"For Official Use Only”
Sole Source Justification (SSJ) in accordance with FAR subparts 13.106 or 13.5 using
Simplified Acquisitions Procedures (SAP)
1. Contracting Activity: The Contracting Activity responsible for this action is the US Army Medical Research Acquisition Activity (USAMRAA), Fort Detrick, Maryland.
2. Requiring Activity: The US Army Institute of Surgical Research (USAISR).
3. Nature of Action:
Commercial Item Non-Commercial Item New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number
Pricing: Firm-Fixed Price* Time & Materials** Cost*
* See FAR 12.207(a) ** See FAR 12.207(b).
For Hybrid Contracts, list percentage of each type of pricing:
* Firm Fixed Price: ________
**Time & Materials: ________
* Cost: ________
Funds: RDT&E Operations and Maintenance, Army (OMA)
Other Funds:
Fiscal Year of Funds: ___FY16/17_____
Estimated Total Dollar Value including Options: ____________
4. Contractor Name:
Name of Proposed:
Contractor(s): Phoenix Research Labs Street Address: 6630 Owens Dr City, State, Zip: Pleasanton, California 94588 Phone: 925-485-1100
DUNS: 949114925
Cage Code: 5PBM4
5. Description of Supplies/Services: The USAISR has a requirement for a retinal imaging system (to include anterior segment adapter, anterior segment lens image guided OCT 2, image guided focal ERG, rat lens-ERG, with rat lens) that is capable of imaging the retina as well as the cornea of rodents, to include mice, rats and guinea pigs.
The sole source manufacturer capable of meeting the Government’s requirements is Phoenix Research Labs, Pleasanton, California. It is estimated that the total value will be approximately.
6. Authority Cited: 41 U.S.C. 1901 OR 41 U.S.C. 1903
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 13.501(a)(1)(i): Only one source reasonably available (including brand name); OR
(d) FAR 13.501(a)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item.
7. Reason for Authority Cited: The market offers very few imaging systems that are made specifically for rodents. Phoenix Research Labs’ Micron IV is the only system on the market that offers the required modularity, including the Anterior Segment (Slit Lamp) System and Image-Guided OCT module required by protocol A-15-028.
The Micron IV Retinal Imaging system combines multiple instruments on one platform to address multiple application needs - including retinal imaging, angiography, fluorescent imaging, Image-Guided OCT and anterior segment (slit lamp) such that all of the applications can be performed with one animal model under one sedation. No other commercially available platform designed for small animals can accomplish these applications. Other vendors combine systems designed for humans and adapt them to rodents, which results in data which is not designed for rodent research.
8. Efforts to obtain Competition: No efforts will be made to solicit offers from as many potential sources as is practicable as there is only one source that is capable of providing the required equipment, given that no other system available meets the MECs of the Micron IV.
a. Effective competition. No competition is anticipated for this acquisition as Phoenix Research Labs is the only manufacturer and distributor of the required retinal imaging system.
b. Subcontracting competition. No subcontracting opportunities are exist for this effort.
9. Actions to remove or overcome barriers Competition: A Request for Information (RFI) was posted to FebBizOps (FBO) for 7 days, to which no responses were received.
A Notice of Intent (NOI) to sole source this requirement will also be posted to FBO for an additional 15 days.
10. Market Survey: Web-based market found one company (Imedos) that produces a VISUALIS- rodent Fundus Imagining system. This system is a fundus camera for rodents only that does not have the capabilities of the Micron IV system. The Micron IV system allows for modularity that the VISUALIS- rodent Fundus Imagining system does not including the Anterior Segment (Slit Lamp) System and Image-Guided OCT module. The current protocol that this system will initially be utilized for requires both of these modules, especially the Anterior Segment (Slit Lamp) System for our corneal studies. There are no other potential sources that meet the capabilities of the Micron IV, meet our minimum MECs, or have the capabilities required to complete our study.
Additionally, a RFI was posted to FebBizOps (FBO) for 7 days, to which no responses were received.
11. Interested Sources: Phoenix Research Labs, there are no other potential sources that meet the capabilities of this acquisition.
