The term “bidder” is used to identify where specific responses to the RFP are required. Yellow fields are also used to identify areas where a bidder response is required.
The Contractor must respond to each requirement or question and explain how it will fulfill each requirement. Attach any supplemental information and reference it appropriately within your response.
Background The Department of Environment, Great Lakes, and Energy (EGLE) is implementing a State-run Pollution Prevention (P2) & Food Waste Reduction Technical Assistance Program (TAP or Program) funded by the U.S. Environmental Protection Agency’s (USEPA) Pollution Prevention (P2) Program. This program is geared towards assisting Michigan Food and Beverage Manufacturing and Processing Industry, one of the National Emphasis Areas (NEAs) designated by USEPA P2 Program. USEPA designates NEAs to focus federal grant funding and technical assistance on sectors with significant opportunities for pollution prevention, economic, and environmental impact. The Michigan P2 and Food Waste Reduction TAP aims to improve the industry’s resiliency through reduced operating costs by improving efficiencies, recycling, reusing and reducing waste (heat, water, solid waste etc.), and supporting onsite generation of renewable energy. The program will provide eligible businesses in the food and beverage industry with no cost technical assistance to identify opportunities to improve reliability, and manage environmental risks through:
· Decreasing energy and water consumption per unit produced thereby reduce operation costs
· Decreasing or eliminating use of hazardous substances
· Reducing food waste by investing in waste audits, smart tracking systems, leveraging food donation partnerships, organics composting and staff training
· Reducing waste costs by reusing waste heat and recirculating water
· Increasing energy security through onsite energy generation
· Reducing waste generation and environmental compliance challenges The program will create tools, resources, case studies and webinars that highlight the best practices in food and beverage industry for environmental protection. The program will also assist businesses to identify and pursue environmental protection implementation grant funding. The program is funded by a federal Pollution Prevention grant from USEPA.
Scope EGLE is soliciting proposals from eligible entities to assist the state in the creation of a Michigan P2 & Food Waste Reduction Technical Assistance Program (hereafter referred to as TAP or Program) as part of its Pollution Prevention Program (P2 Program) and to run it in coordination with the State Industry Engineer Specialist and the Food Waste Specialist. The TAP will focus on the Michigan Food and Beverage Manufacturing and Processing industries (hereafter referred to as ‘F&B industry’).
The State intends to award this Contract to a service provider who can demonstrate their capability to provide all services and complete all tasks listed in Schedule A within the one-year contract period. A Contractor who is awarded a Contract must provide all labor, materials, and equipment needed to successfully complete the assignment and provide acceptable deliverables, subject to the direction and priorities set by the EGLE Program Manager. Any out-of-scope work if deemed necessary must be approved via a change request or addendum and will be billed on a time and material basis.
General Requirements The Contractor shall provide services, staff and deliverables and otherwise do all things necessary for or incidental to the performance of the work, as set forth below.
Task 1 - Listening Sessions & Roundtables The Contractor in collaboration with the EGLE Program Manager must organize a minimum of two listening sessions and one roundtable among food and beverage manufacturers and processors, local governments, breweries/distilleries, technical experts, trade associations and impacted communities. The goal of the first listening session is to collect input on the environmental challenges and resiliency needs of the industry, and to incorporate that in the subsequent tasks especially the EGLE P2 & Food Waste Reduction toolbox. RFP 260000002460 Pollution Prevention & Food Waste Reduction Technical Assistance Program 1 Schedule A – Attachment 1 – Key Personnel
1. Key Personnel The Contractor must appoint individuals who will be directly responsible for the day-to-day operations of the Contract. Key Personnel must be specifically assigned to the State account, be knowledgeable about the contractual requirements, and respond to State inquiries within 24 hours. The required key roles for this Contract are Project Principal, Project Manager, and Subject Matter Experts (SME)/Technical Specialists. Each key role can be carried out by one or more of the Key Personnel, and one Key Personnel can also carry out one of more of the roles.
Two or more of the Contractor Key Personnel assigned to the contract should have experience in industrial processes, food waste, organics, energy use, water use and waste reduction, experience; a minimum of 10 years of experience conducting industrial process and facility audits; and technical expertise to identify cost effective and innovative solutions. One of these experienced personnel must be involved in conducting onsite technical assessments. The State reserves the right to request an alternate project Key Personnel if the originally assigned Personnel do not prove to be qualified to conduct these assessments.
Contractor’s Key Personnel must be on-site for the in-person assessment of participating facilities at a scheduled time convenient for the Contractor, the facility and the State Program Manager.
The State has the right to recommend and approve in writing the initial assignment, as well as any proposed reassignment or replacement, of any Key Personnel. Before assigning an individual to any Key Personnel position, Contractor will notify the State of the proposed assignment, introduce the individual to the State’s Project Manager, and provide the State with a resume and any other information about the individual reasonably requested by the State. The State reserves the right to interview the individual before granting written approval. In the event the State finds a proposed individual unacceptable, the State will provide a written explanation including reasonable detail outlining the reasons for the rejection. The State may require a 30-calendar day training period for replacement personnel.
Contractor will not remove any Key Personnel from their assigned roles on this Contract without the prior written consent of the State. The Contractor’s removal of Key Personnel without the prior written consent of the State is an unauthorized removal (“Unauthorized Removal”). An Unauthorized Removal does not include replacing Key Personnel for reasons beyond the reasonable control of Contractor, including illness, disability, leave of absence, personal emergency circumstances, resignation, or for cause termination of the Key Personnel’s employment. Any Unauthorized Removal may be considered by the State to be a material breach of this Contract, in respect of which the State may elect to terminate this Contract for cause under the Termination for Cause section of the Standard Contract Terms. It is further acknowledged that an Unauthorized Removal will interfere with the timely and proper completion of this Contract, to the loss and damage of the State, and that it would be impracticable and extremely difficult to fix the actual damage sustained by the State as a result of any Unauthorized Removal. Therefore, Contractor and the State agree that in the case of any Unauthorized Removal in respect of which the State does not elect to exercise its rights under Termination for Cause, Contractor will issue to the State the corresponding credits set forth below (each, an “Unauthorized Removal Credit”):
For the Unauthorized Removal of any Key Personnel designated in the applicable Statement of Work, the credit amount will be $25,000.00 per individual if Contractor identifies a replacement approved by the State and assigns the replacement to shadow the Key Personnel who is leaving for a period of at least 30-calendar days before the Key Personnel’s removal.
If Contractor fails to assign a replacement to shadow the removed Key Personnel for at least 30-calendar days, in addition to the $25,000.00 credit specified above, Contractor will credit the State $100.00 per calendar day for each day of the 30-calendar day shadow period that the replacement Key Personnel does not shadow the removed Key Personnel, up to $100.00 maximum per individual. The total Unauthorized Removal Credits that may be assessed per Unauthorized Removal and failure to provide 30-calendar days of shadowing will not exceed $100.00 per individual.
Contractor acknowledges and agrees that each of the Unauthorized Removal Credits assessed above: (i) is a reasonable estimate of and compensation for the anticipated or actual harm to the State that may arise from the Unauthorized Removal, which would be impossible or very difficult to accurately estimate; and (ii) may, at the State’s option, be credited or set off against any fees or other charges payable to Contractor under this Contract.
The Contractor must identify the Key Personnel, indicate where they will be physically located, describe the functions they will perform, and provide current chronological résumés.
The Contractor must identify all Key Personnel that will be assigned to this contract.
