International Agreement Competitive Restrictions ( IACR)

I. Agency and Contracting Activity.

II. Nature and/or description of the action being approved.

A. In accordance with FAR 6.302-1- 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, the United States Air Force will issue a Single-Award Firm Fixed Price (FFP) contract to procure FMS assets in support of Project Stoker - Tranche 5, for (15) each

P/N 67A314D17, CHOCK RAILS, NSN 1730-00-461-1521.

B. Contemplated Contract Type: This contract will be a one-time purchase that will be satisfied upon delivery.

The contracting arrangement will utilize Firm-Fixed-Pricing (FFP) Contract Line Item Number (CLIN).

C. The maximum dollar value of the total estimated orders is $20,000.00. Requirements will be procured with USAF BP3011 (Procurement Ammunitions) appropriated funds.

III. Description of supplies/services required to meet agency needs (including the estimated value).

A. Under this class J&A, the DeVal Lifecycle Support Company to procure P/N 67A314D17, CHOCK RAILS, NSN 1730-00-461-1521, FMS assets in support of Project Stoker - Tranche 5.

i. This is for parts only and there will be no technical support required.

B. Total combined USAF Section III: $20,000.00

IV. Statutory authority permitting other than full and open competition.

10 USC 2304(c)(1) as implemented by FAR 6.302-1: There are 2 manufacturer part numbers associated with this NSN. None of the associated part number(s) are considered obsolete. The manufacturer part numbers were originally supplied by one supplier. Today, one supplier is listed as an Active supplier for this NSN; the DeVal Lifecycle Support Company.

V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).

A. CHOCK RAILS, P/N 67A314D17, NSN 1730-00-461-1521 - there are 2 manufacturer part numbers associated with this NSN.

None of the associated part number(s) are considered obsolete. The manufacturer part numbers were originally supplied by one supplier. Today, one supplier is listed as an Active supplier for this NSN; the DeVal Lifecycle Support Company.

B. This action is for efforts in support of Ukraine and falls under the class deviation - temporary Authorizations for Covered Contracts Related to Ukraine; FAR 6.302-2 "Unusual and compelling urgency." FAR 13.106(1)(b) is also applicable as it is soliciting from a single source for purchases not exceeding SAT. Due to the urgent requirement of this purchase, the JDAM SPO cannot go through DLA due to a lack of having a DoDAAC, and the time it takes to generate one for a one-time, low-cost purchase is prohibitive. The DLA has also denied the JDAM SPO with the Technical Data Packet (TDP) to perform a competitive bidding process. In addition, this part was originally developed and purchased by the US Navy. All attempts to work through their Contracting team to purchase this part via a Navy contract and transferring funds accordingly, were rebuffed and ultimately unsuccessful.

C. Therefore, the JDAM SPO has determined that because the DeVal Lifecycle Support Company already has the TDP and has provided the part requested in support of previous contract(s), it is the only company capable of providing the part requested above described in Section III above without the USG experiencing further unacceptable delays in fulfilling procurement requirements.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under FAR 5.202 applies.

In accordance with 15.403-4(a)(1), the submission for certified cost or pricing is not required as it falls below the threshold of $2,000,000. In accordance with FAR 15.404-1(a)(2), price analysis shall be used when certified cost or pricing date are not required.

The JDAM System Program Office (SPO) researched alternatives and/or other manufacturers for the part number listed above. There are 2 manufacturer part numbers associated with this NSN. None of the associated part number(s) are considered obsolete. The manufacturer part numbers were originally supplied by one supplier. Today, one supplier is listed as an Active supplier for this NSN; the DeVal Lifecycle Support Company. The DeVal Lifecycle Support Company is also certified as a Small Business Administration (SBA) certified HUBZone company.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

There are 2 manufacturer part numbers associated with this NSN. None of the associated part number(s) are considered obsolete. The manufacturer part numbers were originally supplied by one supplier. Today, one supplier is listed as an Active supplier for this NSN; the DeVal Lifecycle Support Company. The DeVal Lifecycle Support Company is also certified as a Small Business Administration (SBA) certified HUBZone company. Historical data shows pricing from $1,403.16 to $2,338.61.

Current pricing provided by the DeVal Lifecycle support Company is $1,303.68.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A. Because of the critical nature of the request FMS assets in support of Project Stoker - Tranche 5 stockpiles, Section VI, Section VII, and that this is the one-time buy, it was determined that there were no other manufacturers able to produce the part(s) requested. See Section V.

B. After review of the current market, no other United States manufacturers have been determined to meet the outlined capabilities within the cost and timelines established.

C. IAW FAR Part 10, AFLCMC/EBH Engineering continues to conclude that there are no commercial items or non-developmental items available that could be modified to satisfy agency needs.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The USG does not have adequate data deliverables or rights to pursue a fully competitive strategy for the requirements described. See Section V.

X. List of any sources that expressed, in writing, an interest in the acquisition.

See Section VI above.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

There are no major barriers to competition, but there is only one active supplier.

XII. Certification by the Contracting Officer.

The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. Certification by the technical/requirements personnel.

By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2(c).
