FEDERAL ACQUISITION REGULATION (FAR) PART 8 ACQUISITIONS
Multiple Award Schedule (MAS)/Multiple Award Contract Orders under MAS/General Services Administration Schedules (GSA)/Federal Supply Schedules
(FSS) FAR 8.405-6
Purchase Request Number: CSS0087 Contract Number: To Be Determined (TBD) Task/Delivery Order Number: TBD Procurement Title: E-6B Airborne Communication Services Estimated Value:
Limited Source Authority: FAR 8.405-6(a)(1)(i)(B)
LIMITED SOURCE JUSTIFICATION
J&A Number: JA19-012
Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve this limited source justification in accordance with (IAW) FAR 8.405- 6(a)(1)(i)(B). The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program.
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
(a) Requesting Agency: Strategic Communications Wing ONE (SCW-1) 7641 Mercury Road Tinker Air Force Base, Oklahoma 73145
(b) Contracting Activity: DISA/Defense Information Technology Contracting Organization (DITCO)/PL8221 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225
2. NATURE/DESCRIPTION OF ACTION(S):
This action is to establish a Firm Fixed Price (FFP) task order against General Service Administration (GSA) Information Technology (IT) Schedule 70 Special Item Number (SIN) 132-55 for E-6B aircraft airborne global operations in support of all E-6B “Take Charge and Move Out” (TACAMO) and Airborne Command Post (ABNCP) mission requirements.
Commercial communication services are required for up to sixteen E-6B aircraft for global operations. The period of performance for the current bridge contract expires December 17, 2018. This follow-on effort will provide the required services beyond December 17, 2018. The E-6B Airborne Communication Services Contract effort actively supports mission tasking requirements as part of the Senior Leader Command, Control and Communications System – Airborne (SLC3S-A) command element. Fiscal Year 2019 Operations and Maintenance and procurement funds will be used for this effort.

3. DESCRIPTION OF SUPPLIES/SERVICES:
(a) Continuity of services is required for support to SCW-1. This effort will provide Executive Airborne Communications Network (EACN)access, Inmarsat Swift broadband (SBB), Swift-64, Aero H+ communications services, Very-High Frequency (VHF) Data-Link (VDL) safety services, and airborne DirecTV services.
(b) The combined services of Inmarsat and DirecTV are required to provide E-6B aircraft-embarked senior leaders with critical real-time information and services needed to function as an airborne mobile command node for senior authority collaboration, decision-making, course of action (COA) formulation, and force direction in a global mission environment.
(c) Access to the EACN by SBB data is critical to the SCW-1 mission. SCW-1 utilizes leased commercial terrestrial lines to connect their Inmarsat services with their EACN.
Specialized services and domains resident within the EACN are required for the E-6B to meet mission-tasking requirements as part of the SLC3S-A command element.
Without access to the EACN, the E-6B would not have the required connectivity and the collaborative services required for interoperability with other SLC3S-A command elements. This lack of connectivity to EACN would result in severe mission degradation or failure.
(d) Finally, DirecTV provides real-time access to critical information such as casualty and damage assessments; international, national, or local government political response;
economic impact assessments; and current and forecasted weather and atmospheric conditions required to provide E-6B embarked senior leaders the situational awareness needed for force direction and command element collaboration. The installed E-6B satellite television receiver hardware is only compatible with DirecTV services. Satcom Direct Communications, Inc. is currently the only GSA IT Schedule 70 SIN 132-55 provider of airborne DirecTV services, and DirecTV is the only existing airborne satellite television service that meets E-6B mission requirements by providing the required information services while also maintaining compatibility with the installed E- 6B systems architecture.
(e) The current task order expires on December 17, 2018. The Government awarded a bridge action to allow time for award of the follow-on and provide a consistent level of effort to SCW-1, United States Strategic Command (USSTRATCOM) and other Department of Defense stakeholders without an extended break in service.
(f) The follow-on contract will be FFP with one 12-month base and four 12-month option periods, plus an additional 6-month option to extend services IAW FAR 52.217-8. The estimated lifecycle amount for this effort is .

4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND DEMONSTRATION OF
CONTRACTOR’S UNIQUE QUALIFICATIONS:
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized, IAW FAR 8.405-6 (a)(1)(i)(B).
(a) Description of Events. Due to complications in obtaining funding, the task order HC1013-
14-F-0002 expired prior to execution of the final option year. As a result, DITCO issued the bridge contract HC1013-18-F-0039 for a 6-month base and two 3-month option periods to allow sufficient time to award the follow-on effort. This task order is the follow-on effort for HC1013-18-F-0039 (and thus HC1013-14-F-0002).
(b) Description of the Justification.
