About this file

This Scope of Work document outlines a Phase I consultant engagement between the Colorado Public Utilities Commission (PUC) and the Regulatory Assistance Project to conduct a modernization study mandated by HB26-1326. The contractor is required to deliver an initial report by November 1, 2026, summarizing findings and recommendations across three primary tasks: baselining the current PUC organization's personnel structure, budget, and commissioner compensation; conducting comparative analysis of at least five similar-sized state utility commissions; and conducting initial scoping interviews with stakeholders including regulated utilities, intervenors, local government associations, and environmental groups. The initial report must be prepared in a professional format suitable for distribution to the Colorado State Legislature and stakeholders, with the definitive scope for the final report (due November 1, 2027) to be established upon completion and review of Phase I findings.

The contract specifies this as a sole source engagement, indicating the Regulatory Assistance Project was selected as the independent third-party consultant without competitive bidding. No specific pricing, budget allocation, or funding source is detailed within this SOW document. The study represents a legislative mandate under Colorado law requiring modernization recommendations addressing the PUC's personnel structures, organizational design, budgetary frameworks, and provisions for equity initiatives and intervenor compensation. The two-phase structure extends through November 2027, with Phase I completion establishing the foundation for Phase II scope development and final legislative recommendations.

MODERNIZATION STUDY OF THE COLORADO PUBLIC UTILITIES COMMISSION

August 26, 2026

Scope of Work for: Colorado Public Utilities Commission

Contractor: Regulatory Assistance Project

BACKGROUND AND OVERVIEW

The Colorado Public Utilities Commission is charged with ensuring safe, reliable and reasonably priced resources consistent with the social, economic and environmental objectives of the state. As a Division within the Department of Regulatory Agencies, the PUC is subject to a periodic “sunset review” by DORA’s Office of Policy, Research and Regulatory Reform. This review culminates in legislation to reauthorize the PUC and establish new requirements. This process was completed in 2025-2026 and resulted in HB26-1326 which reauthorized the Public Utilities Commission for an additional seven years and implemented a series of changes and requirements. One of these new requirements is Section 40-2-109.3 which requires a study to be conducted on “how to modernize [the PUC’s] personnel, organization and budgetary structures.” Per HB-1326, this study must be conducted by “an independent, third-party consultant” and developed in two phases:

1-An initial report, summarizing the initial findings and recommendations by November 1, 2026.

2-A final report, including any legislative recommendations, by November 1, 2027.

SCOPE OF PROJECT

Contractor shall serve as a consultant to the PUC and perform all aspects of Phase I of the study as described below.

Phase I: Baselining, Study Scoping, and Multi-State Comparison

1. Summarize the current PUC organization

a. Describe current personnel by section including nature of expertise, focus areas, staff size and vacancies.

b. Describe current Commissioner annual compensation and travel reimbursement allowances for travel to Denver.

c. Summarize the PUC’s total annual budget over the last five fiscal years separated by appropriations for personnel services, operations and overhead expenses.

2. Summarize items a. through c. for at least five Public Utility Commissions around the U.S. that have a similar regulatory scope, docket complexity and state population.

3. Conduct initial scoping interviews with stakeholders (e.g. regulated utilities, frequent intervenors, local government associations, environmental and other interest groups) on expectations for study focus and areas of concern. CO PUC will provide a list of entities and contact info for interviews.

4. Prepare an initial report in a professional format suitable for distribution to the Colorado State Legislature and stakeholders. Report shall summarize all information from tasks 1. through 3. and provide recommendations on how the next phase of the study should be conducted including provisions addressing equity initiatives and intervenor compensation.

The definitive scope for the final report will be established upon the completion and review of the initial findings and recommendations of the initial report, due by November 1, 2026.
