About this file

This document is a brand name justification for a federal contract opportunity to procure land mobile radio mobile and portable radio equipment from Motorola for the Department of the Interior Bureau of Indian Affairs Office of Justice Services. The estimated value of the proposed contract action is over $150,000. The justification cites that Motorola equipment is utilized by all OJS Districts currently to provide public safety communications interoperability with BIA Law Enforcement Officers, and utilizing a different brand would require retraining officers and incur additional costs for technician training, new accessories, programming equipment, and could pose safety risks during law enforcement encounters. The contracting officer determined the anticipated cost to the government would be fair and reasonable based on two recent contracts awarded to Indian-owned small businesses for similar land mobile radio purchases. The related federal contract opportunity is a 100% Indian Economic Enterprise set-aside solicitation to procure Motorola push-to-talk communications equipment for the Bureau of Indian Affairs Office of Justice Services.

Motorola equipment is utilized by all OJS Districts to provide public safety communications interoperability with BIA Law Enforcement Officers. The APX 8500 and APX 8000 is compatible with existing training procedures and equipment that is in service in all OJS Law Enforcement vehicles. Utilizing this equipment greatly enhances officer and public safety.

Currently there are 200 of these radios in use and issuance of a different brand would require retraining officers to use new equipment creating an officer/community safety risk. Technicians would need to be retrained and new software and programing equipment would need to be procured.

Technician training is typically ~$3,500.00 per student X 12 technicians = ~$42K, new accessories and programing equipment for 20 portables ~20% of radio cost an additional $26,400.00. These costs ($68,400.00), would be incurred to support 1/2 of 1% of our portable radios. Officer/public safety cannot be calculated as a dollar figure, an officer during a violent or life safety stressful encounter will be forced to forget the use of the portable previously issued and rely upon memory of training for new equipment.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