(1) Minimum Government requirements. SCW-1, and its stakeholders
USSTRATCOM ABNCP, Airborne Launch Control System, Non-Strategic Nuclear Forces Theater Commanders and the TACAMO Emergency Action Message relay system all depend on the services provided by Satcom Direct Communications, Inc. to meet mission requirements for operational capability and for Federal Aviation Administration (FAA) and International Civil Aviation Organization (ICAO) requirements. The aforementioned stakeholders rely on the communication services outlined to provide the critical information through these system links. Inmarsat SBB services allow the aircraft connection to the EACN ground entry points for mission IP services and data. Inmarsat S64/Integrated Services Digital Network (ISDN) services are required for high quality voice and data communications supporting mission (passenger) service applications.
Inmarsat Classic (Aero H+) services are required for voice and data applications supporting Air Traffic Control (ATC) operations/Air Traffic Services (ATS) and Airborne Operation Center (AOC) operations including all flight deck safety, reporting, and planning/administration communications during mission profiles where these services are not otherwise accessible through a line-of-sight (LOS) VDL connection (e.g. transoceanic operations). Flight deck safety services are also required over the VDL system during mission profiles over land that operate in the footprint of the LOS VDL terrestrial tower system for the same AOC and ATS/ATC operations where continuous satellite link access for those services would be cost prohibitive. Lastly, DirecTV services are required over the DSS receiver in order to provide embarked senior leaders the critical real- time information needed to support situational awareness for senior authority collaboration, decision-making, COA formulation and force direction.
(2) Proposed sole source contractor. Due to the operational requirements for SCW-1, Satcom Direct Communications, Inc. is the only GSA IT Schedule 70 SIN 132-55 provider that can fulfill the mission requirements at this time. However, Schedule 70 contractors are able to modify their contracts at any time to offer additional services, and new contractors may be added to the Schedule at any time.
Page 4 of 7 Pages
(3) Discussion regarding cause of the limited source situation. SCW-1’s requirements rely on the combined services (SBB, S64, H+, VDL, and DirecTV) to complete their airborne mission supporting SLC3S-A operations. These services provide mission critical components for all aspects of the operation (e.g., in-flight operations, cabin/cockpit voice and data communications, flight safety/tracking). Separation of these requirements into multiple contracts could result in operational impacts and reduce the effective response time to mitigate impacts to the SCW-1 mission, resulting in compromised operational readiness.
5. BEST VALUE DETERMINATION:
(a) By placing an order against a schedule contract using the procedures in Part 8, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
(b) GSA has already determined that prices of supplies, fixed price services, and rates for services offered at hourly rates are fair and reasonable for the purpose of establishing the schedule contract. Additional discounts will be requested beyond the published GSA schedule prices; indeed, discounts for same and similar services have historically been provided for Blanket Purchase Agreement (BPA) and task order awards issued under GSA IT Schedule 70. IAW DFARS 208.404 and Class Deviation 2014-O0011, the contracting officer will utilize the proposal analysis techniques shown at FAR 15.404-1 in order to verify that the anticipated order represents the best value to the Government.
This analysis will include review of GSA Schedule pricing, historical BPA and order pricing, and prices for similar services offered on other contracts.
6. MARKET RESEARCH:
The Government completed market research for the follow-on to contract HC1013-18-F- 0039/HC1013-14-F-0002 from January 2018 through September 2018. As described above, SCW-1 requires the combined set of services (EACN Access, SBB, S64, H+, VDL, and the aforementioned brand-name DirecTV services) to complete their airborne mission supporting SLC3S-A operations. Only the combined set of services can fully support the Government’s need. This requirement is for proprietary products and/or product support and no competitor functional replacement products exist in the market at this time to meet the Government's need.
The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions (i.e., there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system).
The Market Research conducted for this procurement indicates that, of the 38 GSA IT Schedule 70 SIN 132-55 contractors, only one large business contractor, Satcom Direct Communications, Inc., is capable of providing the required services at this time. Per Memorandum of Agreement (MOA) between DISA and GSA for Future Commercial Satellite Communications Services
Page 5 of 7 Pages
Acquisition Services, (FCSA), signed July 2009 (in effect through January 31, 2031), DISA will acquire COMSATCOM services and supplies through the use of FAR procedures governing placement of orders against Federal Supply Schedules (FAR 8.4), GSA ID/IQ contracts (FAR 16.505), and per the terms of the MOA. The acquisition strategy for the FCSA vehicles was approved by the Director, Defense Procurement and Acquisition Policy on July 22, 2009.
DoD requirements for COMSATCOM services must be competed using one of the FCSA contract vehicles. Schedule contractors are able to modify their contracts at any time to offer additional services, and Schedule contractors may be added or removed at any time.
