C - REQUIREMENTS / PERFORMANCE WORK STATEMENT
PART 1 GENERAL INFORMATION
1.1 Description of Services/Introduction
The Contractor shall provide the Department of Labor (DOL), Employment and Training Administration (ETA), Office of Job Corps (OJC) laboratory screening of Job Corps students for drugs of abuse, testing and identifying students who may have genital infections caused by Chlamydia, and testing and identifying students infected with the Human Immunodeficiency Virus (HIV). This includes supplying 121 Job Corps centers with all supplies and equipment necessary to collect blood and urine specimens, and to package and ship specimens to the lab, where they will be processed and analyzed. The Contractor shall report test results to all centers and inform centers and the Contracting Officer’s Representative (COR) of any problems encountered in the process.
In addition, the Contractor shall provide COVID-19 infection testing supplies and support including qualified personnel, equipment, tools, materials, supervision, and other related items and non-personal services.
The Contractor shall coordinate all work performed under the terms of the contract with the COR and shall be accountable for compliance with all Federal laws, regulations, and agency implementing policies, procedures, and directives applicable to work performed under the terms of the contract. The Contractor shall perform to the standards specified in this contract.
1.2 Background
Job Corps is a national residential training and employment program established to address the multiple barriers to employment faced by opportunity youth throughout the United States. The program provides comprehensive career development services to students, including academic, career technical training independent living skills, career readiness and success training, and employment support services. The unique combination of services provided in Job Corps is intended to prepare youth to obtain and maintain gainful employment, pursue further education or training, or satisfy entrance requirements for careers in the Armed Forces.
Each Job Corps center has health and wellness staff who provide students with basic medical care that includes managing chronic illness, promoting self-managed health care, and teaching preventive health education to encourage good wellness habits and prevent avoidable illness, injury and death.
Within 48 hours of the student’s arrival at the center, a cursory health evaluation is performed. Laboratory tests are a required part of the cursory health evaluation. Blood specimens are drawn for hemoglobin or hematocrit determination. These analyses shall be done on center or by an outside laboratory. A dip-stick type urine screening is done for sugar and albumin and additional tests are done in case of positive findings. Newly enrolled female students are given an immuno-chemical pregnancy test, a Pap smear if indicated, and a gonococcal infection test. Male and female students provide a specimen to check for Chlamydia that is sent to a nationally contracted laboratory.
The center physician may request additional tests to aid in differential diagnosis, observation, or treatment. If these additional laboratory tests are for HIV or Chlamydia, then the nationally contracted laboratory will perform the analysis.
Trainee Employee Assistance Program (TEAP)
Job Corps implemented a national program on biochemical testing, and alcohol and other drugs of abuse prevention and intervention.
The Trainee Employee Assistance Program (TEAP) mirrors workplace settings and incorporates the employee assistance model. The program incorporates mandatory components for students testing positive on entrance as well as voluntary programming for students who are assessed as at-risk and in need of additional support.
Drug testing information is one part of the comprehensive information that TEAP Specialists rely on to make clinical decisions and support students as they progress in the Job Corps program. Interventions are geared towards providing students with education, coping skills, and other support to cease their drug use. TEAP Specialists provide 15 hours/100 students/week to assess, diagnosis, and intervene with students with substance use issues.
1. All Contractors are advised by admissions counselors that Job Corps is drug free.
2. All students are tested for drugs within 48 hours after entry.
3. Students who test positive on entry are placed in the TEAP program which provides assessment, intervention, relapse prevention, education, and referrals as needed.
4. Students testing positive on entry have a follow-up test between 37 and 40 days so results are received on or before the 45th day after entry.
5. Students testing positive on the follow-up test are separated from the Job Corps program.
6. Students, where there is reasonable suspicion of alcohol or drug use on center, will be tested on suspicion at any time during their program enrollment and are separated if the suspicion drug test is positive.
7. All drug test specimens are sent to the nationally contracted lab.
Job Corps has a Zero-Tolerance policy that states students who test positive for substance use will face program sanctions, and possible separation from the program.
