RFP 202606108 Court Reporting Q&A Summary

This file is a Questions and Answers summary for RFP 202606108, issued by the Maine Department of Education, Office of Special Services and Inclusive Education, regarding court reporting and transcription services for special education due process hearings statewide. The procurement seeks proposals for verbatim written and electronic transcripts plus audio/digital recordings of special education administrative pre-hearings and hearings conducted throughout Maine, with delivery in multiple formats including hard copy, searchable PDF, and audio/digital recordings upon request. Services must be delivered within 21 calendar days of the last day of each proceeding. The RFP specified a questions deadline of August 3, 2026, and a proposals due date of August 17, 2026. The contract term runs from January 1, 2027, through December 31, 2028, with two optional renewal periods extending through December 31, 2030, and December 31, 2031, with one award anticipated.

The Q&A summary reveals critical operational details affecting pricing and service delivery: historical data shows an average of 1.8 hearings per year over the past five years, with average hearing lengths of 3.7 days and approximately 886 pages per hearing transcript. Hearing officers make determinations regarding in-person versus remote attendance using the agency's Zoom platform; vendors must demonstrate capability to provide both in-person and virtual services, which is mandatory for award consideration. The scope allows for recording-only and live transcription services. Qualified court reporters/stenographers must meet specific certification requirements listed in Appendix C of the RFP. No cancellation or no-show policy exists for hearings confirmed and subsequently canceled on short notice, and pricing does not account for such cancellations. An existing vendor currently provides these services. Evaluation criteria are weighted as follows: Organization Qualifications and Experience (40 points), Proposed Services (30 points), and Cost Proposal (30 points), with cost scored mathematically where the lowest bid receives 30 points.

Can you provide vendors with the estimated number of hearings per year expected for the next year, or the historical number of hearings?Year to year is unpredictable. Average over the past 5 years has been 1.8 per year, broken down as follows: FY22-0, FY23-2, FY24-1, FY25-3, FY26-3.
Can you provide vendors with the average hearing length? The average hearing length over the past 5 years is 3.7 days. The hearing lengths have ranged between 1 to 6 days broken down as follows: 1 day-1, 2 days-0, 3 days-4, 4 days-1, 5 days-2, and 6 days-1.
Can you provide vendors with the approximate number of attendees per hearing? This number varies according to how many witnesses are scheduled to testify on any given day and whether or not the hearing is open to the public. Regular attendees (up to 11) include the hearing officer, court reporter, possibly two attorneys for the parent(s), parent(s), two school district attorneys, one or two school district team members and the witness testifying. The hearing officer has other scheduled witnesses in a waiting room.
The RFP makes reference to in-person as well as remote attendance by the reporters. Who would make the determination as to whether reporters appear remotely or in-person? Is that the agency requiring it on a hearing-specific basis? Or the vendor wThe hearing officer makes the determination about a request for an in person hearing based on input from the attorneys. Prior to COVID, all hearings were in person, since then all of the hearings have been on the Zoom platform which is scheduled and controlled by our hearing officers.
For remote hearings is the vendor expected to provide a remote video hearing platform for the use of all parties? Or does the Department have a platform that they would prefer that reporters connect to?No, our hearing officers have Zoom accounts and schedule the daily hearing sessions, sending the appropriate parties the Zoom link.

Will the informational per-unit rates in the grey table (Table 26) become the actual billing rate schedule used for invoicing under the awarded contract, since real hearings won't always match the six Table 25 scenarios exactly? The services (scenarios) in the blue table of Appendix G (p. 28) are intended to be examples for evaluation purposes. The grand total in the Proposed Cost will be used for scoring the Cost Proposal section referenced in PART V, B 3 of the RFP.
