In order for the City to more comprehensively evaluate the digital products and/or services of the Company, please complete the questionnaire below regarding the Company’s compliance with Web Content Accessibility Guidelines (WCAG) 2.2 published by the World Wide Web Consortium (W3C). Disadvantaged Business Enterprise

Definitions:
Disadvantaged Business Enterprise (DBE): an entity owned or controlled by a socially and economically disadvantaged individual(s) who are of good character and citizens of the United States.
(a) Ownership or control. “Ownership” and “control” shall have the same meanings as set forth in 13 CFR 124.105 and 13 CFR 124.106, respectively. (See also 13 CFR 124.109 for special rules applicable to Indian tribes and Alaska Native Corporations; 13 CFR 124.110 for special rules applicable to Native Hawaiian Organizations).
(b) Socially disadvantaged individual. The undersigned Firm declares and stipulates that the bid/proposal submitted is made in good faith, without collusion or connection with any other person or persons bidding for the same work, and that it is made in pursuance of and subject to all the terms and conditions of the advertisement for bid/proposal, all of which have been read and examined prior to signature.
Submitting this bid/proposal will be taken by the City of Brighton as a binding covenant that the Firm will finish the project as follows:
The Firm agrees to commence the project work as agreed upon in the pre-project meeting with the City's Project Manager and shall be completed in the established timeline, as determined at the meeting. If, due to seasonally anticipated adverse weather conditions, the Firm is delayed at any time and such delay had a dilatory effect on the scheduled project or progress of the work by any cause beyond the control of the Firm as determined by the Project Manager, the Firm shall be entitled to an equitable extension of the Contract time. The Project Manager will work with the Firm to define an acceptable extension of time.
The City reserves the right to make the award based on the bid/proposal deemed to be the most responsive and responsible and to waive any informalities or reject any or all bids.
The City shall not pay the Firm for defective work and/or for repairs or additional work required for successful completion of the project. All work not specifically set forth as a pay item in the Contract shall be considered a subsidiary obligation of the Firm and all costs in connection therewith shall be included in the prices for the various items of work. Prices shall include all costs in connection with the proper and successful completion of the work, including furnishing all materials, equipment and tools, and performing all labor and supervision to fully complete the work to the City’s satisfaction.
Poor quality and workmanship shall not be paid for by the City of Brighton. Such work product must be removed immediately and replaced properly at no cost to the City.
All quantities stipulated in the Firm’s bid/proposal are approximate and are to be used only as a basis for estimating the probable cost of the work. The basis of payment shall be the actual amount of materials furnished and work done. The Firm agrees to make no claim for damages, anticipated profits, or otherwise on account of any differences between the amounts of work actually performed and materials actually furnished and the estimated amount of work.
The City reserves the right to increase or decrease the amount of work to be done on the basis of the bid/proposal unit price up to plus or minus twenty-five percent (25%) of the total bid/proposal. Prices in written form will govern over prices in figures.
By responding to the solicitation, the Firm agrees to the liquidated damages, if applicable and outlined within the solicitation documents.
Pursuant to the solicitation for the above named project, and being familiar with all contractual requirements therefore, the undersigned Firm hereby proposes to furnish all labor, material, tools, supplies, equipment, plant, transportation, services, and all other things necessary for the completion of the contractual work, pay all taxes and patent costs, and perform the work in accordance with the requirements and intent of the
Contract Documents, within the time of completion as set forth herein, for and in consideration of the included unit prices found on the Fee Schedule.
The undersigned hereby affirms that (1) they are a duly authorized agent of the Bidder, (2) they have read all terms and conditions and technical specifications which were made available in conjunction with this solicitation and fully understands and accepts them unless specific variations have been expressly listed in the bid/proposal,
(3) the bid/proposal is being submitted on behalf of the Firm in accordance with any terms and conditions set forth in this solicitation, and (4) the Firm will accept any awards made to it as a result of the bid/proposal submitted herein for a minimum of one hundred twenty
(120) calendar days following the date of submission.