1.3 Objectives
To fulfill program requirements and provide the safest possible environment for all Job Corps students, the U.S Department of Labor requires clinical laboratory screening services for drugs of abuse, testing and identifying students who may have genital infections caused by Chlamydia, and testing and identifying students infected with HIV.
In addition, the Department requires a supply of Abbott ID NOW test kits for 121 Job Corps centers, sufficient testing supplies, technical support for the ID NOW machines, training Job Corps’ center wellness staff on using the ID NOW machines, training Job Corps’ center wellness staff on collecting specimens, preparing and submitting test result reports, and reporting all test results to the Office of Job Corps, and State and local health departments for all the centers.
1.4 Scope
The Contractor shall provide the services and supplies listed below and assumes responsibility for quality control of all laboratory procedures.
HIV Testing
The Contractor shall conduct initial and confirmatory HIV tests (4th Generation or latest industry standard). Requirements include providing 121 centers with centrifuges, sterile needles, vacuum tubes, overnight shipping supplies (e.g., insulated packages, envelopes, labels, dry ice, etc.) and other necessary equipment and supplies.
Toxicology Testing
The Contractor shall conduct laboratory screenings of Job Corps students for drugs of abuse. Requirements include providing 121 centers with collection kit supplies and equipment.
Chlamydia Testing
The Contractor shall conduct Chlamydia tests per contract year. Requirements include providing 121 centers with collection equipment and supplies.
COVID-19 and Influenza Testing and Supplies and Services
The Contractor shall provide Government approved COVID-19 and Influenza tests and supplies. Examples of such tests are Rapid Nucleic Acid Amplification (NAAT), Rapid Antigen, Polymerase Chain Reaction (PCR), and Rapid ID NOW Influenza (e.g., Abbott ID NOW or Abbott BinaxNOW). Based on fluctuations in COVID-19 and Influenza rates, the Government may adjust the quantities and types of tests needed and realign the budget accordingly.
The Contractor shall distribute COVID-19 and Influenza tests to 121 Job Corps centers as directed by NOJC. Requirements include ensuring on-schedule delivery from manufacturers and distributors, providing proper storage (post distribution), ensuring timely shipments to Job Corps centers as assigned by NOJC, accurately tracking shipment and expiration dates, and providing accurate and timely inventory and shipping reports to NOJC.
Administrative and Project Management Requirements
The Contractor shall participate in weekly meetings with the COR/NOJC to discuss deliverables, projects, and concerns. The Contractor shall also continuously work with NOJC to assess and determine training needs of center health and wellness staff. This includes, but is not limited to, developing and conducting training on accessing and navigating the lab reporting system, specimen collection, and transporting specimens.
Reporting Requirements
The Contractor shall submit weekly, monthly, annual, and ad hoc data reports that provide details and problems related to laboratory services provided under the awarded contract. Weekly reports are due each Monday, monthly reports are due within 20 days after the end of each month, and annual reports are due within 30 days of the end of Job Corps’ Program Year.
Technological Capabilities
The Contractor shall have a dedicated computerized and automated test request and result reporting system. At a minimum, the system will collect and report results and demographic information, generate and track accession numbers, and track and automatically re-supply inventory. The system must be certified HIPAA compliant with internal 128-bit SSL and 3 DES encryption.
The Contractor shall procure, install, and service all equipment. In addition, the Contractor shall work with the Job Corps Data Center (JCDC) on system requirements for back-end reporting and integrating test results into Job Corps’ CDSS Suite of Applications, as applicable.
The Contractor shall provide training and technical assistance to 121 centers on how to operate the system. The Contractor shall have the capability to securely receive confidential inquiries from center health and wellness staff.
Centers for Disease Control
The Contractor shall provide the Centers for Disease Control (CDC), via the COR, with pertinent statistics and test results during performance of the contract. The Contractor shall notify the COR of any CDC requests for aliquots of positive specimens.
1.5 Period of Performance
The period of performance shall be for one (1) Base Period of 12 months and four (4) 12-month option periods.
The Government reserves the right to extend the term of this contract at the prices set forth in Section B in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the Term of the Contract”.
