Requisition Number: DJF-16-0700-PR-0009420 Version 1.0 Page 1 of 5
FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH
AUTHORITY 41 U.S.C. 3304 (A) (1)
Requisition Number: DJF-16-0700-PR-0009420
Date: 05/27/2016
Estimated Contract Dollar Value: $285,510.01
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for an Exception to Fair Opportunity.”
The U.S. Department of Justice, Federal Bureau of Investigation, Science and Technology Contracts Unit, has prepared this justification for other than full and open competition for the 450kV X-Ray Tube
Upgrade for it’s exisiting NSI 3D CT X-Ray System on behalf of the Chemistry Unit/Scientific
Analysis Section/Laboratory Division.
2. Nature and/or description of the action being approved.
This is a one-time firm-fixed price contract that will be sole-sourced to North Star Imaging
(NSI) for a 450kV X-Ray tube upgrade of an existing NSI 3D CD X-Ray system.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value)
The Laboratory’s High Resolution Walk-In 3D X-Ray System is in need of a new high power 450 kV X-
Ray tube. The current system has an updated, fully functional 220 kV tube, and an outdated 350 kV tube that is over 10 years old, and cannot be controlled by the host system. The addition of a new, 450 kV X-
Ray tube will not only add full control capabilities, but also provide much higher object penetration and better signal to noise ratios when needed. The upgrade to a 450KV tube is specifically needed for the analysis of heavier walled, metal items of the type encountered in terrorism investigations. The Chemistry
Unit routinely receives heavy walled metal objects from improvised explosive devices (IED) for analysis and must be able to radiograph and CT scan these. Similar needs apply to certain components received from other Laboratory entities such as the Firearms and Toolmarks Unit. Unless the upgrade is made, it will remain impossible to fully examine many types of items commonly received in high profile investigations.

• 0.4 mm (700 watts: 1.5 mA)/1.0 mm (1,500 watts: 3 mA)
• NSI MP-1 digital controller with enclosure. The MP-1 has 6 operating modes, which are Warm
UP, Radiographic, Fluoroscopic, Auto Watt, and Remote Control via RS232. Up 600 stored techniques.
• Industrial CF -450 high stability generators.
• CF I/O box.
• 2 – 10 meter high-tension cable.
• NSI CF Oil to Air cooler with flow and temperature interlocks.
• All associated cables, cooling lines and documentation.
• NSI X-View Laser alignment system
Tube Mount Modification
X-ray Tube Shielding
X-ray Tube Shutter
• Four leaf, two axis tube shutter shielded for 450kV. Independent axis control.

4. The statutory authority permitting other than full and open competition.
For purposes of this acquisition, the statutory authority permitting other than full and open competition is delineated at 41 U.S.C. 3304 (a) (1) and implemented at FAR Part 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
North Star Imaging (NSI) is uniquely qualified to provide these services to the Chemistry Unit based upon the following:
Requisition Number: DJF-16-0700-PR-0009420 Version 1.0 Page 3 of 5
North Star Imaging is the only company that can provide the service required for this upgrade in order to maintain the warranty of the system. North Star Imaging built, installed, and services the existing NSI 3-D CT X-Ray system in need of this upgrade, and is the only company that can integrate the X-Ray tube control into its proprietary hardware and software.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The FBI will publicize this requirement on the Federal Business Opportunities website. This announcement will give an opportunity for other vendors to demonstrate their ability to meet the
FBI’s specific needs through a submission of technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
Before awarding a contract, the Contracting Officer will perform a price analysis in accordance with FAR 15.804-2(a)-(e).
8. A description of the market research conducted and the results.
Market Research was conducted by regularly attending scientific meetings, performing internet searches, interacting with other laboratories, and participating in scientific working groups.
Based on the unique nature of this requirement, it is recommended that NSI be considered a sole source for this purchase as they are the sole manufacturer of the FBI’s existing NSI 3-D CT X-
Ray system and the only vendor capable of performing the upgrade in order to maintain the warranty of the system.
9. Any other facts supporting the use of other than full and open competition.
See section 5 above.
10. A listing of any sources that expressed a written interest in the acquisition.
A synopsis will be posted on the Federal Business Opportunities website. This synopsis will give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The FBI will continue to conduct market surveys and research available through industry shows and technology releases in the form of papers and journals on subsequent acquisitions. Service and upgrades on highly specialized laboratory instrumentation are very sensitive, and requires manufacture-trained technicians and proprietary equipment and parts. Under some circumstances, manufacturers can certify outside organizations to perform this work, but it is rare. If in the event other vendors are certified by NSI to perform these services, they will be given fair opportunity to bid on future acquisitions of this type.
