1 PART III – SECTION J –

Attachment 11: Small Business Subcontracting Plan

Question: In general, if the Prime contractor has a subcontract with a foreign Institution, is that subcontract exempt from needing a small business subcontracting proposal regardless of the amount of the subcontract?

Response: FAR 19.704(a)(9) states that each subcontracting plan required under 19.702(a)(1),(2),(3) shall include – assurances that the offeror will include the clause at 52.219-8, Utilization of Small Business Concerns (see 19.708(a)), in all subcontracts that offer further subcontracting opportunities, and that the offeror will require all subcontractors (except small business concerns) that receive subcontracts in excess of $700,000 to adopt a plan that complies with the requirements of the clause at 52.219-9, Small Business Subcontracting Plan. Based on this FAR language, a subcontract with a foreign institution that receives a subcontract award in excess of $700,000 would not be exempt.

2 PART III – SECTION J –

Attachment 11: Small Business Subcontracting Plan

Question: Is the “entire period of performance” considered a one-year term? For instance, if a subcontract (national or foreign) has a yearly budget under $700,000 but a total budget over $700,000 would the subcontract be exempt from needing to prepare a small business subcontracting proposal?

Response: As stated on page 15 of the Request for Proposal (RFP), the period of performance includes a base plus four (4) options. In accordance with FAR 19.704(c), “for multiyear contracts or contracts containing options, the cumulative value of the basic contract and all options is considered in determining whether a subcontracting plan is necessary. FAR 19.704(9) requires assurances by the offeror to include the clause at 52.219-8, Utilization of Small Business Concerns, in all subcontracts that offer further subcontracting opportunities, and that the offeror will require all subcontractors (except small business concerns) that receive subcontracts in excess https://oamp.od.nih.gov/DGS/DGS-workform-information/attachment-files https://oamp.od.nih.gov/DGS/DGS-workform-information/attachment-files

RFP-NIAID-DMID-NIHAI201800005 Page 3 of 3 of $700,000 to adopt a plan that complies with the requirements of the clause at 52.219-9, Small Business Subcontracting Plan.

3 PART III – SECTION J –

Attachment 11: Small Business Subcontracting Plan

Question: Do the Small Business Subcontracting Plans (for both the Prime and any Subcontractor) need to be submitted at the time of the full proposal submission or can they be submitted later if the proposal is selected for funding and enters into the negotiation phase?

Response: The Small Business Subcontracting Plan for the Prime offeror, if required, shall be submitted with proposal submission.

Small Business Subcontracting Plans from the Prime offeror’s subcontractors do not need to be provided to the NIAID or included in proposal submission. It is the responsibility of the Prime to manage the subcontract and any plans required if selected for award.