1.6 General Information
Quality Control
The Contractor shall develop and maintain an effective Quality Control (QC) plan to ensure services are performed in accordance with this PWS. In this plan, the Contractor shall develop and implement procedures to identify, prevent, and ensure defective services are not ongoing. The Contractor’s QC plan is how they assure the Government their work complies with contractual requirements. At a minimum, the Contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1- Performance Requirements Summary. The Contractor shall revise and improve the QC plan based on input from the program office and the Contracting Officer. For this contract, the Contractor shall submit the first edition of the Quality Control plan by the end of the first month of contract award.
Quality Assurance
The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with performance standards. It defines how performance standards will be applied, the frequency of surveillance, and minimum acceptable defect rate(s).
Government Remedies
The Contracting Officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” for the Contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

Hours of Operation
Normal hours of operation are Monday through Friday, 8:00 am to 6:00 pm EST.
Place of Performance
The place of performance will primarily be the Contractor’s office/laboratory. However, travel may be required to Job Corps centers, regional offices; the U.S. Department of Labor Headquarters in Washington, DC; or other locations to be determined in the future.
Type of Contract
The Government anticipates award of a Time and Materials Contract.
Security Requirements
Not applicable.
Physical Security
If applicable, the Contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
Key Control
If applicable, the Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan.
Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer. NOTE: All references to keys include key cards.
Lost Keys
If applicable, and in the event keys (other than master keys) are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks. However, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the Government replaces locks or keys, the total cost of re-keying or replacing the lock, shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, the Government shall replace all locks and keys and deduct the amount from the monthly payment due the Contractor.
Key Use
The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees.
The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.
Lock Combinations
If applicable, the Contractor shall establish and implement methods of ensuring that lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.
Conservation of Utilities
The Contractor shall instruct employees on utility conservation practices. The Contractor shall be responsible for operating under conditions that preclude the utilities waste, which includes turning off water faucets or valves after using the amount necessary to clean equipment.

Post Award Conference/Periodic Progress Meetings
The Contractor agrees to attend any post-award conference convened by the Contracting Officer or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officers Representative, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance.
During these meetings, the Contracting Officer or Contracting Officers Representative will apprise the Contractor on how the Government views the Contractor's performance and the Contractor will apprise the Government of any problems. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
Contracting Officer Representative (COR)
A COR will be delegated separately.
Contract Manager
The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract.
Identification of Contractor Employees
All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

PWS – Performance Work Statement
Contracting Officer’s Representative (COR) – A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the Contractor.

PART 4 CONTRACTOR FURNISHED ITEMS AND SERVICES
4.1 General
The Contractor shall maintain a secure laboratory conducive to performing the work in this PWS. The condition of said laboratory shall be consistent with the level of security and privacy necessary to complete the tasks outline in the PWS.
4.2 Clearance
The Contracting Officer (CO) or Contracting Officer’s Representative (COR) shall excise full and complete control over granting, withholding, or canceling clearances for contract employees, if applicable. The CO or COR may grant temporary clearances to contractor employees. However, granting a temporary clearance shall not be considered a full clearance. It also shall not prevent, preclude, or bar withdrawal or termination of any clearances by the department.
PART 5 SPECIFIC TASKS & DELIVERABLES
5.1 Basic Services
The Contractor shall provide laboratory screening of Job Corps students for drugs of abuse, testing and identifying students who may have genital infections caused by Chlamydia, and testing and identifying students infected with HIV. In addition, the Contractor shall provide COVID-19 infection testing supplies and support including qualified personnel, equipment, tools, materials, supervision, and other related items and non-personal services. The Contractor assumes responsibility for quality control of all laboratory procedures.
Work Area 1 - HIV Testing
The Contractor shall conduct approximately 50,000 4th Generation HIV tests and 250 confirmation tests per contract year.
Requirements include providing 121 centers with centrifuges, sterile needles, vacuum tubes, overnight shipping supplies (e.g., insulated packages, envelopes, labels, dry ice, etc.) and other necessary equipment and supplies.
· Arrange for pickup of specimens from centers daily. Centers will, at the Contractor’s expense, send specimens by overnight delivery as scheduled by the Contractor and center. In addition, the Contractor shall arrange for pickup and delivery of specimens for repeat tests because of broken specimens, indeterminate results, or as requested by the center physician.
