About this file

This document is a justification for other than full and open competition under simplified acquisition procedures. The United States Coast Guard Aviation Logistics Center Short Range Recovery Division requires the procurement of eight hoist hooks with an optional quantity of sixteen. The hoist hooks are to be utilized on MH-65 aircraft. The procurement is restricted to Aerial Machine and Tool Corp as the original equipment manufacturer of the proprietary part, which incorporates a slide locking mechanism prohibiting the hoist hook from becoming unhooked during operations. Market research determined Aerial Machine is the only qualified source that can fulfill the requirement as the OEM and sole possessor of technical data required.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.

STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE

INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE AUTHORITY AND TYPE OF JUSTIFICATION.

The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Short Range Recovery (SRR) Division has a services requirement to be procured on a sole source basis utilized on the MH-65 helicopter.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. This procurement is for the procurement of Eight (08) Hoist, Hook Reset, (PN: AMTC-R2022-2, NSN: 1680-01-HS3-0947), to be utilized on the MH-65 aircraft. With an optional quantity of Sixteen (16).

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES

CAN BE USED. This acquisition is restricted to the only source of supply known to have the capability of furnishing the required supplies. Aerial Machine and tool Corp, Cage Code (70133), is the original equipment manufacturer for the piece part referenced. Because the Coast Guard has, a specific requirement for the hoist hook to also incorporate a slide locking mechanism, which prohibits the hoist hook from becoming un, hooked during hoisting. This requirement is restricted to the only known approved source whose proprietary manufacturing capabilities incorporate a restricting slide lock and is the only source capable of suppling the required quantities needed to support USCG missions.

Because of the aforementioned proprietary restrictive requirement, the USCG is unable to solicit for an alternate source of supply capable of suppling hoist hook with an inclusive slide locking mechanism. Furthermore, the Government does not have adequate data or lacks rights to data, and it is not economical to buy the data or rights to the data.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL

SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). The spare parts listed for procurement under this acquisition are highly specialized parts, designed and manufactured by a non-Government activity Specifically for the

USCG G366 platforms hoist assembly. The hoist hook, reset is designed to lock the hoist hook with a slide lock that allows the swimmer or crew to manipulate the lock with a slide motion that allows the hook to be easily affixed and removed to the rescue basket during rescue operations. The USCG has also incorporated it for use at night or during limited visibility with the addition of a high visibility paint that can easily be seen at night or when the rescue swimmer is in the water. Technical data required for procurement by other than the OEM or an OEM approved source is not available. The original manufacture of this part is Aerial machine and Tool Corp, cage (70133) and is the only USCG source of supply. Because of the OEM’s proprietary data restrictions soliciting from other than the OEM or a USCG approved source will compromise the safety of flight for the aircraft and the crew. The solicitation and resulting purchase order will require all materials repaired to have clear, documented traceability to the repair source and a completed Certificate of Conformance, certifying compliance with this contract condition, in accordance with FAR clause 52.246-15, Certificate of Conformance, which will be incorporated.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

Market research has determined that Aerial Machine has maintained their status as the only source qualified to fulfill this requirement. In that they are, the only OEM authorized manufacturer with the proprietary data approved by the USCG to perform the work, the technical expertise to interpret the data, and the ability to solve technical problems, all of which are vital for the continued operational readiness of the aircrafts rescue hoist cable and hook assembly. However, the USCG will accept quotes for these items from the OEM or any OEM approved authorized repair facility.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. The USCG did not purchase data rights as part of the initial system acquisition of the H65 aircraft. The USCG does not possess adequate technical descriptions to provide to potential new sources and is unable to provide proprietary information to outside vendors. This information must be obtained directly from the OEM. Due to the maturity of the H65 platform, the cost to procure data rights, presuming they would be made available, would be cost prohibitive.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. Although the government has not been willing to bear the cost of procuring the necessary OEM data for this service, USCG ALC SRR still continues to check maintenance and repair web-based subscription services, alternate approved systems, industry periodicals, and sends representatives to various trade shows and conferences to seek out all possible legally achieved service options and sources.
