About this file
This memorandum details a sole source justification for preventative maintenance and calibration services on an engine titanium scanning system. The Army Contracting Command at Corpus Christi Army Depot seeks these services for a base year plus two option years from Union Western Technologies, the original equipment manufacturer. The proprietary software and integrated system components require the expertise of Union Western to perform necessary repairs, calibrations, and software updates critical to equipment operation and ensuring safety of flight. Corpus Christi Army Depot maintenance teams lack the specific training and certifications to support this sophisticated laboratory equipment used daily in production. The contracting officer has determined the anticipated costs to be fair and reasonable based on price analysis, and approved the justification to limit competition subject to funds availability and authorization of the acquisition.

4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited: The Justification of the purchase of PM and Calibration for the ETC2000 Scanning System service from United Western Technologies for the ETC-2000 Scanning Systems B/C: M5164 is based on the highly sophisticated nature of the critical NDT laboratory equipment. This equipment is utilized daily in support of the depot production shops to provide sound and functional aircraft parts to the war fighter.
The equipment was purchased from and installed by United Wester Technologies. It contains proprietary software and integrated components that cannot be serviced by CCAD personnel or other contract sources.
The software is required for equipment calibration and operation. Service updates and preventive maintenance are necessary to prevent safety of flight issues and critical system failures related to mandatory analytical procedures. CCAD does not have the expertise or the qualified personnel to perform the repair and calibration services required for this equipment.
6. Publicizing Contract Actions: Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A), Action is NOT a brand name restriction and is under $150K, no posting required.
7. Market Research:
Dates Conducted: 09 May – 13 September 2023 by Gilbert Sanchez and Terry Clark, Contract Specialist.
Market research, in accordance with FAR Part 10, was conducted through the following methods:
Discussed with knowledgeable persons in Government and/or industry regarding the commercial nature of this requirement and/or standard industry practice in this area of supplies/services: Mr. Sanchez served as the Contracting Officer Representative (COR) on previous service contract to Uniwest Technologies for the ETC 2000 Scanning System.
Discuss publications of a formal request for information: Mr. Sanchez contacted Mr. Kevin Mernaugh, CCAD Supervisor Engine NDT Branch, May 2023; and he discussed if any other know contractor can perform the preventative maintenance (PM) and calibration. Mr. Sanchez also contacted Burt Goranson, United Western Technologies Corp., Engineer May 2023, and he discussed if any know contractor can perform the PM and calibrations. Mr. Sanchez learned that Uniwest Technologies holds these proprietary rights. CCAD Maintenance Teams do not have the specific training and certifications to calibrate, troubleshoot, nor adjust, or repair the ETC 2000 Scanning System.
Discuss the review of Government and/or commercial databases for relevant information. Identify database(s) and when reviewed: Mr. Sanchez performed market research on the previous service contract which is a base year and 2 option years.
Uniwest Technologies holds the proprietary rights and the technical date for the factory service which is imperative to maintain. CCAD Maintenance Teams do not have the specific training and certifications to calibrate, troubleshoot, adjust, or repair the ETC 2000 Scanning.
Discuss other types of Market Research (not mentioned above) and date performed.
On 19 September 2023, the Contract Specialist performed market research utilizing the search engine Google and did not find any other company that can perform this service.