· Label all specimens submitted by centers to the lab in a manner devised by NOJC. The Contractor shall provide centers with instructions on how to label specimens with accession numbers, demographics (age, sex, race), center name, and reason for the test (e.g., entry, suspicion, intervention).
· Analyze and report all test results. Original specimens shall be analyzed within 24 hours (1 day) of receipt. If a 4th Generation HIV test is positive, a confirmation test will be done on the same specimen within 4 days of receipt.
· Provide an individual report of each positive, indeterminate, and negative test to the originating center using the laboratory’s reporting form. Individual test results shall be recorded as follows:
1. Negative 4th Generation HIV test
2. Negative HIV by confirmation test
3. Indeterminate HIV by confirmation test
4. Positive HIV by confirmation test
* Tests positive by 4th Generation HIV test and negative by confirmation test, report as in 2 above.
* Tests positive by 4th Generation HIV test and indeterminate by confirmation test, report as in 3 above and request a repeat test in 3 months.
* Initial positive 4th Generation HIV tests shall not be reported. Indeterminate tests, and positive 4th Generation HIV tests with positive confirmation tests shall be electronically reported to centers no later than 7 days after receipt of the specimen. Test results shall not be phoned in to center health and wellness staff.
* The term equivocal shall not be used in any report of test results
Work Area 2 – Toxicology Testing
The Contractor shall conduct approximately 60,000 laboratory screenings of Job Corps students for drugs of abuse per contract year.
Requirements include providing the following collection kit supplies and equipment to 121 centers within 30 days of contract award and as requested by centers and NOJC for the duration of the contract:
· Wide mouth collection cups with a volume capacity of 60 millimeters (ml) or greater with a temperature strip affixed
· Shatterproof specimen bottles with lids
· Self-adhesive labels for specimen identification
· Tamper and leak proof transport bags with absorbent material
· Crush resistant cardboard shipping containers
· Tamper evident/resistant seals
· Job Corps specific drug testing and control forms
The Contractor shall supply lab packs and prepaid air bill labels for shipping specimens overnight to the laboratory. Shipping supplies shall be provided to 121 Job Corps centers within 30 days of contract award and as requested by centers and NOJC for the duration of this contract. Also within 30 days of contract award, the Contractor shall contact each center and arrange schedules for sample collection and delivery to the lab.
The Contractor shall arrange for pickup of specimens from centers daily by a nationwide, overnight courier service that guarantees delivery to the lab within 24 hours of pick-up (within 48 hours for centers located outside the continental United States). Specimens shall be picked up from centers on a frequency determined by Job Corps centers or NOJC. Centers will, at the Contractor’s expense, send specimens by overnight delivery as scheduled by the center. In addition, the Contractor shall arrange for pickup and delivery of specimens for repeat tests due to broken specimens, indeterminate results, center physician requests.
The Contractor shall label all specimens submitted by centers to the lab in a manner devised by NOJC. The Contractor shall provide centers with instructions on how to label specimens with accession numbers, demographics (age, sex, race), center name, and reason for the test (e.g., entry, suspicion, intervention).
The Contractor shall analyze and report all test results. Original specimens shall be analyzed within 24 hours (1 day) of receipt. All samples that screen positive shall be confirmed by gas chromatography/tandem mass spectrometry (GC/MS). Results of samples that confirm positive shall be securely and confidentially transmitted, by electronic communication within 96 hours of receipt of specimens. All specimens received shall be tested for the 10 drug types listed below using the following cut off levels:

The Contractor shall provide each Job Corps center with a certified laboratory report for each individual specimen tested. This report allows centers to track and monitor individual students during their enrollment in Job Corps.
The Contractor shall analyze specimens for drugs and provide data indicating the specificity and sensitivity of the methods used. The level of specificity must be at least 94%, and sensitivity must be at least 83%. Quality control measures must be described. In addition, the Contractor should send at least one percent of the quality control specimens to a reference lab each month
Work Area 3 – Chlamydia Testing
The Contractor shall conduct approximately 50,000 Chlamydia tests per contract year. Requirements include:
· Providing sterile swab test packets, all equipment and supplies needed for collection and preparation of specimens, and labels, envelopes, shipping packages necessary to ship specimens from centers to the lab. Supplies and equipment shall be provided to 121 centers within 30 days of contract award and as requested by centers and NOJC for the duration of the contract.
