JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
FAR Part 6 Requisition Number: Insert Requisition Number
FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH (STATE AUTHORITY E.G., 10 U.S.C. 2304 (C)(1) OR 41 USC 253) Requisition Number: DJF-16-2200-PR-0000964
Date: 04/05/2016 Estimated Contract Dollar Value: $79,595.00
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation, Mission Support Contracts Unit (MSCU), has prepared this justification for other than full and open competition in response to a requirement from the Critical Incident Response Group (CIRG), Tactical Section, Hostage Rescue Team (HRT).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
This is a one time, firmed-fixed price purchase order contract, sole-sourced to Atlantic Signal.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is to provide a tactical communications suite for single and dual radio communications. This suite will streamline technical support along with future system integration for the next generation communications platforms. PTT’s and headsets provide hearing protection, and have the ability to interface with multiple communication platforms used by the FBI.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1)) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The suite is a proprietary product manufactured by Atlantic Signal. The link to the communicataion push-to-talk assembly is a 7pin connector that is used for the radio and ICS/Smartphone cable connection. All radio and ICS/Smartphone cables are propriety to the vendor due to this 7pin connector is used to mate the cable with the push-to-talk assembly. The unique communication push-to-talk assembly does not require a battery to operate; rather, it is powered by the voltage supplied through the connected radio via the Push-to-Talk feature. This power is used to activate the circuitry necessary to split the audio when using dual radio communications (radio 1 right ear, radio 2 left ear, ICS/Smartphone both ears). This is done without the need for any adjustments by the user. If only 1 redio is used then the audio will be heard in both ears.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The FBI will publicize this requirement on the General Services Administration (GSA) eBuy Website to provide authorized resellers to quote this requirement.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated cost of the PTT radios and headsets is $79,595.00. A determination for fair and reasonable pricing will be refined upon receipt of competitive quotes.
8. A description of the market research conducted and the results.
Research via the internet, emails, and phone calls to multiple vendors for exact systems was conducted. A testing and evaluation process was completed which identified and selected this system as the preferred solution for a tactical PTT system. Several similar systems are available, but do not offer the capability to power the PTT assembly via the radio connection or offer a headset that would interface with current equipment used by the agency.
9. Any other facts supporting the use of other than full and open competition.
Covered under Item 5 (nature of the acquisition requiring the use of the authority).
10. A listing of any sources that expressed a written interest in the acquisition.
N/A
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The FBI will continue to conduct market research to identify potential sources on subsequent acquisitions.
