About this file
This document contains required federal contract representations and certifications provisions for commercial product and service acquisitions under the Federal Acquisition Regulation (FAR).
The solicitation uses a Lowest Price Technically Acceptable (LPTA) evaluation methodology for commercial items with a NAICS code of 334419 (Other Electronic Component Manufacturing) and a small business size standard of 750 employees. Quoters must provide fixed unit pricing and total cost including shipping, with delivery required on an FOB Destination basis within one month after receipt of order. Shipping costs must be included in the total fixed-price quote, with any tariff costs listed as a separate CLIN 0002 on a not-to-exceed basis. Technical acceptability is determined by the quoter's demonstrated ability to meet all minimum requirements and delivery schedule obligations. The government will evaluate options, if applicable, by adding option prices to the base requirement price and may reject offers with significantly unbalanced option pricing.
Quoters must complete multiple representations addressing: inverted domestic corporation status, delinquent tax liability and federal felony convictions, small business status and socioeconomic certifications (including women-owned, service-disabled veteran-owned, disadvantaged, and HUBZone categories), Buy American domestic content requirements, and place of manufacture. All representations require certification that the offeror meets or does not meet specified criteria. Misrepresentation of small business status or other program eligibility carries penalties including fines, imprisonment, suspension, debarment, and program ineligibility under the Small Business Act.

(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.

FAR 52.212-2 Evaluation- Commercial Products and Commercial Services
(a) Responses received to this RFQ will be evaluated on the basis of Lowest Price Technically Acceptable (LPTA). Quoters submitting a response must provide a completed Price Quote to be evaluated and considered for award. Price quotes must indicate fixed unit pricing and total cost, including shipping cost and estimated time of delivery after receipt of order, and warranty and training considerations. Responses will be evaluated based on 1) contractor’s ability to meet the government’s minimum requirements stated in this notice and on 2) ability to deliver the required items on a FOB Destination basis within the period of performance/lead time specified in the Statement of Work document.
Responses to this solicitation must include clear and convincing evidence of the Quoters’ capability of fulfilling the requirement as it relates to the essential government requirements stated in this solicitation. Under the lowest-price technically acceptable (LPTA) process, Quoters will be determined to be “technically acceptable” or “technically unacceptable” based on an evaluation of responses against the following factors to determine if, as submitted, the quotation is technically acceptable.
(1) Technical Capability: The Quoter must indicate in its quotation the ability to provide all minimum requirements identified in the Requirements document.
(2) Schedule: The Quoter must indicate in its quotation the ability to meet the delivery requirements (delivery FOB Destination within one (1) month ARO). The total cost of shipping must be included in the total fixed-price quoted amount, with any potential tariff costs included as a separate CLIN 0002 on a not to exceed basis. The quote must contain delivery terms for FOB-Destination only.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