· Receiving and processing specimens from 121 centers on an ongoing basis as scheduled by centers and NOJC. Overnight shipments to the lab are at the Contractor’s expense. Pick up of specimens from all Job Corps centers shall be done by an overnight courier service that guarantees specimen delivery to the Contractor within 24 hours of specimen pick-up (within 48 hours of pick-up for centers located in Alaska, Hawaii, and Puerto Rico.
· Labelling all specimens submitted by centers in a manner devised by NOJC. The Contractor shall provide centers with instructions on how to label specimens with accession numbers, center name, student name with age, sex, race, whether symptomatic or asymptomatic, and whether the test was taken as part of an entrance exam or afterwards.
· Analyzing and reporting all test results and processing all specimens with a Food and Drug Administration approved test using Amplified Nucleic Acid Methodology. Reports shall be available within 24 hours of receipt of specimen.
Work Area 4 - COVID-19 and Influenza Testing and Supplies Services
The Contractor shall provide up to 100,000 COVID-19 and Influenza tests and supplies per contract year. Examples of such tests are Rapid Nucleic Acid Amplification (NAAT), Rapid Antigen, Polymerase Chain Reaction (PCR), and Rapid ID NOW Influenza (e.g., Abbott ID NOW or Abbott BinaxNOW). Based on fluctuations in COVID-19 and Influenza rates, the Government may adjust the quantities and types of tests needed and realign the budget accordingly.
The Contractor shall distribute COVID-19 and Influenza tests to 121 Job Corps centers as directed by NOJC. Requirements include ensuring on-schedule delivery from manufacturers and distributors, providing proper storage (post distribution), ensuring timely shipments to Job Corps centers as assigned by NOJC, accurately tracking shipment and expiration dates, and providing accurate and timely inventory and shipping reports to NOJC.
Additional requirements include:
· Establishing and maintaining a database that contains COVID infection rates for all students; daily recording of all tests and results; providing NOJC and other stakeholders with weekly test results and ad hoc reports; and reporting all test results to the appropriate State and local health departments on behalf of each active Job Corps centers as required. The Contractor shall perform additional and appropriate test result analyses and reporting as assigned.
· Providing technical support for COVID-19 infection testing. This includes providing Pathologist oversight, as required, and quality control for all existing ID NOW test machines and test processes on Job Corps centers; providing technical assistance to center health and wellness staff as needed; scheduling ad hoc technical training for center health and wellness staff on using test machines;
creating, testing, and maintaining result verification procedures and protocols; and assisting with various emerging issues; making timely announcements on the contractor’s website after securing clearance from NOJC on subjects related to COVID testing requirements and processes; providing on-going technical assistance to Job Corps center practitioners by responding to emails and calls precisely, clearly, and within a required timeframe, and conducting timely follow-up as needed; replying to NOJC’s inquiries and requests within the agreed upon timeframe and with clear, comprehensive, and well-written responses.
· Providing regular reports and updates with clear and concise writing and comprehensive coverage of all elements specified by
NOJC.
Work Area 5 – Administrative and Project Management
The Contractor shall provide project management and maintain regular communication with NOJC/COR to ensure timely and quality completion of all project deliverables. This includes, but is not limited to:
· Meeting with the COR/NOJC on a weekly basis to discuss the status of deliverables and projects. The Contractor shall prepare meeting agendas and submit summary notes after each meeting/conference call.
· Ensuring project activities meet deadlines and are carried out efficiently
· Complying with Job Corps’ policies and regulations
· Providing the COR/NOJC with weekly updates and submitting weekly, monthly, quarterly, and year-end reports as required.
Work Area 6 - Reporting Requirements
The Contractor shall submit weekly, monthly, annual, and ad hoc data reports that provide details and problems related to laboratory services provided under the awarded contract. Weekly reports are due each Monday, monthly reports are due within 20 days after the end of each month, and annual reports are due within 30 days of the end of Job Corps’ Program Year.

The monthly Problem Report shall summarize any problems related to collection, confidentiality, analysis of specimens, reporting results to centers, center practices, corrective actions suggested or taken, etc.
