DEPARTMENT OF THE NAVY
NAVAL SURFACE WARFARE CENTER
CORONA DIVISION
PO BOX 5000
CORONA, CA 92878-5000
JUSTIFICATION AND APPROVAL
IN REPLY REFER TO
J&A No. 50,229 Ser 02/2632
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.
2. Description of the Action Being Approved
Award of a Firm-Fixed-Price, Indefinite Delivery Indefinite Quantity contract on a sole source basis to King Nutronics Corporation (King), for the purchase of King 3689A Precision Pressure Standard Systems (PPSS). Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies/Services
The Corona Division, Measurement Science Department (MS), in support of the Naval Sea Systems Command (NAVSEA) Metrology and Calibration (METCAL) Program, has a requirement for up to a maximum of 50 King PPSS, part number (P/N) 3689A to support Naval Aviation Fleet Intermediate Calibration Activities, Fleet Training Activities, and Navy Calibration Laboratories. The King PPSS will be procured over a three-year ordering period.
The total estimated value of this acquisition is and will be funded with Other Procurement, Navy (OPN) funds. The table below depicts the type of funding as well as the estimated amount per fiscal year.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by Federal Acquisition Regulation (FAR) 6.302- 1(a)(2).
5. Rationale Justifying Use of Cited Statutory Authority
NAVSEA METCAL currently utilizes the King 3689A PPSS in over 22,000 annual calibration hours in support of calibrating digital pressure gauges, engine flow test standards, missile test sets, precision barometers, waveguide test adapters, and engine test sets. In accordance with OPNAV Instruction 3960.16B, NAVSEA METCAL must maintain a false acceptance of less than 2% for all calibration support equipment. This false acceptance requirement is necessary to ensure that all pressure devices across the Navy function properly. In order to meet this false acceptance standard, the Government’s requirement for a PPSS must be four (4) times higher than the calibration support equipment being calibrated. The King 3689A is the only PPSS with a test uncertainty ratio of 4:1, which meets the minimum requirement in accordance with OPNAV Instruction 3960.16B. If a PPSS without this false acceptance ratio were procured, it would cause hydraulic and pneumatic pressure systems on ships and submarines to fail.
The King 3689A is used in at least 113 Instrument Calibration Procedures (ICPs). The procurement of an alternative PPSS from a manufacture other than King would require testing, verification, and revisions to the current ICPs. The ICP developmental costs would require an engineering analysis, engineering certification, interval analysis, publication, and database element support. The estimated cost to develop each individual ICP, if an alternative PPSS was procured, is The estimated cost for selecting an alternative calibration standard would be at least ).
Subsequently, a support suite used to calibrate a PPSS other than the King 3689A would need to be purchased. The support suite used to calibrate a new PPSS would include a precision manometer, a dead weight tester, a high pressure dead weight tester, an intensifier, and a regulator parts kit. Currently, Ser 02/2632
NAVSEA METCAL utilizes three support suites in support of calibration efforts. The estimated cost for each support suite with the required capabilities is , or a total cost of . The total cost to develop new ICPs and purchase new PPSS calibration support suites would equal of the total estimated value of this procurement.
In addition to the increase in procurement cost to develop new ICPs and procure additional support suites for a PPSS other than the King 3689A, a loss of time to fielding would occur within the fleet. Each pressure measurement ICP will take up to four
(4) months to develop from start to issuance. Taking into account the 113 ICPs, this equates to a 452 month total delay.
Number of ICPS Number of Months per
ICP
Total Number of Months to modify ICPs 113 ICPs 4 Months 452 Months
The Government would be able to assign three (3) engineers to support this effort, who would be able to modify three (3) ICPs at once, reducing the time from 452 months to 50 months ((452 months ÷ 3 engineers) ÷ 3 ICPs per engineer).
For the reasons discussed above, there is a reasonable basis to conclude that the agency’s minimum needs can only be satisfied by unique supplies available from only one supplier with unique capabilities.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted to determine if a PPSS capable of meeting the Government’s requirement was available in the commercial market place. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal any sources for the requested equipment other than King, the original equipment manufacturer. The market research that was conducted revealed that King produced the only PPSS capable of meeting the Government’s minimum requirements.
Ser 02/2632
A Sources Sought Notice (SSN) was posted on beta.SAM.gov website, indicating the Government’s intent to sole source this requirement to King. The posting was issued on 26 March 2021 and closed on 12 April 2021. At the close of the SSN, no responses were received from Industry.
Additionally, market research was conducted to verify if King has authorized distributors or resellers with the ability to provide the King 3689A. An email was sent to King on 14 April 2021 requesting information on any authorized distributors or resellers with the ability to produce the King 3689A. An email response was received on 14 April 2021 verifying that King works directly with the Department of Defense, and does not have authorized distributors or resellers with the ability to provide the King 3689A. Therefore, this item is peculiar to one manufacturer, and market researched shows that King does not have any authorized distributors or resellers with the ability to provide the King P/N 3689A.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the items covered by this J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, Corona Division has no plans at this time to compete future requirements for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
