J&A Number: 20-0460
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity:
Naval Air Warfare Center Weapons Division (NAWCWD) China Lake, CA
2. Description of the Action Being Approved:
This Justification and Approval (J&A) authorizes and approves on a sole source basis the issuance of an Indefinite Delivery, Indefinite Quantity (IDIQ) type contract to Webbege, Inc.
(Doing Business As (DBA): Cronos Consulting Group), 7851 Mission Center Ct #108, San Diego, CA 92108.
3. Description of Supplies/Services:
This IDIQ will provide for the procurement of Information Technology (IT) Infrastructure products, services and solutions for new temporary shelters and repurposed buildings required aboard the installation due to the catastrophic damage to existing structures caused by the July 2019 earthquakes which have displaced mission critical personnel. The contractor will provide a wide range of IT infrastructure products, services and solutions covering the full spectrum of NAWCWD operations and missions. The products and services provided will include, but are not limited to, hardware, software, networking, technology devices, security, voice, video and data communications, mainframes, client/server, web-based applications, and system solutions consisting of both commercial-off-the-shelf (COTS) and custom built equipment.
Estimated Dollar Value in Thousands
FY 21 Total
Total $13464 K
4. Identification of Statutory Authority:
10 U.S.C. 2304(c)(2), Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority:
In July of 2019, two major earthquakes struck Naval Air Weapons Station (NAWS) China Lake, CA (of which NAWCWD is a principal tenant) causing catastrophic damage to the physical and technological infrastructure. To date, the installation remains only partially mission capable and is unable to fully perform in multiple Department of Defense research, development, and testing areas (e.g., battlespace integration, airborne electronic attack, aircraft survivability, counter-improvised explosive devices, directed energy, robotics, and energetics). Specifically, in Fiscal Year 2019, the command lost approximately $44 Million in revenue and is projected to lose approximately $37 Million in revenue in Fiscal Year 2020. The loss in revenue is attributed to the loss of interconnected laboratories and facilities that support the Research, Development, Test and Evaluation of current and evolving technologies as it relates to National Defense. The total projected loss due to natural disaster is approximately $81 Million and potentially more if mission critical communications are not restored within scheduled milestones.
In order to return the installation to a fully mission capable status as quickly as possible, NAWCWD has procured temporary facilities under the authority provided in Class J&A 20-0034 and has begun repurposing old facilities (e.g. vacant on-campus schools). These facilities require immediate implementation of IT Infrastructure solutions to restore the ability to perform mission critical activities, without such, the new and repurposed facilities would be rendered useless.
The Government faces two limiting factors to potential sources: Department of Defense IT Infrastructure Security restrictions and implementation lead time constraints.
Due to the sensitive nature of IT Infrastructure capabilities for Department of Defense use, requirement. According to the National Institute of Standards and Technology (NIST) Special Publication 800-53, Revision 4, Security and Privacy Controls for Federal Information Systems and Organizations, the acquiring agency is required to ensure vendors adhere to necessary supply chain safeguards. With previous relevant experience (Ref. Contract #N6893619C0069) it is with an extremely high level of confidence, this vendor will fulfill the like requirements of this acquisition. These restrictions limit the number of firms which are able to provide IT solutions.
Due to the time restrictions associated with this procurement, it is only practicable for the Government to engage those companies with known experience complying with the stated security restrictions.
Secondly, based on the China Lake Earthquake Integrated Product Team Integrated Master Schedule for temporary and rehabilitation efforts aboard the installation, the first of many temporary facilities discussed above must be fully outfitted by 1 October 2020. The Government has determined that the implementation of the full IT Infrastructure solution for the first facility must be complete within 30 days after receipt of order.
For the reasons stated above, the Government has determined that an unusual and compelling urgency exists for this requirement. Under FAR 6.302-2(a)(2) when an unusual and compelling urgency exists, the agency need not provide for full and open competition and is permitted to limit the number of sources from which it solicits proposals if a delay in award of a contract would result in serious injury, financial or other, to the Government.
6. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable:
As a part of its Market Research, the Government contacted several vendors to determine their capability to meet the implementation lead time requirement; however, none of the vendors contacted, other than Cronos Consulting Group, were able to offer a solution that met the
Specifically, lead times and inventory that align with the critical path delivery schedule of the China Lake Earthquake Recovery Integrated Product Team Integrated Master Schedule.
In order to have these buildings fully mission capable by the required date, this contract must be awarded no later than 1 September 2020. Considering the procurement action lead time associated with a contract of this size, complying with the required synopsis timelines as stated in solution by the need dates identified above. Thus, in accordance with FAR 5.202(a)(2), a synopsis will not be provided.
For the reasons stated above and considering the overall urgency of the requirement, it is reasonable to limit the competition for this requirement to only Cronos Consulting Group.
7. Determination of Fair and Reasonable Costs:
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal and sufficient information to support the accuracy and analysts, cost analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competitions:
Future contracts for this requirement, beyond the emergent needs discussed in this document, are planned to be competed. A competitive acquisition for follow-on requirements is estimated to occur in FY 2022.
