LIMITED SOURCE JUSTIFICATION

J&A Number: JA15-079

Upon the basis of the following justification, I, as The Procuring Activity Competition Advocate, hereby approve this limited source justification in accordance with FAR 8.405-6(b)(1). The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program.

JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Defense Information Systems Agency (DISA), Global Combat Support System – Joint (GCSS- J), P.O. Box 549., Ft. Meade, MD 20755

Contracting Activity: Defense Information Technology Contracting Office - National Capital Region (NCR), P.O. Box 549, Ft. Meade, MD 20755

2. NATURE/DESCRIPTION OF ACTION(S):

The nature of this action is to procure proprietary, brand-named, commercial off-the-shelf (COTS) Red Hat software. The GCSS-J PMO requests a firm-fixed priced contract for the annual renewal of Red Hat Support for JBoss EAP, JDV, and RHEL Software. The period of performance for the requirement will be 26 May 2015 - 25 May 2016 and will be procured using the DoD ESI BPA. Fiscal Year (FY) 15 Operation and Maintenance (O&M) funds will be utilized for this procurement.

3. DESCRIPTION OF SUPPLIES/SERVICES:

JBoss EAP, a fully certified Java EE platform, offers a single platform to quickly develop and deploy applications anywhere-on-premise, in virtualized environments, or in the cloud. JDV enables data integration within Service-Oriented Architecture (SOA) environments built on JBoss EAP.

JDV and JBoss EAP, a middleware product, are integral components of GCSS-J architecture that enable end users to retrieve data which can then be manipulated in the users’ browser thereby reducing the amount of network processing time required to perform an action. This results in improved performance for the end users.

RHEL orchestrates the hardware resources that fulfill the infrastructure’s basic computing requirements such as CPU, memory, networking, and storage. It offers storage management capabilities, such as snapshot and backup tools; military-grade security technologies such as Security Enhanced Linux; and runs on highly scalable, multi-core systems that support the most demanding workloads.

4. IDENTIFICATION OF LIMITED SOURCE AUTHORITY AND DEMONSTRATION OF

CONTRACTOR’S UNIQUE QUALIFICATIONS:

(a) Circumstances Justifying Limiting the Source: This acquisition is conducted under the authority of FAR 8.405-6(b)(1), items peculiar to one manufacturer—the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

Page 3 of 6 Pages

(b) Description of the Justification: Red Hat provides maintenance support subscriptions for JBoss EAP, JDV, and RHEL software tools. The JBoss EAP is a subscription-based application server runtime platform used for building, deploying, and hosting highly transactional Java applications and services for the GCSS-J application. It is a key component of the JBoss Enterprise Portal Platform, a Java 2 Platform, Enterprise Edition (J2EE) platform for developing and deploying enterprise Java applications, web applications, services, and portal.

. GCSS-J was designed around these components; nothing else can be substituted. GCSS-J cannot function without them.

(c) Justification:

(1) Minimum Government requirements: The minimum government requirement is for

Red Hat software, as detailed in paragraph 3 above.

(2) Proposed sole-source contractor: Not applicable.

(3) Discussion regarding cause of the limited source situation: RHEL (Red Hat

Enterprise Linux) is the OS (Operating System) that GCSS-J was designed for and runs on. GCSS-J will not run on any other operating system and would have severe compatibility problems with any other version of Linux.

The GCSS-J application has been developed and built with Jobs EAP, JDV, and RHEL since 2009. These software tools have been proven to meet the application development requirement for a reliable and secured system. So far, there is no other software that has met GCSS-J’s development requirements. To purchase other software product would put GCSS-J application at severe risk since they would not be compatible forcing a complete rewrite of the GCSS-J application. Other products cannot interface within the GCSS-J application, this aspect of the GCSS-J system would have to be replaced with compatible COTS ultimately impacting the performance of the GCSS-J application. This would therefore breach the established program baseline in schedule, cost, and performance. It will be detrimental to GCSS-J if a product other than Red Hat’s JBoss is purchased.

(4) Demonstration of limited source: In accordance with Defense FAR Supplement (DFARS) 208.7402, the DoD ESI BPA is a priority source; and the recommendation is to solicit a quote from the DoD ESI BPA contract holds authorized to provide the Red Hat software products. Red Hat’s only authorized DoD ESI BPA resellers are Carahsoft Technology and DLT Solutions.

Page 4 of 6 Pages

(5) Procurement discussion: The required Red Hat Software is proprietary and manufactured by Red Hat. Red Hat owns the copyrighted source code with legal rights, privileges, and ownership contained therein. No other source may legally modify or change the software, nor would they have access to the source code to do

so. Red Hat, the OEM, or its authorized resellers will provide the most economically feasible solution to satisfy the government’s requirement for software.

(6) Impact: If a product other than JBoss is purchased, the entire GCSS-J software and hardware architecture will have to be reengineered. The cost impact is estimated to be approximately for development man-hours.

5. BEST VALUE DETERMINATION:

Prices under the DoD ESI BPA have been negotiated with significant discounts and are considered fair and reasonable; therefore, no additional fair and reasonable determination is required. The Contracting Officer will compare quoted prices to the pre-established ESI BPA prices and the Independent Government Cost Estimate (IGCE). In addition, in accordance with FAR 8.405-4, the Contracting Officer will seek price reductions prior to award. A determination will be made that the order represents the best value to the Government and results in the lowest overall cost alternative to meet the Government's needs.

6. MARKET RESEARCH:

The Services Development Directorate (BDC-SD) conducted market research from February 2015 through April 2015 for the requested Red Hat Software. Market research included using DoD ESI and the Open Market. It was determined that the software requirements are available under the Red Hat DoD ESI BPA. Therefore, in accordance with DFARS 208.74, this requirement will be competed amongst the Red Hat DoD ESI BPA holders (CarahSoft Technologies and DLT).

(b) DISA continues to evaluate potential usage of other brands. At this time there are no alternatives to this procurement that can satisfy the requirements, both technically and in the time required. Actions are taken on a regular basis to remove barriers to competition while providing cost effective solutions for the protection and advancement of the Agency's mission critical systems. The government will continue to examine the marketplace for alternative viable solutions for future acquisitions.
