REQUEST FOR PROPOSALS (RFP) No. NIH-NINDS-17-03
Project Title: “NINDS Center for Clinical Research Resources”
ISSUE DATE: March 1, 2017
DATE DUE: May 3, 2017
Ladies and Gentlemen:
The National Institute of Neurological Disorders and Stroke (NINDS), NIH, invites you to submit a proposal in response to the requirements of the enclosed RFP No. NIH-

The NINDS seeks to award a contract to an organization with the requisite qualifications and capabilities to provide scientific and technical clinical research support services in the area of Quality Control/Quality Assurance clinical trial monitoring, statistical and methodological support, clinical data acquisition and archiving support and common data element (CDE) development support.
The envisioned contract award is a follow-on requirement to the current National Institute of Neurological Disorders and Stroke (NINDS) Center for Clinical Trial Resources requirement currently being performed under NINDS contract HHSN271201200034C by the EMMES Corporation.
THIS ACQUISITION IS ISSUED ON A WOMAN-OWNED SMALL BUSINESS SET-ASIDE
BASIS whereby only woman-owned small businesses will be eligible for contract award.
Please reference Article I.3., FAR Clause 52.219-30, “Notice of Set-Aside for, or Sole Source Award to, Woman-Owned Small Business Concerns Eligible Under the Woman- Owned Small Business Program (December 2015)” for further details.
The North American Industry Classification System (NAICS) code for this this requirement is 541712. The small business size standard is 1,000 employees.
If your organization is a Woman-Owned Small Business, please complete Attachment 4, listed in Section J, entitled “SBA Form 2413 – Woman Owned Small Business (WOSB) Program Certification – WOSBs” and upload to the WOSB Program Repository along with all other required documents as outlined in the Compliance Guide for WOSB Program (www.sba.gov/wosb) prior to submitting an offer.

http://www.sba.gov/wosb
Additionally, offerors are advised to review the list of attachments in Section J entitled “List of Attachments.” This list provides information as to which attachments need to be completed and submitted with your proposal (and which attachments are included for informational purposes only). Some of the attachments listed in Section J supplement the Instructions in Section L of the main RFP document, so it is important to refer to both Section L and the applicable attachments in Section J when preparing your proposal. The list of attachments in Section J also provides links to fillable forms for many of the attachments that need to be completed and submitted with your proposal.
Your attention is further directed to Attachment 2, "Proposal Intent Response Sheet.” If you intend to submit a proposal in response to this solicitation, we ask that you send a copy of the Proposal Intent Response Sheet via e-mail it to Jason Williams at willjas@nida.nih.gov.
It is your responsibility to monitor the web page at http://www.FedBizOpps.gov/ for any amendments that might be issued under this RFP. A separate notice of RFP amendments, if any, to individual sources, will not be made.
Proposals are to be delivered electronically via the NIH electronic Contract Proposal Submission (eCPS) website at https://ecps.nih.gov. Please reference Attachment 1, listed in Section J, entitled “Packaging and Delivery of Proposals for Use with the NIH electronic Contract Proposal Submission (eCPS) Website” for instructions and further details. Please note that you must create an account in the NIH electronic Contract Proposal Submission (eCPS) system/website in order to submit a proposal and it may take up to there (3) business days to establish a new account. Please apply for a new account early to allow enough time for the registration process.
Your attention is directed to the RFP provision entitled “LATE PROPOSALS AND REVISIONS” set forth in Section L, paragraph 1, (j) of this RFP, implemented by HHSAR 352.215-70. Please review these provisions so that you will be fully aware of the time requirements for submitting your proposal. It is your responsibility to ensure that your proposal is delivered by the due date and time to the NIH electronic Contract Proposal Submission (eCPS) website as required in the RFP.
Your proposal must be prepared in the format prescribed in the RFP. Please be sure that all documents which you are required to complete and sign (e.g., Representations and Certifications, NIH Form 2043 “Proposal Summary and Data Record”, NIH Section 508 Product Assessment Template etc.) are submitted with your proposal (again, please review the list of attachments included in Section J which will indicate which attachments need to be completed and submitted with your proposal [and whether to include with your Technical Proposal or Business Proposal]).
Your proposal must provide a contact name and telephone number, your company name and complete mailing address. Furthermore, FAR Provision 52.204-7, System for Award Management (SAM), which is applicable to this solicitation, requires that a prospective mailto:willjas@nida.nih.gov http://www.fedbizopps.gov/ https://ecps.nih.gov/ awardee be registered in the SAM database prior to award, during performance, and through final payment of any contract resulting from this solicitation. In addition, your organization’s Tax Identification Number (TIN) and Dun & Bradstreet Number must be provided. The RFP does not commit the Government to pay the costs for the preparation and submission of a proposal.
It also is brought to your attention that the Contracting Officer is the only individual who legally can commit the Government to the expenditure of public funds in connection with this acquisition. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

