QUESTIONS & ANSWERS

Posted to SAM.gov on July 7, 2023

The following questions and answers are provided for informational purposes only. Nothing contained in the below questions and answers constitutes a change to the terms and conditions of the solicitation. Any change to a term or condition will be issued through an amendment to the solicitation.

Note: In some instances, questions have been abbreviated or additional context has been added to clearly describe the question for all potential Offerors.

QUESTION 1:

Does the FBI have a preferred sight vendor for this RFP that we can work with to forego providing the required number of samples? As a small business we are a bit concerned at the price for the 30 required samples that we would have to provide.

ANSWER 1:

THE FBI DOES NOT HAVE A PREFERRED VENDOR.

QUESTION 2:

Bases on C.2.2 – Can you please clarify what quantities you anticipate to be fulfilled in 90 days. We want to properly anticipate your supply needs to ensure a 90-day delivery window.

ANSWER 2:

THE RESULTING CONTRACT IS INDEFINITE DELIVERY, INDEFINITE QUANTITY

THEREFORE UNABLE TO DETERMINE EXACT QUANTITIES.

QUESTION 3:

Factor 6 on page 85 of the evaluation criteria seems to contradict C.4.4 on page 10 regarding the red dot requirements. C.4.4 states a waterproof requirement of 25 ft. for 1 hour toward NV compatible models. Factor 6 indicates a 90 min. test. What is the correct waterproof requirement for the NV compatible optic?

ANSWER 3:

PLEASE SEE AMENDMENT 0002, PAGE 7.

QUESTION 4:

Does FAR 52.225-1 apply for this solicitation?

ANSWER 4:

PLEASE SEE SECTION I – CONTRACT CLAUSES.

QUESTION 5:

Will you accept Assembled in US products made overseas?

ANSWER 5:

PLEASE SEE SECTION I – CONTRACT CLAUSES, FAR 52.225-1 AND 52.225-13.

QUESTION 6:

Does the supplier of the sights have to be small-business as well, or just the contractor?

ANSWER 6:

ANY CONTRACT AWARD WINNER THAT RESULTS FROM THIS SOLICITATION SHALL

BE A SMALL BUSINESS. PLEASE NOTE THAT CLAUSE 52.219-33 NONMANUFACTURER

RULE APPLIES TO THIS SOLICITATION.

QUESTION 7:

The RFP contains multiple references to the Buy American statute and the FAR provision relating to place of manufacture/country of origin; however, page 61 of the solicitation states, “The Government will consider for award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for such products are insufficient to fulfill the requirements of the solicitation.”

Do you anticipate that the U.S.-made designation, etc., will be waived for this solicitation?

ANSWER 7:

THE FBI MAKES NO ASSUMPTIONS ON OFFERS NOT YET RECEIVED.

QUESTION 8:

In the RFP Cover page attachment, it asks us to sign and attest that the sample "Ballistic Shields" submitted in response to RFP are in compliance. This would not be factual in regards to this RFP as we are not providing ballistic shields.

ANSWER 8:

PLEASE SEE AMENDMENT 0001.

QUESTION 9:

Section “C.7 Battery” requires a minimum of 250 hours of battery life at a medium reticle intensity setting. However, in Phase III testing the “Factor 5 - Battery Life Test” specifies the optics will be adjusted to the highest red dot intensity level for 150 to 160 hours. If any sight has turned off after this time period it will have failed this assessment.

• Is the FBI requiring optics to meet 250 hours of battery life at a medium setting, and 160 hours battery life at the highest intensity setting?

• Will optics be tested to this requirement in a “dot only” coniguration if they have functionality to switch the reticle portion “off”? The battery life is considerably higher in dot only mode vs dot and reticle mode.

ANSWER 9:

PLEASE SEE AMENDMENT 0002, PAGE 7.

WHILE SECTION C.7 OF THE STATEMENT OF WORK REQUIRES A BATTERY LIFE OF

250 HOURS, THE RIFLE RED DOT SIGHT WILL BE TESTED FOR A PERIOD OF TIME

BETWEEN 150 AND 160 HOURS.

IF THE RIFLE RED DOT SIGHT HAS MULTIPLE ALTERNATE RETICLES, THE PRIMARY

RETICLE CONFIGURATION (E.G., THE ILLUMINATED RED DOT) WILL BE SELECTED

FOR THE BATTERY LIFE ASSESSMENT.

QUESTION 10:

The RMR HD (standard objective lens) does not have a true auto shutoff feature. However, if left in manual mode for 16.5 hours or more, without a button press, the optic will go into automatic mode. This feature can conserve battery life by automatically dimming the dot/reticle if the optic is placed in dark storage (safe, range bag, holster) for an extended period of time. This feature can be disabled by manually locking in the desired brightness setting.

• Will an optic with this type of battery save feature be tested to Factor 4 or Factor 5 testing during Phase III?

ANSWER 10:

IN THE SITUATION DESCRIBED ABOVE, THE FBI WOULD CONSIDER THE RIFLE RED

DOT SIGHT TO NOT HAVE AN AUTOMATIC SHUTOFF FEATURE. THE RIFLE RED DOT

SIGHT WOULD BE TESTED UNDER FACTOR 5.

QUESTION 11:

What is the rifle brand and model the FBI is going to test the optics with?

• What is the caliber of the rile?

• What is the weight of the rile?

ANSWER 11:

THE FBI UTILIZES COLT-PATTERN CARBINES CHAMBERED IN 5.56MM, ASSEMBLED

IN-HOUSE USING PRIMARILY COLT MIL-SPEC COMPONENTS. THE CARBINE HAS AN

11.5” BARREL AND WEIGHS APPROXIMATELY 7.2 POUNDS.

QUESTION 12:

Can the government please define in a measurement the lower 1/3 co-witness requirement? For example, 1.53” or 1.64”

ANSWSER 12:

PLEASE SEE SECTION C.6.2 OF THE RFP FOR THE CURRENT BACKUP IRON SIGHTS

USED BY THE FBI. ANY RIFLE RED DOT SIGHT SUBMITTED SHOULD ALLOW FOR THE

SHOOTER TO SEE THROUGH THESE BACK UP IRON SIGHTS IN THE APPROXIMATE

LOWER 1/3 OF THE OPTIC.

QUESTION 13:

Can the Government explain the procedure used for Factor 4 – Red Dot Shut-Off Test in more detail? Will the optics be mounted in a fixture or condition where automatic turn-on cannot be activated unintentionally?

ANSWER 13:

TO REDUCE THE POSSIBILITY OF MOVEMENT, THE FBI INTENDS TO PLACE THE

RIFLE RED DOT SIGHTS ON A CONCRETE BLOCK MEASURING 36” (W) X 36” (L) X 36”

(H). THE SIGHTS WILL REMAIN ON THIS BLOCK FOR THE DURATION OF THE

ASSESSMENT.

QUESTION 14:

I work for a company that manufactures a COTS item that is available in the USA. Our item is made in China. Is that allowable for this RFP?

ANSWER 14:

NO. PLEASE SEE SECTION I – CONTRACT CLAUSES, FAR 52.225-1 AND 52.225-13.
