When completing the declaration, bidders must identify all subcontractors proposed for participation in the contract. Bidders awarded a contract are contractually obligated to use the subcontractors for the corresponding work identified unless the State agrees to a substitution and it is incorporated by amendment to the contract.
DARFUR CONTRACTING ACT
Effective January 1, 2009, CDCR generally cannot contract with “scrutinized” companies that do business in the African nation of Sudan, as described in PCC §§ 10475 -10478. A company that currently has (or within the previous three years has had) business activities or other operations outside of the United States must certify that it is not a “scrutinized” company when it submits a bid or proposal to CDCR. A scrutinized company may still submit a bid or proposal for a contract with CDCR if the company first obtains permission from the CDCR. All bidders must submit a completed OBS 1500 (Attachment # 10) verifying status, with their bid proposal, if applicable.
COMMERCIALLY USEFUL FUNCITON
The Purchasing Authority Manual, Chapter 3, Topic 2, Infoblock 3.2.5 describes that all California certified SBs and DVBEs contractors, subcontractors and suppliers that bid on or participate in a state contract regardless of the procurement approach or the payment method must perform a Commercially Useful Function (CUF).
The purpose of the CUF (Attachment # 13) requirement is to prevent certified SB/MB/DVBE businesses from acting as a “pass through” or “front” when identified as the prime bidder or when identified as a subcontractor from providing artificial or incidental participation to meet the socio-economic objective of a solicitation or contract. In either case, when CUF is not validated, there is a potential for obtaining unwarranted State preference advantages.
PROHIBITION ON TAX DELINQUENTS
Pursuant to the PCC section 10295.4, effective 7/1/2012, persons or companies identified as the largest tax delinquents by the Franchise Tax Board (FTB) or the Board of Equalization (BOE) are ineligible to enter into any contract with the state for non-IT goods or services. Any contract entered into in violation of section 10295.4 is void and unenforceable.
CDCR’S QUOTE WORKSHEET
Only bids quoted on the CDCR's Quote Worksheet form will be considered. Bids submitted referencing bidder attachments which include legal terms and conditions that conflict with the State's General Provisions shall be considered non-responsive and such bids shall be rejected.

As a contractor with CDCR, you and your staff are expected to ensure compliance with this policy as described in Department Operations Manual, Chapter 5, Article 44.
4. Security Regulations
a. Unless otherwise directed by the entrance gate officer and/or Contract Manager, the contractor, contractor’s employees and subcontractors shall enter the institution through the main entrance gate and park private and nonessential vehicles in the designated visitor’s parking lot. Contractor, contractor’s employees and subcontractors shall remove the keys from the ignition when outside the vehicle and all unattended vehicles shall be locked and secured while on institution grounds.
b. Any State- and contractor-owned equipment used by the contractor for the provision of contract services, shall be rendered temporarily inoperative by the Contractor when not in use, by locking or other means unless specified otherwise.

The State shall in no way be responsible for contractor’s loss due to fire.

The Request for Gate Clearance must include the person’s name, social security number, valid state driver’s license number or state identification card number and date of birth. All persons entering the facilities must have a valid state driver’s license or photo identification card on their person.

Purchasing Agent: PO #: Postconsumer-Content Certification Phone: E-mail:
The State Agency Buy Recycled Campaign (SABRC) is a state mandated program that requires the reporting of all purchases made within 11 specified product categories. All state agencies are required to verify the recycled-content of all products purchased within each of these categories.
All businesses shall certify in writing to the contracting officer or his or her representative the minimum percentage, if not exact percentage, of postconsumer recycled-content (PCRC) material in the products, materials, goods, or supplies offered or sold to the State regardless of whether the product meets the minimum content requirements specified in law (see reverse side). The certification shall be furnished under penalty of perjury. The certification shall be provided regardless of content, even if the product contains no recycled material. A State agency may waive the certification requirement if the percentage of postconsumer material in the products, materials, goods, or supplies can be verified in a written advertisement, including, but not limited to, a product label, a catalog, or a manufacturer or vendor Internet website.
