Sole Source Justification and Approval Under FAR 13.501

1. Contracting Activity: The Contracting Activity is the United States Army Medical Research Acquisition Activity (USAMRAA). The Requiring Activity is the Walter Reed Army Institute of Research (WRAIR).

2. Description of Action: The Logistics Department, WRAIR requires a modification to contract W81XWH18C0137, Chenega to provide custodial services to specified BioSafety Level (BSL) II rooms in Bldg. 508, HIV Testing Lab. This modification is for a firm fixed price endeavor using RDT&E funds from PR Number 11663149 in the amount of $17,592.36 for 2 months. The additional funding will be under a new purchase request funded by O&M dollars.

3. Description of Supplies/Services: The contractor, Chenega shall provide custodial services to specified HIV testing BSL II labs in building 508. The HIV testing labs require a higher level of service for the safety of employees, for delivery of clinical services, and to the specifications of College of American Pathology (CAP) accredited labs.

4. Authority Cited: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1)(ii), sole source under the authority of the simplified procedures for certain commercial items.

5. Reason for Authority Cited: Chenega is the only contractor capable of providing custodial services to BSL Level II labs. They are current contractors to WRAIR headquarters building 503 and have trained custodial personnel on site and capable of providing custodial services to BSL Level II labs. The labs are currently scheduled for CAP accreditation inspection within the next few months and have not received BSL Level II services.

6. Efforts to Obtain Competition: : No actions have been taken. Chenega was awarded contract, W81XWH19C0137, as a directed award under Federal Acquisition Regulation (FAR) subpart 19.8 (Section 8a) authority.

7. Actions to Increase Competition: No actions have been taken. Chenega’s contract is one of 2 custodial contracts performing at WRAIR. MVLE also provides custodial services under W81XWH20C0016 for WRAIR’s 5 outlying buildings, of which, Bldg 508 is one. MVLE is an AbilityOne contractor, under FAR subpart 8.7 authority. AbilityOne contractors employs individuals with severe handicaps. MVLE was queried as to their capability to perform custodial services in BSL labs. No response was provided to the Contracting Officer. Chenega, a certified healthcare environmental services contractor, can immediately provide trained personnel for these areas.

8. Market Research: These custodial services fall within the newly created Healthcare Environmental Custodial Services Professional Services Code (PSC) which require higher level services not ordinarily found with generic custodial services. BSL labs, which routinely handle dangerous pathogens, require very exacting processes and standards in order to maintain the health and safety of all in contact with these pathogens. Severely handicapped employees would put themselves and others at risk attempting to perform services in the BSL labs.

9. Interested Sources: Notices required by FAR 5.201 shall be published, and thatany bids or proposals received shall be considered.
