About this file

This document is a Sole Source Justification Memorandum for the procurement of NGD-9 liquid polymer from Goodrich Corporation. The Naval Surface Warfare Center Carderock Division (NSWCCD) requires 1,800 lbs of NGD-9 A side and 882 lbs of NGD-9 B side for material sample fabrication, with an estimated total value including polymer, DMA test fee, and heated freight truck delivery. The procurement is being conducted on a sole-source basis due to the proprietary nature of the polymer, which provides acoustic modification and protection for Navy vehicle surfaces and took over seven years to develop.

The solicitation (N0016726Q1023) allows interested parties to submit capabilities statements by 12:00 PM on December 9, 2025, though the government retains discretion to proceed with the sole-source award to Goodrich Corporation. The procurement falls under NAICS code 325520 for a business with 550 employees, and will be executed using Simplified Acquisition Procedures with a firm fixed-price purchase order. The justification emphasizes the unique characteristics of the NGD-9 compound, highlighting that developing an alternative would require significant time and financial investment.

MEMORANDUM FOR FILE

FROM:

CODE:

TO:Code 02
DATE:21 NOV 2025
SUBJECT:Non-Competitive Procurement Justification Memo for Actions Under SAT

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer

3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE

Purchase liquid polymer consisting of 1,800 lbs (4 55-GL drums) of NGD-9 A side and 882 lbs (2 55-GL drums) of NGD-9 B side for material sample fabrication to be used at Acoustic Research Detachment and Naval Underwater Warfare Center. Estimated value of this procurement is $ including the polymer material, DMA test fee, and heated freight truck delivery.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025

☒ 1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

NGD-9 liquid polymer is a classified proprietary formulation owned and sold by Goodrich/Collins Aerospace. This polymer provides acoustic modification and protection on Navy vehicle surfaces. The formulation has been verified and used by the Navy vehicle community for years and would require many years and copious amounts of money to find a replacement material to use in its stead. The previous research phases to formulate this specific compound took over seven years and has an estimated cost over $ .

· 2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

· 3. Other Reasons.

· 4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)

· a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

· b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

· c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

IV. CERTIFICATIONS & APPROVALS
