The services provided under contract W564KV-18-C-0004 are currently being re-competed with an anticipated award time-frame of January/February 2021. The new contract will consist of a Base period of 12-months and 4 Option periods of 12-months each for a total contract period of 60-months at full performance. The requirement will also consist of a 2-month Phase-in period to ensure that the awarded contractor is capable of assuming the service with no degradation in performance upon takeover. In order to mitigate risk, a 3-month Bridge contract is required for the period of 10 February 2021 through 10 May 2021 to ensure a smooth transition to the new contract.
In accordance with FAR 6.302-1(a)(2), the supplies or services required are only available from a limited number of responsible sources. However, while the re-compete and original contract were awarded under full and open competitive procedures, it has been determined that it would not be economically feasible to compete a 3-month contract based on the “time constraints” associated with a competitive award as well as the limited period of performance between the expiration of the current contract and the start of the follow-on contract.
Additionally, the manpower associated with conducting a solicitation, which may include a source selection panel, will result in the duplication of costs that are not expected to be recovered by the Government. Moreover, unacceptable delays may occur due do to the onboarding of a new company and the loss of expertise in the event that the incumbent is not the awardee. It may also be difficult to find a company that will make a business decision to participate in a “short-term” 3-month contract based on internal cost factors such as recruiting, hiring, training and the issuance of benefits while insuring that their new employees can meet the qualifications specified for each position. It is also worth noting that most companies that provide outsourcing services do not retain excess employees on staff, but hire them in accordance with the work that they acquire. The short performance period for this requirement may make it difficult for the awardee to hire employees who are seeking full time and/or long-term employment.
The process may also be hindered by newly mandated Covid 19 procedures that result in lockdown issues such as contractor personnel being out of the office, closures, or delays that potential sources may have in obtaining qualified employees to perform the contract.
(b) Alternatives: No feasible alternative exists to satisfy the agencies needs in a timely or cost effective manner.