Year-to-Date Report (Yearly)
The annual year-to-date report includes summary results for HIV, Toxicology, Chlamydia, and COVID testing.
Technological Capabilities
The Contractor shall have a dedicated computerized and automated test request and result reporting system. At a minimum, the system will collect and report results and demographic information, generate and track accession numbers, and track and automatically re-supply inventory. The system must be certified HIPAA compliant with internal 128-bit SSL and 3 DES encryption.
The Contractor shall procure, install, and service all equipment. In addition, the Contractor shall work with the Job Corps Data Center (JCDC) on system requirements for back-end reporting and integrating test results into Job Corps’ CDSS Suite of Applications, as applicable.
The Contractor shall provide training and technical assistance to 121 centers on how to operate the system. The Contractor shall have the capability to securely receive confidential inquiries from center health and wellness staff.
Centers for Disease Control
The Contractor shall provide the Centers for Disease Control (CDC), via the COR, with pertinent statistics and test results during performance of the contract. The Contractor shall notify the COR of any CDC requests for aliquots of positive specimens.
EDUCATION AND TRAINING
The Contractor shall provide educational and training services such as webinars and presentations, sometimes in conjunction with Job Corps meetings. The Contractor shall also provide ongoing technical assistance to Job Corps centers as needed.
LABORATORY QUALIFICATIONS AND REQUIREMENTS
The Contractor/laboratory shall meet or exceed the following personnel and laboratory requirements:
Personnel – Technicians, Technologists, Supervisors, and Directors of the laboratory must be licensed by the state in which the tests are performed. In the absence of state licensure requirements, they must be certified by a national certifying registry such as the American Society of Clinical Pathologists (ASCP). Personnel are required to participate in continuing education programs in addition to maintaining licensure.
Laboratory – The Laboratory shall have a Clinical Laboratory Improvement Act (CLIA) and College of American Pathologist (CAP) license for testing interstate samples for Chlamydia and HIV, and either a CLIA or Substance Abuse and Mental Health Services Administration (SAMSHA) certification for testing interstate samples for drugs of abuse. The Laboratory shall be licensed in the state in which testing is preformed and licensed in states that require licensure for testing specimens (e.g., New York, Florida, California, Pennsylvania, Maryland, and West Virginia (for HIV)). The laboratory shall be enrolled in a nationally recognized proficiency testing program such as the College of American Pathologists (CAP). In addition, the laboratory shall provide evidence of accreditation and a certificate of satisfactory performance during annual CAP inspections.
The Contractor shall comply with U.S. Department of Transportation (DOT) requirements related to urine toxicology testing and be certified by DOT to perform such testing. The Contractor shall offer a DOT 10-panel drug test that is consistent with Job Corps’ existing test formula.
The Contractor shall distribute phlebotomy needles in accordance with the Needlestick Safety and Prevention Act of 2001. Additional requirements include:
· A dedicated national portal or data processing system that provides individual results and statistical and demographic analysis and reports.
· A dedicated administrator and alternate to communicate with centers, orally and in writing.
· A means to notify center health and wellness staff of significant findings. Test results shall not be provided over the phone.
PART 6 APPLICABLE PUBLICATIONS
6.1 Publications Applicable to This PWS
As applicable, the Contractor shall produce and publish policy and advisory documents on their website on behalf of the Government.
The Contractor shall seek and secure input, review, and approval from the COR prior to publishing any such documents.

(a) Inspection/Acceptance. (1) The Government has the right to inspect and test all materials furnished and services performed under this contract, to the extent practicable at all places and times, including the period of performance, and in any event before acceptance. The Government may also inspect the plant or plants of the Contractor or any subcontractor engaged in contract performance. The Government will perform inspections and tests in a manner that will not unduly delay the work.
(2) If the Government performs inspection or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish and shall require subcontractors to furnish all reasonable facilities and assistance for the safe and convenient performance of these duties.
(3) Unless otherwise specified in the contract, the Government will accept or reject services and materials at the place of delivery as promptly as practicable after delivery, and they will be presumed accepted 60 days after the date of delivery, unless accepted earlier.
