About this file
This document is a Sole Source (Including Brand Name) Justification under Simplified Procedures for Certain Commercial Items (FAR 13.5) for the USDA/Animal and Plant Health Inspection Service (APHIS). The USDA proposes to enter into a negotiated sole source contract with QIAGEN to provide CLC Genomics software licenses, including CLC Genomics WB Premium Desktop, Network, Server, and Premium Suite. The estimated value of the base year and four option years is provided. The justification cites the statutory authority of 41 U.S.C 1901, noting that the CLC Genomics software is custom and only available from QIAGEN, who was specifically requested by the science and bioinformatics staff. No other vendor offers the desired workflows for microbial profiling, pathogen and outbreak analysis, and genome finishing. The Contracting Officer determined the pricing to be fair and reasonable based on historical knowledge and published price lists. No sources expressed written interest in the acquisition.
The related federal contract opportunity is a Notice of Intent to Sole Source the CLC Genomics Software Licenses to QIAGEN, LLC. The period of performance is a base year plus four option years. This is not a request for proposals or quotations, but instead an intent to issue a sole source award under FAR 6.302-1. Interested parties may respond by July 19, 2024 to identify their interest and capability.

USDA/Animal and Plant Health Inspection Service (APHIS), Acquisition Branch
2. The nature and/or description of the action being approved.
The USDA proposes to enter into a negotiated sole source contract with QIAGEN, using the simplified procedures for certain commercial items under Federal Acquisition Regulation (FAR) Part 13.5.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

4. The statutory authority permitting other than full and open competition.
41 U.S.C § 1901 - Simplified Acquisition Procedures up to $7.5 million, as authorized by FAR 13.500(a) and implemented by FAR 13.501(a).
5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The common challenges of today's ever-growing sample volumes demand efficient bioinformatics.
Yet a lack of well-integrated analytics for microbial genomics and single cell analysis leaves researchers and organizations with the burden of integrating and maintaining all the required tools for bioinformatics, statistics and visualizations to power their research.
The need for integrated analytics for research continuity is in high demand.
All analytics come fully integrated into one scalable and enterprise-ready solution that provides an alternative to CLI based open source bio-informatics tools. Data and sample-metadata management is included.
With ready-to-use workflows, bioinformaticians can shift the focus from data to discovery by providing preconfigured workflows that streamline processing of raw NGS data.
Researchers can focus on the interpretation of results, for example in the context of other samples or metadata.
The proprietary algorithms yield accurate results and are designed to save time and compute resources, and to be accessible to bioinformatics experts and non-bioinformaticians alike.
If this suite of software licenses is not purchased the NBAF bioinformatics staff will not be able to do pathogen discovery.
No other vendor offers the desired workflows for microbial profiling, pathogen and outbreak analysis, and genome finishing.
6. A description of efforts made to ensure offers are solicited from as many potential sources as is practicable.
This is custom software that is only available from QIAGEN, and is specifically requested by the science and bioinformatics staff.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The price will be evaluated against the customer’s historical knowledge and published price lists for the type of product/service.
8. A description of the market research conducted and the results or a statement of the reason Market Research was not conducted.
This is custom software that is only available from QIAGEN, and is specifically requested by the science and bioinformatics staff. Multiple surveys and interviews were conducted with the science and bioinformatics staff to determine if other open source or closed source software would be compatible. The determination is that no other software can replace CLC Genomics workbench suite offered by QIAGEN.
9. Any other facts supporting the use of other than full and open competition.
QIAGEN CLC Genomics Workbench Premium delivers tools and workflows for a broad range of bioinformatics needs for microbiome analysis, isolate characterization, functional metagenomics and antimicrobial resistance characterization.
With the use of CLC Genomics Workbench, bioinformaticians from a broad range of technical experience and competency can work on microbial profiling, to assemble and annotate high quality reference genomes for critical type strains.
With the CLC Genomics suite bioinformaticians can leverage whole genome analysis for an epidemiological outbreak investigation to include pathogen and outbreak analysis.
Because of the Isolate management feature, users can accurately type and characterize microbial isolates.
In addition users will be able to monitor outbreaks by tracking pathogen transmission back to the source using modern phylogenetic tools.
Because NBAF uses next gen sequencers that produce short read lengths and repetitive genomic regions they resolve in fragmented de novo assemblies. CLC Genomics offers a proprietary module "Genome Finishing Module" that improves results and converts contigs into high quality assemblies.
10. A listing of the sources, if any, that expressed a written interest in the acquisition.
None
11. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
No other vendor offers the desired workflows for microbial profiling, pathogen and outbreak analysis, and genome finishing.