THE ENCLOSED CONTRACT SCHEDULE IS INTENDED TO PROVIDE THE OFFEROR WITH THE NECESSARY INFORMATION
TO UNDERSTAND THE TERMS AND CONDITIONS OF THE RESULTANT CONTRACT.
SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS
ARTICLE B.1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES
The NINDS Division of Clinical Research (DCR) is charged with ensuring the highest quality of each NINDS-funded clinical research project in terms of both conduct and the integrity of resultant data and ensuring compliance with DHHS/NIH/NINDS regulations regarding human subject protection and safety monitoring. To ensure the highest quality product and most efficient use of resources, DCR has established a programmatic requirement for clinical research-related scientific and technical support for NINDS-sponsored clinical research in the form of an NINDS Center for Clinical Research Resources.
The Contractor shall provide scientific and technical support toward the conduct of NINDS-sponsored clinical research in the areas of Quality Control/Quality Assurance clinical trial monitoring, statistical and methodological support, clinical data acquisition and archiving support and common data element development support.
ARTICLE B.2. PRICES/COSTS
The final contract will contain the price/cost provisions agreed upon by the Government and the Offeror.
Basic Requirement
The basic requirement, which consists of the four performance areas contained in the Statement of Work (Quality Assurance/Quality Control clinical trial monitoring, statistical and methodological support, clinical data acquisition and archiving and common data element development support) will be funded on cost reimbursement, term, level-of-effort basis and will consist of a base 12-month (1 year) period of performance with four successive 12-month Term Options for a total potential performance period of 5 years.
Quantity Options
The Common Data Element performance area under this contract will contain up to 10 separately-priced Quantity Options for: 1) the development of new disease-specific Common Data Elements, if and when identified, such that they may be added to the NINDS Common Data Element website disease-specific-library; and 2) development and implementation of web-based training modules, if and when the need is identified, to assist website users in navigating and utilizing the NINDS Common Data Elements website from both a general framework standpoint and more specific training modules related to particular disease-specific Common Data Elements contained on the website.
Quantity Options, if exercised, will be funded on a cost reimbursement, completion basis (completion for the New Disease-Specific CDE Development Options being final acceptance and upload of the new disease data to the NINDS Common Data Elements website; completion of the Web-Based CDE
Training Module Options being the final acceptance and upload of the training module to the NINDS Common Data Elements website).
Though these Quantity Options may be exercised at any time during the performance period of the contract, It is estimated that one (1) New Disease-Specific CDE Development Option and one (1) Web- Based CDE Training Module Option will be exercised each year.
NOTE: Exercise of any Term Option (Basic Requirement) or Quantity Option (New Disease-Specific CDE Development Option and/or Web-Based CDE Training Module Option) is subject to continued Institute need for such services and availability of funds in the Fiscal Year in which said options would be exercised.
ARTICLE B.3. ESTIMATED COST AND FIXED FEE – BASIC REQUIREMENT PLUS BASIC REQUIREMENT
TERM OPTIONS
The basic contract requirement represents a cost plus fixed fee level of effort contract (i.e., severable services) with a one-year base period and four successive one-year Option periods of performance.
The level of effort requirements of the base contract represent severable services that are continuing and recurring in nature. Despite the extensive performance history of this contract, the NINDS still have no way of knowing, even within a reasonable range of estimation, the exact course of action that will need to be taken in order to perform the four Performance Area support functions contained in the Statement of Work (Monitor Quality Assurance/Quality Control in Clinical Research; Statistical and Methodological Support; Clinical Data Acquisition and Archiving; and Common Data Element support) in any given year. Therefore, the most that the NINDS can fairly bargain for is that the Contractor have available and provide a cadre of personnel to be able to devote to the specific performance requirements as they are identified. Thereby, the Contractor’s performance obligation and the Government’s need can only be defined in terms of the expected level of effort that can be provided on an annual basis, for each 12 month period, as a means of defining the Contractors performance obligation and the Government’s need for the basic requirement. The clause at FAR 52.232-20, Limitation of Cost, is included and is made a part of this contract and applies to the base contract and each successive option period so exercised.
a. The estimated cost of the Base contract is $TBD (estimated 12,500 hours/ level-of-effort).
b. The fixed fee for the Base contract is $TBD. The fee shall be paid in direct ratio to the level of effort expended; that is, the percent of fee paid shall be equal to the percent of total effort expended.
Payment shall be subject to the withholding provisions of the clauses ALLOWABLE COST AND PAYMENT and FIXED FEE referenced in the General Clause Listing in Part II, ARTICLE I.1 of this contract.
c. The total estimated amount of the base contract, represented by the sum of the estimated cost plus the fixed fee, is $TBD.
d. If the Government exercises its Basic Requirement Options to extend the period of performance for out years two through five pursuant to the OPTION PROVISION Article in SECTION H of this contract, the following represents the cost and fee for each of the Basic Requirement term options:
Level-of- Effort Hours
Performance Period Cost Fee Total Contract Amount
Option 1 – Basic Requirement

e. If the Government intends to NOT exercise a subsequent Basic Requirement Option, as contained in paragraph (d), the Contractor will be informed 60 days prior to contract expiration in order to allow for any final deliverables, including but not limited to, the Final Report. Otherwise, the Government shall notify the contractor in writing at least 30 days in advance of its intent to exercise any subsequent Basic Requirement Option listed in paragraph d) above. See ARTICLE I.3.
ADDITIONAL CONTRACT CLAUSES, FAR 52.217-9, Option to Extend the Term of the Contract, for full details.

In addition to the basic contract requirement, as addressed in Article B.2., the Government will also have the right to exercise a variety of quantity options during the performance period of this contract (estimated to be five years, assuming all of the Basic Requirement Term Options are exercised). Each Quantity Option contained in this Article will represent a separately priced line-item inclusive of cost plus fixed fee and each Quantity Option represents a non-severable requirement to be fully funded at the time the Option is exercised. The Quantity Options, as described in the Statement of Work (Article C.1), are listed below:

If the Government exercises these options, notice must be given before the expiration date of the contract. Specific information regarding the time frame for this notice is set forth in the OPTION PROVISION Article in SECTION H of this contract.
c. Payment of fee for each option shall be subject to the withholding provisions of the clauses ALLOWABLE COST AND PAYMENT and FIXED FEE referenced in the General Clause Listing in Part II, ARTICLE I.1. of this contract. The fee for each option shall be paid in installments based on the percentage of completion of work, as determined by the Contracting Officer.
